AGENDA ITEM: Consideration of approval of a resolution approving a Development
Agreement with Castle Productions, LLC (Castle Ranch)
FORMAT: Resolution
SYNOPSIS INCLUDING PRO & CON: The City Council has recently approved the rezoning
for Castle Ranch which is a 10 acre single family residential subdivision
located north of the Fox Valley development on the west side of Warrior
Lane. In order to develop the property, certain public utilities including
water main and sanitary sewer need to be extended including the
extension of utilities across the neighboring property owner to the south
(Brcka property).
Staff has prepared a development agreement, which defines the
obligations of both the City and developer related to the development of
the property. The agreement includes provisions related to utilities, road
improvements and parkland dedication among other things. Per the
agreement, the City would be obligated to extend sanitary sewer to serve
the site by December 31, 2021 and complete an asphalt overlay along
Warrior Lane by November 30, 2021. In exchange, the developer agrees
to final plat a minimum of 20 residential lots by June 30, 2022. The
sanitary sewer and asphalt projects have been programmed in and
budgeted for in 2021.

RESOLUTION 2021-
APPROVING DEVELOPER’S AGREEMENT FOR CASTLE RANCH
[CASTLE PRODUCTIONS, LLC]
IN THE NAME AND BY THE AUTHORITY OF THE CITY OF WAUKEE, IOWA
WHEREAS, the City of Waukee, Dallas County, State of Iowa, is a duly organized Municipal
Organization; AND,
WHEREAS, the City Council has previously approved the rezoning of a property to be known as Castle
Ranch (Ordinance 2981) located west of Warrior Lane and north of Hickman Road; AND,
WHEREAS, the City has been in discussion with the developer, Castle Productions, LLC, regarding
certain obligations of both the City and the developer related to public improvements and requirements of
the subdivision; AND,
WHEREAS, the discussions have resulted in a development agreement that the City Staff believes are in
the best interest of the City to approve.
NOW THEREFORE BE IT RESOLVED by the City Council of the City of Waukee, Iowa, that the
Developer’s Agreement with Castle Productions, LLC is hereby approved.
BE IT FURTHER RESOLVED that the Mayor is authorized to execute any and all documents to
effectuate the development agreement, and that the City Clerk shall cause the originals of the agreement
to be recorded upon the properties by submitting the original to the D allas County Recorder with the
appropriate recording fees.
Passed by the City Council of the City of Waukee, Iowa, and approved this the 7th day of June,
2021.
