of America Marketing Agreement

SYNOPSIS INCLUDING PRO & CON: On July 16, 2018 with revisions approved on August 20,
2018 the City of Waukee entered into a Marketing Agreement with Utility Service Partners Private
Label, Inc., d/b/a Service Line Warranties of America (SLWOA), Resolution No. 18-331 giving
residential homeowners an option of purchasing a service line warranty for sewer and water line
laterals between the water and/or sanitary sewer main and the connection on the private property. The
agreement was for three years with automatic renewal for an additional one year terms unless one of
the parties gives the other written notice at least 90 days prior to the end of the term. City staff
recommend terminating this agreement prior to the renewal date of July 16, 2021 as the agreement is
no longer necessary with SLWOA no longer using Waukee’s logo for their marketing materials per
City staff’s request.

RESOLUTION 2021-
APPROVING TERMINATING SERVICE LINE MARKETING AGREEMENT WITH
UTILITY SERVICE PARTNERS PRIVATE LABEL, INC., D/B/A/ SERVICE LINE
WARRANTIES OF AMERICA
IN THE NAME AND BY THE AUTHORITY OF THE CITY OF WAUKEE, IOWA
WHEREAS, the City of Waukee, Dallas County, State of Iowa, is a duly organized Municipal
Organization; AND,
WHEREAS, the City entered into a Marketing Agreement with Utility Service Partners Private
Label, Inc., d/b/a Service Line Warranties of America in order to market optional sewer and
water line lateral service warrantees to residential homeowners on July 16, 2018, Resolution No.
18-281; AND,
WHEREAS, revisions to the agreement were approved on August 20, 2018, Resolution No. 18-
331; AND,
WHEREAS, the agreement was approved for three years with automatic renewal for additional
one year terms unless one of the parties gives the other written notice at least 90 days prior to the
end of the term; AND,
WHEREAS, the City of Waukee seeks to terminate the Marketing Agreement with Utility
Service Partners Private Label, Inc., d/b/a Service Line Warranties of America.
NOW THEREFORE BE IT RESOLVED by the City Council of the City of Waukee directs
City Staff to proceed with termination notice for Marketing Agreement with Utility Service
Partners Private Label, Inc., d/b/a Service Line Warranties of America and the City of Waukee,
Iowa is hereby approved.
Passed by the City Council of the City of Waukee, Iowa, and approved the 19th day of April,
2021.
