AGENDA ITEM: Consideration of approval of a Motion to set a Public Hearing Date of
June 21, 2021, as the date of public hearing on an ordinance to amend
Chapter 169, Zoning Ordinance, City of Waukee, Iowa, by rezoning
certain property from A-1 Agricultural District to R-2 One & Two
Family Residential District, R-3 Multi-Family Residential District, R-4
Row Dwelling & Townhome District, and C-1 Community & Highway
Service Commercial District [Waukee Crossing 2]
FORMAT: Motion
SYNOPSIS INCLUDING PRO & CON: Staff has received a request for rezoning of
approximately 133 acres of property from A-1 to R-2, R-3, R-4 and C-1.
The property is located south of the new high school and north of
Hickman Road.
In order to set a public hearing to discuss a rezoning, the applicant is
required to receive written consent from 50% of the surrounding property
owners within a 250-foot radius of the property. Alternatively, the City
Council can set a public hearing date on behalf of the applicant. The
applicant has indicated that they have been unsuccessful in receiving the
50% consent from surrounding property owners.
The applicant has received consent from a total of 40.93% of property
owners within 250-feet. The applicant has contacted each owner within
this area and has either received consent, no consent, or gotten no reply.
Staff would also add that the City of Waukee and the Waukee
Community School District are two of the property owners within the
250-foot radius, however, neither party is eligible to provide consent.
FISCAL IMPACT INCLUDING COST/BENEFIT ANALYSIS:

STAFF REVIEW AND COMMENT: Staff would recommend approval of the City Council
setting the public hearing date for June 21, 2021 to discuss this matter
further. Council action to set the public hearing date does not indicate
support for the project. Rather, it represents the Council’s willingness to
allow the public hearing process to continue.
RECOMMENDATION: Approve the motion.
