AGENDA ITEM: Consideration of approval of a resolution consenting to Real Estate
Agreement between Waukee Community School District and the Richard
L. Petersen Revocable Trust and the Clare B. Petersen Revocable Trust
(NW Douglas Parkway extension)
FORMAT: Resolution
SYNOPSIS INCLUDING PRO & CON: The Waukee Community School District has come to
an agreement with Richard and Clare Petersen for the acquisition or right
of way and construction of NW Douglas Parkway from NW 10th Street to
the new 8/9 school building site which borders the Petersen property.
As a part of the agreement, the parties have requested the City to consent
to the agreement as it pertains to special assessments associated with the
road extension project and future access locations. The City Attorney
has reviewed the agreement and is comfortable with the proposed
language and the City’s consent.
The Waukee Community School District has previously approved this
agreement at their meeting held on March 23, 2021.

RESOLUTION 2021-
APPROVING CONSENT TO REAL ESTATE AGREEMENT BETWEEN WAUKEE
COMMUNITY SCHOOL DISTRICT, RICHARD L. PETERSEN REVOCABLE TRUST AND
CLARE B. PETERSEN REVOCABLE TRUST

IN THE NAME AND BY THE AUTHORITY OF THE CITY OF WAUKEE, IOWA
WHEREAS, the City of Waukee, Dallas County, State of Iowa, is a duly organiz ed Municipal
Organization; AND,
WHEREAS, the Waukee Community School District is engaged in the process of acquiring real estate
for the construction of a new school building and associated facilities; AND,
WHEREAS, in order to provide appropriate access to the new school building, the District needs to make
various road improvements in order to construct an extension of Douglas Parkway across property
currently owned by Richard L. Petersen Revocable Trust and Clare B. Petersen Revocable Trust, which
will be dedicated to the City of Waukee upon completion for use as public right of way; AND,
WHEREAS, the parties discussions have resulted in a real estate agreement that requires the consent of
the City of Waukee specific to special assessments and future access along Douglas Parkway.
NOW THEREFORE BE IT RESOLVED by the City Council of the City of Waukee, Iowa, that
consent to the Real Estate Agreement between Waukee Community School District, Richard L. Petersen
Revocable Trust and Clare B. Petersen Revocable Trust is is hereby approved.
BE IT FURTHER RESOLVED that the Mayor is authorized to execute any and all documents to
effectuate the real estate agreement, and that the City Clerk shall cause the originals of the agreement to
be recorded upon the properties by submitting the original to the Dallas County Recorder with the
appropriate recording fees.
Passed by the City Council of the City of Waukee, Iowa, and approved this the 5th day of April,
2021.
