June 21, 2021
(A) Call to Order – The regular meeting of the Waukee City Council was called to order by Mayor
Pro Tem Bottenberg at 5:30 p.m. at Waukee City Hall, 230 W. Hickman Rd. and electronically
via Zoom.
(B) Pledge of Allegiance
(C) Roll Call – The following members were present: Council Members Anna Bergman Pierce, R.
Charles Bottenberg, Chris Crone, Larry R. Lyon, Ben Sinclair. Absent: Mayor Courtney Clarke.
Also in attendance: City Administrator Tim Moerman, Assistant City Administrator Brad Deets,
Finance Director Linda Burkhart, Public Works Director/City Engineer Rudy Koester, Planning
Coordinator Andy Kass, Human Resources Director Michelle Lindsay, Marketing &
Communications Director Summer Evans, IT Director Son Le, Fire Chief Clint Robinson, Police
Lt. Jeff Mellencamp, Police Officer Austin Gibbs, City Clerk Rebecca D. Schuett, City Attorney
Steve Brick.

(E) Agenda Approval – Council Member Sinclair moved to approve the agenda, removing
consideration of Consent Agenda items I1J and I1CC; seconded by Council Member Bergman
Pierce. Results of vote: Ayes: Bergman Pierce, Bottenberg, Crone, Lyon, Sinclair. Nays: None.
Motion carried 5 – 0.

(G) Public Hearings:
1) On an ordinance to amend Chapter 169, Zoning Ordinance, City of Waukee, Iowa, by
rezoning certain property from A-1 to R-2, R-3, R-4 and C-1, a parcel to be known as
Waukee Crossing 2 – Mayor Pro Tem Bottenberg opened the public hearing and asked if
any written correspondence had been received; City Clerk Schuett replied in the negative.
Planning Coordinator Kass briefly reviewed the application, noting that the applicant was
only able to obtain 41% consent from surrounding property owners, but that two of those
larger property owners are the City and the Waukee Community School District, neither of
which are eligible to consent. Mr. Kass reviewed a development concept plan. The
applicant does not intend to develop the full property, but to install infrastructure in order to
sell off parcels to others for development. The required parkland dedication is estimated at
this time, as there is not yet an exact number of lots, but there is an area of greenspace for
recreational trail development along the existing creek. Council Member Sinclair asked for
clarification on the 41% consent; Mr. Kass replied that the owner was at a disadvantage in
obtaining the correct consent percentage due to the City and school district property
ownership. Council Member Lyon asked why those two entities were ineligible to provide
consent; City Attorney Brick reviewed the applicable statutory code provisions. No
comments were made by the public in attendance.
2) On an ordinance to amend Chapter 169, Zoning Ordinance, City of Waukee, Iowa, by
rezoning certain property from K-OF/PD-1 to K-MF Stacked High/PD-1, a parcel to be
known as Kettlestone Apartments – Mayor Pro Tem Bottenberg opened the public
hearing and asked if any written correspondence had been received; City Clerk Schuett
replied in the negative. Planning Coordinator Kass briefly reviewed the application, noting
that the applicant had received the minimum 51% consent from surrounding property owners
and that no correspondence either for or against the proposal has been received by City
staff. Mr. Kass then reviewed a development concept plan, noting that the development was
planned as a mix of rental and purchased units. The PD-1 overlay is requested by the
applicant for higher density to allow the addition of smaller studio and one-bedroom units.
The overlay also limits the number of such smaller units. While the Kettlestone Master Plan
identifies the subject property for commercial use, City staff believe the proposed multi-

