AGENDA ITEM:Consideration of approval of a resolution approving agreement with
Waukee Betterment Foundation Inc. [Triumph Park Fishing Pier Project]
FORMAT:Resolution
SYNOPSIS INCLUDING PRO & CON: This agreement between the City of Waukee and
Waukee Foundation, Inc. is for the construction of the fishing pier at
Triumph Park. The Waukee Foundation, Inc. has been raising private
funds for the addition of a fishing pier for the use of the general public,
including, but not limited to, persons with disabilities and is in the
process of raising funds to privately fully fund the construction of a
fishing pier.
The foundation has negotiated with a contractor capable of constructing
said fishing pier for the price of $610,000.00 and the foundation wishes
to make a contribution to the City equal to said amount to the City to
fully fund the construction of said amenity. Funding is conditioned upon
the use of Larson Construction for an initial contract price of
$610,000.00. As a condition of such funding the Foundation requires
that the City enter into a contract, acceptable to the City, for the
construction of the fishing pier in accordance with the plans and
specifications.
The Foundation is solely providing the funding to the City to construct a
fishing pier in Triumph Park for the use and enjoyment of the general
public and the Foundation does not have any control or interest in the
ownership, design, construction, maintenance or operation of Triumph
Park or the facilities and structures being constructed including the
fishing Pier. The City of Waukee will own and maintain the facilities
associated with this agreement.

RESOLUTION 2021-
APPROVING TRIUMPH PARK CONTRIBUTION AGREEMENT BETWEEN THE
WAUKEE BETTERMENT FOUNDATION AND THE CITY OF WAUKEE
IN THE NAME AND BY THE AUTHORITY OF THE CITY OF WAUKEE, IOWA
WHEREAS, the City of Waukee, Dallas County, State of Iowa, is a duly organized Municipal
Organization; AND,
WHEREAS, the City has budgeted public funds for the purpose of construction and development of a
recreation and sports complex known as Triumph Park (“City Project”) but there is a need for
supplemental funding from private sources to complete the full build-out of the complex; AND,
WHEREAS, on September 8, 2020, the Waukee City Council approved a Triumph Park Contribution
Agreement with the Waukee Betterment Foundation (the “Foundation”) to aid in the completion of
Miracle Field surfacing thereby completing the Miracle Field in the first phase, as well as an Epic
Playground (Resolution #2020-341); AND,
WHEREAS, the Foundation has been raising private funds for the addition of a fishing pier for the use of
the general public, including, but not limited to, persons with disabilities, and is in the process of raising
funds to privately fully fund the construction of a fishing pier; AND,
WHEREAS, the City and Foundation desire to enter into an agreement setting forth the respective
obligations of the both parties toward the funding and construction of the fishing pier.
NOW THEREFORE BE IT RESOLVED by the City Council of the City of Waukee, Iowa, that the
Triumph Park Contribution Agreement between the Waukee Betterment Foundation and the City of
Waukee is hereby approved.
Passed by the City Council of the City of Waukee, Iowa, and approved this the 5th day of April,
2021.
