AGENDA ITEM:Consideration of approval of a resolution approving Amended and Restated
Storm Sewer Easement [Glynn Village Homeowners Association]
FORMAT: Consent
SYNOPSIS INCLUDING PRO & CON: This resolution amends the drainage tile easement that was
put in place prior to construction of the Glynn Village Trail Amenity park
project for the purposes of draining stormwater from the playground mulch
area. During construction it was determined that the location of the easement
was not going to work due to soil conditions and topography. The drainage
tile has been installed and this resolution amends the original agreement to the
better reflect what was actually constructed.

RESOLUTION 2021-
APPROVING AMENDED AND RESTATED STORM SEWER EASEMENT
[GLYNN VILLAGE HOMEOWNERS ASSOCIATION]
IN THE NAME AND BY THE AUTHORITY OF THE CITY OF WAUKEE, IOWA
WHEREAS, the City of Waukee, Dallas County, State of Iowa, is a duly organized Municipal
Organization; AND,
WHEREAS, Glynn Village Homeowners Association and the City of Waukee entered into a
Storm Sewer Easement dated April 17, 2020, and filed with the Dallas County Recorder in Book
2020 Page 8113; AND,
WHEREAS, said easement was entered into as part of the Glynn Village Trail Amenity Park
Project for the purposes of draining stormwater from the playground mulch area; AND,
WHEREAS, during project construction it was determined that the location of the easement
would need to be amended due to soil conditions and topography; AND,
WHEREAS, an amended and restated easement is proposed to reflect the actual construction.
NOW THEREFORE BE IT RESOLVED by the City of Waukee City Council in session this
21st day of June, 2021, that it hereby approves the Amended and Restated Storm Sewer
Easement [Glynn Village Homeowners Association].