family zoning addresses a need for varied housing options in the area. Council Member
Lyon noted that smaller units can be of interest to people who travel a lot and prefer their
own space to a hotel. No comments were made by the public in attendance.
3) On the intent to commence a public improvement project known as Ute Avenue and
Ashworth Road Intersection Improvement Project – Mayor Pro Tem Bottenberg opened
the public hearing and asked if any written correspondence had been received; City Clerk
Schuett replied in the negative. Public Works Director/City Engineer Koester reviewed the
project area, noting that the public hearing addresses requirements of Code of Iowa Chapter
6B. City staff has obtained most of the necessary property through good faith efforts with
property owners; however, there remains a temporary construction easement under
negotiation. Mr. Koester then reviewed the project construction schedule. Council Member
Sinclair asked when Sugar Creek Elementary School was scheduled to open; Mr. Koester
replied it would open in 2022. Council Member Crone requested an explanation of the
property negotiation process; Mr. Koester reviewed the process, including appraisals and
negotiations. No comments were made by the public in attendance.
4) On plans, specifications, form of contract and estimate of cost [Douglas Parkway
Extension Project] – Mayor Pro Tem Bottenberg opened the public hearing and asked if
any written correspondence had been received; City Clerk Schuett replied in the negative.
Public Works Director/City Engineer Koester reviewed the project and construction schedule.
No comments were made by the public in attendance.
5) On plans, specifications, form of contract and estimate of cost [2021 Well
Rehabilitation Phase 2 Project] – Mayor Pro Tem Bottenberg opened the public hearing
and asked if any written correspondence had been received; City Clerk Schuett replied in the
negative. Public Works Director/City Engineer Koester reviewed the project and
construction schedule, noting the inclusion of an interim completion date that would allow
time to fill the well. No comments were made by the public in attendance
6) On plans, specifications, form of contract and estimate of cost [Meredith Drive/Warrior
Lane HMA Overlay Project] – Mayor Pro Tem Bottenberg opened the public hearing and
asked if any written correspondence had been received; City Clerk Schuett replied in the
negative. Public Works Director/City Engineer Koester reviewed the joint project among the
Cities of Clive, Urbandale and Waukee. The project was bid last week by the City of Clive,
which is the lead agency for the project. He then reviewed the construction schedule. No
comments were made by the public in attendance.
(H) Public Hearing Action Items:
1) Ordinance: Consideration of approval of an ordinance to amend Chapter 169, Zoning
Ordinance, City of Waukee, Iowa, by rezoning certain property from A-1 to R-2, R-3, R-
4 and C-1, a parcel to be known as Waukee Crossing 2 [introduction; first reading]–
Council Member Crone introduced the ordinance and moved to approve the first reading in
title only; seconded by Council Member Lyon. Council Member Bergman Pierce noted that
the trailhead is near the subject property, expressing a desire to see more trail connectivity
within this project; Planning Coordinator Kass replied that staff was looking into the matter.
Results of vote: Ayes: Bergman Pierce, Bottenberg, Crone, Lyon, Sinclair. Nays: None.
Motion carried 5 – 0.
2) Ordinance: Consideration of approval of an ordinance to amend Chapter 169, Zoning

3) Resolution: Consideration of approval of a resolution approving and authorizing a
public improvement project to construct the Ute Avenue and Ashworth Road

Intersection Improvement Project, funding of final site-specific design, final route/site
selection, to acquire land for the project by purchase and, if necessary, to authorize
the use and acquisition of property by eminent domain – Council Member Lyon moved
to approve the resolution; seconded by Council Member Sinclair. Results of vote: Ayes:
Bergman Pierce, Bottenberg, Crone, Lyon, Sinclair. Nays: None. Motion carried 5 – 0.

4) Douglas Parkway Extension Project
A. Resolution: Consideration of approval of a resolution approving plans,
specifications, form of contract and estimate of cost – Council Member Lyon moved
to approve the resolution; seconded by Council Member Bergman Pierce. Results of
vote: Ayes: Bergman Pierce, Bottenberg, Crone, Lyon, Sinclair. Nays: None. Motion
carried 5 – 0. (Resolution #2021-256)
B. Resolution: Consideration of approval of a resolution awarding contract – Council
Member Sinclair moved to approve the resolution; seconded by Council Member Crone.
Public Works Director/City Engineer Koester reviewed the bid tabulation, recommending
award to apparent low bidder Absolute Concrete Construction, Inc., of Slater, IA. Council
Member Lyon questioned why concrete remains reasonably priced while other
construction materials have risen in price; Mr. Koester noted that staff have only seen an
increase in PVC material pricing and that the real issue is lead time in obtaining
materials. Council Member Sinclair asked how this project addressed the completion of
the full Douglas Pkwy. extension; Mr. Koester replied that this project was the first of
many in a multi-year project to complete Douglas Pkwy. Results of vote: Ayes: Bergman
Pierce, Bottenberg, Crone, Lyon, Sinclair. Nays: None. Motion carried 5 – 0.

Pierce moved to approve the resolution; seconded by Council Member Sinclair. Results

B. Resolution: Consideration of approval of a resolution awarding contract – Council
Member Bergman Pierce moved to approve the resolution; seconded by Council
Member Crone. Public Works Director/City Engineer Koester reviewed the bid
tabulation, recommending award to apparent low bidder C. L. Carroll Co., Inc., of Des
Moines, IA. Results of vote: Ayes: Bergman Pierce, Bottenberg, Crone, Lyon, Sinclair.

6) Meredith Drive/Warrior Lane HMA Overlay Project
A. Resolution: Consideration of approval of a resolution approving plans,
specifications, form of contract and estimate of cost – Council Member Crone
moved to approve the resolution; seconded by Council Member Bergman Pierce.
Results of vote: Ayes: Bergman Pierce, Bottenberg, Crone, Lyon, Sinclair. Nays: None.

