February 16, 2021
*Due to public health concerns and guidance, in accordance with Iowa Code Sections
21.4(1)(b) and 21.8, this meeting of the Waukee City Council was conducted electronically as
holding the meeting in person was impossible or impractical.
(A) Call to Order – The regular meeting of the Waukee City Council was called to order by Mayor
Clarke at 5:30 p.m. at Waukee City Hall, 230 W. Hickman Rd. and electronically via Zoom
pursuant to the electronic meeting provisions of Iowa Code Sections 21.4(1)(b) and 21.8.
(B) Pledge of Allegiance (temporarily suspended)
(C) Roll Call – The following members were present: Mayor Courtney Clarke; Council Members
Anna Bergman (electronically), R. Charles Bottenberg (electronically), Larry R. Lyon
(electronically), Ben Sinclair (electronically). Absent: Council Member Chris Crone. (Council
Member Crone began electronic participation at 5:54 p.m.)
Also in attendance: City Administrator Tim Moerman, Development Services Director Brad
Deets (electronically), Public Works Director/City Engineer Rudy Koester (electronically), Parks
& Recreation Director Matt Jermier (electronically), Human Resources Director Michelle Lindsay
(electronically), Marketing & Communications Director Summer Evans (electronically), IT
Director Son Le (electronically), Fire Chief Clint Robinson (electronically), Police Lt. Jeremy
Long, City Clerk Rebecca D. Schuett, City Attorney Steve Brick (electronically).

(E) Agenda Approval – Council Member Lyon moved to approve the agenda; seconded by Council
Member Sinclair. Results of vote: Ayes: Bergman, Bottenberg, Lyon, Sinclair. Nays: None.
Absent: Crone. Motion carried 4 – 0 – 1.

(G) Public Hearings:
1) On an ordinance to amend Chapter 169, Zoning Ordinance, City of Waukee, Iowa, by
rezoning certain property from A-1 to R-2 and R-2/PD-1, a parcel to be known as Fox
Valley – Mayor Clarke opened the public hearing and asked if any written correspondence
had been received; City Clerk Schuett replied in the negative. Development Services
Director Deets reviewed the application. The Planned Development Overlay District allows
for smaller single-family lots. The development includes an east/west collector road with no
direct driveway access. The development concept plan shows a parcel not included in the
current rezoning application that may develop as a future school site. If the parcel is not
developed as such, it will likely move forward as additional single family residential and
parkland. The current rezoning application includes parkland in the SW corner. Stormwater
detention ponds planned for the parcel will be owned and maintained by a homeowners
association. No comments were made by the public in attendance.
2) On an ordinance to amend Chapter 169, Zoning Ordinance, City of Waukee, Iowa, by
rezoning certain property from A-1 to R-4, a parcel known as Broderick property –
Mayor Clarke opened the public hearing and asked if any written correspondence had been
received; City Clerk Schuett replied in the negative. Development Services Director Deets
reviewed the application, as well as a map showing overall current and anticipated
development in the area. The development concept plan shows a majority of private internal
streets, with one east/west roadway bisecting the development. Mr. Deets then reviewed
exterior elevation concepts. No comments were made by the public in attendance.
3) On an ordinance to amend Chapter 160 Site and Building Development Standards,
Chapter 165, Zoning Regulations, Definitions and General Regulations and Chapter
169 Zoning Regulations, District Regulations by incorporating regulations for interior
storage uses – Mayor Clarke opened the public hearing and asked if any written

