HomeMy WebLinkAbout2021-04-05-J01L University Ave Overlay_Amendment to Developer's AgrCITY OF WAUKEE, IOWA CITY COUNCIL MEETING COMMUNICATION MEETING DATE: April 5, 2021 AGENDA ITEM:Consideration of approval of a resolution approving Amendment of Developer’s Agreement between Waukee Community School District and the City of Waukee, Iowa [University Avenue Maintenance and Improvements] FORMAT:Resolution SYNOPSIS INCLUDING PRO & CON: The Waukee Community School District and the City of Waukee entered into a Developer’s Agreement dated January 18, 2016. The School District and the City of Waukee agreed to several cost sharing arrangements pertaining to the University Avenue future maintenance and improvements. In the Developer’s Agreement, paragraph 3(E) provides for the annual maintenance-chip sealing of University Avenue. WCSD intends to construct and use the property for its Transportation Facility and there will be heavy construction and bus traffic on University Avenue associated with the District’s construction and use of the facility. WCSD agrees to pay the City one-half (1/2) of the cost, up to $10,000.00 annually, incurred by the City in chip sealing University Avenue west of its intersection on 6th Street. The City shall invoice the WCSD for its share of such cost after it is incurred by the City, and the WCSD shall pay the amount due within 30 days of receipt of the invoice. The WCSD and the City of Waukee have explored options to mitigate the need for ongoing chip sealing maintenance which will continue for several years as more particularly provided in the Developer’s Agreement. The City of Waukee in consultation with the WCSD, has undertaken a Hot Mix Asphalt overlay on University Avenue to eliminate the need for ongoing chip sealing operations and save the parties the recurring costs for chip sealing University Avenue and WCSD has agreed to reimburse the City the sum of $60,000.00 representing WCSD’s share of the cost of the Hot Mix Asphalt. FISCAL IMPACT INCLUDING COST/BENEFIT ANALYSIS: $60,000.00 to be paid to the City within 30 days of receiving an invoice from the City of Waukee. Amendment to Developer’s Agreement PREPARED BY: Beth Richardson REVIEWED BY: Rudy Koester RK PUBLIC NOTICE INFORMATION – NAME OF PUBLICATION: DATE OF PUBLICATION: AGENDA ITEM: J1L THE CITY OF WAUKEE, IOWA RESOLUTION 2021- APPROVING AMENDMENT TO DEVELOPER’S AGREEMENT BETWEEN THE WAUKEE COMMUNITY SCHOOL DISTRICT AND THE CITY OF WAUKEE IN THE NAME AND BY THE AUTHORITY OF THE CITY OF WAUKEE, IOWA WHEREAS, the City of Waukee, Dallas County, State of Iowa, is a duly organized Municipal Organization; AND, WHEREAS, the City of Waukee and the Waukee Community School District entered into a Developer’s Agreement dated January 18, 2016 where the WCSD and the City of Waukee agreed to several cost sharing arrangements pertaining to the University Avenue future maintenance and improvements; AND, WHEREAS, in the Developers Agreement, the WCSD agreed to pay the City one-half (1/2) of the cost, up to $10,000.00 annually, incurred by the City in chip sealing University Avenue west of its intersection with 6th Street; AND, WHEREAS, both parties explored options to mitigate the need for ongoing chip sealing maintenance which will continue for several years; AND, WHEREAS, in consultation with WCSD staff, the City has undertaken a Hot Mix Asphalt (HMA) overlay on University Avenue to eliminate the need for ongoing chip sealing operations and save the parties the recurring costs for chip sealing University Avenue; AND, WHEREAS, the WCSD has agreed to reimburse the City of Waukee the sum of $60,000.00 representing WCSD’s share of the cost of the HMA project. NOW THEREFORE BE IT RESOLVED by the City Council of the City of Waukee that the Amendment to Developer’s Agreement between the Waukee Community School District and the City of Waukee, Iowa are hereby approved.