B. Resolution: Consideration of approval of a resolution consenting to the City of
Clive’s making award of construction contract – Council Member Crone moved to
approve the resolution; seconded by Council Member Lyon. Public Works Director/City
Engineer Koester reviewed the City of Clive bid tabulation, recommending consent to the
award to apparent low bidder Des Moines Asphalt & Paving of Ankeny, IA. Council
Member Bottenberg stated that he would abstain from voting due to a professional
conflict of interest. Results of vote: Ayes: Bergman Pierce, Crone, Lyon, Sinclair. Nays:
None. Abstentions: Bottenberg (professional conflict of interest). Motion carried 4 – 0 –

announced Mayor Clarke’s reappointment of Miranda Djukic and Connie Thienes to the
Library Board of Trustees. Council Member Sinclair moved to approve the resolution;

3) Resolution: Consideration of approval of a resolution approving Fifth Amended and
Restated Intergovernmental Agreement for the Ownership and Operation of a
Consolidated 911 Emergency Communications Center [Westcom] – Council Member
Lyon moved to approve the resolution; seconded by Council Member Sinclair. Westcom
Chief Darin Riney addressed the council, reviewing Westcom calls for service volume and
noting a recent strategic planning initiative to address governance, growth strategies and
service expectations. Westcom management committee chairperson and Clive City

Manager Matt McQuillen next addressed the council, providing a brief summary of the
proposed amendments to the 28E agreement, including several membership levels and the
addition of the City of Windsor Heights as a member. He added that all other member cities
have approved the proposed agreement amendment. Results of vote: Ayes: Bergman

plat, noting several common area outlots that would be owned and maintained by the

8) Resolution: Consideration of approval of a resolution approving final plat for Painted
Woods South Townhomes – Planning Coordinator Kass briefly reviewed the plat. Council
Member Sinclair asked if the parkland dedication had been included with the neighboring
development; Mr. Kass replied in the affirmative. Council Member Crone moved to approve

9) Resolution: Consideration of approval of a resolution approving site plan for Painted
Woods South Townhomes – Council Member Crone moved to approve the resolution;
seconded by Council Member Sinclair. Planning Coordinator Kass reviewed the site plan for
owner-occupied, two-story slab-on-grade units. Exterior building elevations were also
reviewed. Council Member Crone wondered about the price point for the units; Mr. Kass
replied that he was not certain, but that the prices might be similar to those for Autumn
Valley Townhomes. Results of vote: Ayes: Bergman Pierce, Bottenberg, Crone, Lyon,
Sinclair. Nays: None. Motion carried 5 – 0. (Resolution #2021-288)
10) Resolution: Consideration of approval of a resolution approving site plan for
Keystone Construction Services [1650 NW Gettysburg Lane] – Planning Coordinator
Kass reviewed the site plan for an office/warehouse building, including a future outdoor
storage area. Exterior building elevations were also reviewed. Council Member Bottenberg
asked about storm water management for the site; Mr. Kass responded that it was
addressed within the overall James Pointe development. Council Member Crone moved to
approve the resolution; seconded by Council Member Sinclair. Results of vote: Ayes:

A. Call to Order – The special meeting of the Waukee City Council was called to order by Mayor Clarke
at 5:00 p.m. at Waukee City Hall, 230 W. Hickman Rd.
B. Roll Call – The following members were present: Mayor Courtney Clarke; Council Members Anna
Bergman Pierce, R. Charles Bottenberg, Chris Crone, Larry R. Lyon, Ben Sinclair. Absent: None.
Also in attendance: City Administrator Tim Moerman, Assistant City Administrator Brad Deets, Parks &
Recreation Director Matt Jermier, Building Official Keith Rash, City Clerk Rebecca D. Schuett.
C. Agenda Approval – Council Member Crone moved to approve the agenda; seconded by Council

1) Resolution: Consideration of approval of a resolution rejecting quotations [96-inch Zero
Turn Mower, Waukee Parks & Recreation Department] – Council Member Bottenberg moved to
approve the resolution; seconded by Council Member Lyon. Parks & Recreation Director Jermier
stated that due to an error in the apparent low quote and after consultation with the City Attorney,
City staff recommend rejecting all received quotes and going out for new quotes. Results of vote:
Ayes: Bergman Pierce, Bottenberg, Crone, Lyon, Sinclair. Nays: None. Motion carried 5 – 0.

2) Resolution: Consideration of approval of a resolution awarding quote [410 6th Street roof
repair]– Council Member Lyon moved to approve the resolution; seconded by Council Member
Sinclair. Building Official Rash noted the need for repairs to address a roof leak caused by a failing
roof truss joint, then recommended awarding quote to Edge Companies of Grimes, IA. Council
Member Sinclair asked if there were any immediate safety concerns; Mr. Rash replied in the
negative. Council Member Lyon asked about the overall state of the building; Assistant City
Administrator Deets replied that City staff planned to hire a consultant to assess the condition of
this and other City-owned buildings. Results of vote: Ayes: Bergman Pierce, Bottenberg, Crone,
Lyon, Sinclair. Nays: None. Motion carried 5 – 0. (Resolution #2021-292)
E. Closed Session: Pursuant to Code of Iowa §21.5(1)(i) to evaluate the professional competency
of an individual whose appointment, hiring, performance, or discharge is being considered
when necessary to prevent needless and irreparable injury to that individual’s reputation and
that individual requests a closed session – Council Member Crone moved to close the regular
session and enter closed session pursuant to Code of Iowa §21.5(1)(i);seconded by Council Member
Lyon. Results of vote: Ayes: Bergman Pierce, Bottenberg, Crone, Lyon, Sinclair. Nays: None. Motion
carried 5 – 0. Council entered closed session at 5:17 p.m.