correspondence had been received; City Clerk Schuett replied in the negative. Development
Services Director Deets reviewed the proposed ordinance changes, which would include
restrictions to indoor self-storage only, a requirement for retail space on the main floor along
the building frontage, and architectural standards compatible with other commercial buildings
in the district. No comments were made by the public in attendance.
4) On a General Obligation Lease Purchase Agreement in the amount of not to exceed
$50,000 for the acquisition of golf course equipment – Mayor Clarke opened the public
hearing and asked if any written correspondence had been received; City Clerk Schuett
replied in the negative. Parks & Recreation Director Jermier reviewed the agreement for the
acquisition of a rough mower for use at Sugar Creek Municipal Golf Course. At the end of
the lease term, City staff will determine if it is advisable to purchase the mower. The first
payment for the lease is due August 2021 and has been included in the proposed FY2022
City budget. No comments were made by the public in attendance.
(H) Public Hearing Action Items:
1) Ordinance: Consideration of approval of an ordinance to amend Chapter 169, Zoning
Ordinance, City of Waukee, Iowa, by rezoning certain property from A-1 to R-2 and R-
2/PD-1, a parcel to be known as Fox Valley [introduction; first reading] – Council
Member Sinclair introduced the ordinance and moved to approve the first reading in title
only; seconded by Council Member Lyon. Mayor Clarke requested clarification on how the
City plans to identify the percentage of single family lots allowed to develop with a smaller lot
size; Development Services Director Deets reviewed the council directive, noting that this
specific development would have a higher percentage of smaller lots than typically allowed
due to development plans for the overall area and the inclusion of lots along a collector road.
Results of vote: Ayes: Bergman, Bottenberg, Lyon, Sinclair. Nays: None. Absent: Crone.
Motion carried 4 – 0 – 1.
2) Ordinance: Consideration of approval of an ordinance to amend Chapter 169, Zoning
Ordinance, City of Waukee, Iowa, by rezoning certain property from A-1 to R-4, a
parcel known as Broderick property [introduction; first reading] – Council Member
Sinclair introduced the ordinance and moved to approve the first reading in title only;
seconded by Council Member Lyon. Council Member Sinclair asked how parkland
dedication funds are allocated; Development Services Director Deets reviewed the parkland
dedication ordinance requirements, clarifying that the City cannot require developers to
provide cash in lieu of parkland but that developers can make such an offer. (Council
Member Crone began electronic participation at 5:54 p.m.) Results of vote: Ayes: Bergman,
Bottenberg, Crone, Lyon, Sinclair. Nays: None. Motion carried 5 – 0.
3) Ordinance: Consideration of approval of an ordinance to amend Chapter 160 Site and
Building Development Standards, Chapter 165, Zoning Regulations, Definitions and
General Regulations and Chapter 169 Zoning Regulations, District Regulations by
incorporating regulations for interior storage uses [introduction; first reading]–
Council Member Crone introduced the ordinance and moved to approve the first reading in
title only; seconded by Council Member Sinclair. Results of vote: Ayes: Bergman,
Bottenberg, Crone, Lyon, Sinclair. Nays: None. Motion carried 5 – 0.
4) $47,750 General Obligation Lease Purchase Agreement (golf course equipment)
A. Resolution: Consideration of approval of a resolution instituting proceedings to
take additional action for the authorization and issuance of a General Obligation
Lease Purchase Agreement in the amount of not to exceed $50,000 for the
acquisition of golf course equipment – Council Member Lyon moved to approve the
resolution; seconded by Council Member Sinclair. Council Member Bottenberg stated
that he would abstain from voting due to a professional conflict of interest. Results of
vote: Ayes: Bergman, Crone, Lyon, Sinclair. Nays: None. Absentions: Bottenberg.
Motion carried 4 – 0 – 1. (Resolution #2021-063)
B. Motion: Consideration of approval of a motion that the form of Tax Exemption
Certificate be placed on file and approved – Council Member Crone moved for
approval; seconded by Council Member Lyon. Council Member Bottenberg stated that
he would abstain from voting due to a professional conflict of interest. Results of vote:

Ayes: Bergman, Crone, Lyon, Sinclair. Nays: None. Absentions: Bottenberg. Motion
carried 4 – 0 – 1.
C. Resolution: Consideration of approval of a resolution authorizing action to enter
into a Lease Purchase Agreement and levying a tax to pay said Lease Purchase
Agreement – Council Member Lyon moved to approve the resolution; seconded by
Council Member Sinclair. Council Member Bottenberg stated that he would abstain from
voting due to a professional conflict of interest. Results of vote: Ayes: Bergman, Crone,
Lyon, Sinclair. Nays: None. Absentions: Bottenberg. Motion carried 4 – 0 – 1.

5) Resolution: Consideration of approval of a resolution approving site plan for Hyper
Energy Bar [1025 SE Laurel Street] – Council Member Crone moved to approve the

reviewed the site plan, lot ingress and egress, stormwater detention and exterior elevations.

6) Resolution: Consideration of approval of a resolution approving the extension of a
Solid Waste Services Contract with Ankeny Sanitation, Inc. – Council Member Sinclair
moved to approve the resolution; seconded by Council Member Lyon. Public Works
Director/City Engineer Koester reviewed the current contract, which expires June 2021, and
recommended extending the agreement. Council Member Lyon complimented Ankeny
Sanitation, Inc. (ASI) on their work and asked how recycled materials are handled, noting
that the program only makes sense if the materials are actually recycled. Dave Massey with
ASI (participating electronically) noted that the recycling markets have been down over the
last several years but appear to be trending upward again. He then noted the tonnage of
recyclable materials collected in Waukee over the previous year, adding that the recycling
rebate outlined in the contract has not been available since 2017. Mayor Clarke clarified that
the rebate was not available because it is not currently as cost-effective as in the past, and
not because the materials are not being recycled; Mr. Massey replied in the affirmative. Mr.
Koester added that recycling helped prolong the life of landfills by diverting certain materials
for reuse. Council Member Lyon asked if the City paid extra for recycling; Mr. Koester
responded that it was part of the fee charged per household and included yard waste and
bulk item pick-up. Results of vote: Ayes: Bergman, Bottenberg, Crone, Lyon, Sinclair. Nays:
None. Motion carried 5 – 0. (Resolution #2021-076)
7) Resolution: Consideration of approval of a resolution authorizing an application to the
Des Moines Area Metropolitan Planning Organization (MPO) Transportation
Alternatives Program (TAP) [School and Trail Crossing Improvements Project] –
Council Member Crone moved to approve the resolution; seconded by Council Member
Lyon. Public Works Director/City Engineer Koester reviewed the grant application and
approval timeline, noting that the projects in the City’s application included improved
pedestrian crossings as part of the Safe Routes to School program. Results of vote: Ayes:
