Ordinance No. 2989, amending Chapter 203, Water Rates [Introduction; first,
second, third (final) readings]

SYNOPSIS INCLUDING PRO & CON: On April 19, 2021, the Waukee City Council approved
Ordinance No. 2989, which repealed existing rates for water and enacted new
rates. City staff have since discovered an error within Section 203.2(F)
related to Irrigation Water Rates, wherein the correct rate of $2.00 is written
as one dollar.
FISCAL IMPACT INCLUDING COST/BENEFIT ANALYSIS:

STAFF REVIEW AND COMMENT: As the ordinance corrects an error and does not impact rates,
City staff recommends approval of the first reading of the ordinance in title
only and waiver of the second and third readings. The Code of Iowa requires
a vote of not less than three-fourths of all the members of the council (or 4 out
of 5, in Waukee’s case) in order to waive readings of an ordinance.
RECOMMENDATION: Introduce the ordinance, approve the first reading in title only, waive the
second and third readings and place the ordinance on final passage.

ORDINANCE NO.
AN ORDINANCE CORRECTING A SCRIVENER’S ERROR IN ORDINANCE NO.
2989, AMENDING CHAPTER 203, WATER RATES
WHEREAS, on April 19, 2021, the Waukee City Council approved Ordinance No. 2989,
which repealed existing rates for water and enacted new rates as specified in the ordinance;
AND,
WHEREAS, said ordinance contains an error within Section 203.2(F) related to
Irrigation Water Rates, wherein the correct rate of $2.00 is written as one dollar.
BE IT ORDAINED by the City Council of the City of Waukee:
Section 1: Ordinance No. 2989, referencing Chapter 203, Water Rates, is amended as
follows to correct a scrivener’s error within Section 203.2(F), Irrigation Water Rates:
§203.2 Water Rates. Water shall be furnished at the following monthly rates per
meter within the city limits:
F.Irrigation Water Rates. Beginning July 1, 2021, irrigation water usage
will be charged at a rate of two dollars ($2.00) higher per 1,000 gallons
per month than the regular domestic meter rated listed in (B) above.
Section 2 Repealer. All ordinances or parts of ordinances in conflict with the provisions
of this ordinance are hereby repealed.
Section 3. Severability Clause. If any section, provision or part of this ordinance shall
be adjudged invalid or unconstitutional, such adjudication shall not affect the validity of the
ordinance as a whole or any section, provisions or part thereof not adjudged invalid or
unconstitutional.
Section 4. Effective Date. This ordinance shall be in effect on July 1, 2021 after its
final passage, approval and publication as provided by law.
