AGENDA ITEM: Consideration of approval of a resolution approving a Development
Agreement with Castle Productions, LLC and David and Rita Brcka
(Castle Ranch)
FORMAT: Resolution
SYNOPSIS INCLUDING PRO & CON: The City Council has recently approved the rezoning
for Castle Ranch which is a 10 acre single family residential subdivision
located north of the Fox Valley development on the west side of Warrior
Lane. In order to develop the property, water main and sanitary sewer
need to be extended from the Fox Valley subdivision and across the
Brcka property which adjoins the Fox Valley subdivision.
Castle Productions, LLC is agreeable to extending the utilities across the
Brcka property as well as connecting the Brcka house to the new utility
systems. In exchange, the Brcka’s have agreed to grant the necessary
easements to accommodate the utility construction.

STAFF REVIEW AND COMMENT: Staff would recommend approval of the development
agreement.

RESOLUTION 2021-
APPROVING DEVELOPMENT AGREEMENT RELATED TO CASTLE RANCH
IMPROVEMENTS
[CASTLE PRODUCTIONS, LLC, DAVID AND RITA BRCKA]
IN THE NAME AND BY THE AUTHORITY OF THE CITY OF WAUKEE, IOWA
WHEREAS, the City of Waukee, Dallas County, State of Iowa, is a duly organized Municipal
Organization; AND,
WHEREAS, the City Council has previously approved the rezoning of a property to be known as Castle
Ranch (Ordinance 2981) located west of Warrior Lane and north of Hickman Road; AND,
WHEREAS, in order to develop the property, water main and sanitary sewer must be extended across the
adjoining David and Rita Brcka property; AND,
WHEREAS, a development agreement has been written which defines the obligations of both Castle
Productions LLC and David and Rita Brcka and City Staff believes the agreement is in the best interest of
the City to approve.
NOW THEREFORE BE IT RESOLVED by the City Council of the City of Waukee, Iowa, that the
Developer’s Agreement with Castle Productions, LLC and David and Rita Brcka is hereby approved.
BE IT FURTHER RESOLVED that the Mayor is authorized to execute any and all documents to
effectuate the development agreement, and that the City Clerk shall cause the originals of the agreement
to be recorded upon the properties by submitting the original to the D allas County Recorder with the
appropriate recording fees.
Passed by the City Council of the City of Waukee, Iowa, and approved this the 7th day of June,
2021.
