SYNOPSIS INCLUDING PRO & CON: The lease between the City of Waukee, the Waukee
American Legion and VFW for the Veteran’s Hall at 410 6th St. has
expired. The tenants request renewal of the lease agreement.
FISCAL IMPACT INCLUDING COST/BENEFIT ANALYSIS:
COMMISSION/BOARD/COMMITTEE COMMENT:
STAFF REVIEW AND COMMENT: The City Attorney has reviewed the lease agreement
and recommends no changes from the previous agreement.
RECOMMENDATION: Approve the resolution.

RESOLUTION 2021-
APPROVING LEASE – BUSINESS PROPERTY BETWEEN THE CITY OF WAUKEE,
IOWA; WAUKEE POST 11517 VETERANS OF FOREIGN WARS OF THE UNITED
STATES, INC.; AND WAUKEE POST 737, THE AMERICAN LEGION, DEPARTMENT OF
IOWA, INC. (410 6TH STREET)
IN THE NAME AND BY THE AUTHORITY OF THE CITY OF WAUKEE, IOWA
WHEREAS, the City owns the property locally known as 410 6th St, Waukee, Iowa which the City
formerly offered for use as the Waukee Community Center; AND,
WHEREAS, on April 6, 2009, the Waukee City Council held public hearing and approved a Lease –
Business Property between the City of Waukee and the Waukee Post 737, the American Legion,
Department of Iowa, Inc. (the “Tenant”) (Resolution #09-69); AND,
WHEREAS, on May 2, 2016, the Waukee City Council approved a revised lease for the subject
property (Resolution #16-153), which has since expired; AND,
WHEREAS, the Tenant has notified the City of their intent to enter into a new lease agreement for the
subject property;
BE IT THEREFORE RESOLVED by the City Council of the City of Waukee that the Lease –
Business Property between the City of Waukee, Iowa; Waukee Post 11517 Veterans of Foreign Wars
of the United States, Inc.; and Waukee Post 737, the American Legion, Department of Iowa, Inc. is
hereby approved.
Passed by the City Council of the City of Waukee, Iowa, and approved this the 3rd day of May, 2021.
