Call to Order – The work session meeting of the Waukee City Council was called to order by Mayor Clarke at 6:30 p.m. at Waukee City Hall, 230 W. Hickman Rd. B. Roll Call – The following members were present: Mayor Courtney Clarke; Council Members Anna Bergman (via telephone), R. Charles Bottenberg, Chris Crone, Larry R. Lyon. Absent: None. Also in attendance: City Administrator Tim Moerman, Development Services Director Brad Deets, IT Director Son Le, Human Resource Director Michelle Lindsay, Police Chief John Quinn, City Clerk Rebecca D. Schuett, City Attorney Steve Brick. C. Agenda Approval – Council Member Bottenberg moved to approve the agenda; seconded by Council Member Lyon. Results of vote: Ayes: Bergman, Bottenberg, Crone, Lyon. Nays: None. Motion carried 4 – 0. D. Work Session: 1) Presentations: Applicants for appointment to a vacant council position for a term of office to expire December 31, 2021 – The council conducted interviews with applicants Ankush Bhatia, Mathew Zinkula, Ben Sinclair, Cherian Koshy, Juan Garcia, Michael Schrodt and Phil Jeneary (via telephone). Applicant Gordon Miller was unable to attend. E. Comments Council Member Bottenberg moved to adjourn; seconded by Council Member Lyon. Ayes: All. Nays: None. Motion carried 4 – 0. Schuett, City Clerk J1B WAUKEE CITY COUNCIL MINUTES February 18, 2020 (A) Call to Order – The regular meeting of the Waukee City Council was called to order by Mayor Pro Tem Bottenberg at 5:32 p.m. in the Council Chambers at Waukee City Hall, 230 W. Hickman Rd. (B) Pledge of Allegiance (C) Roll Call – The following members were present: Council Members Anna Bergman, R. Charles Bottenberg, Chris Crone, Larry R. Lyon, Ben Sinclair. Absent: Mayor Courtney Clarke. Also in attendance: City Administrator Tim Moerman, Human Resource Director Michelle Lindsay, Development Services Director Brad Deets, Community & Economic Development Director Dan Dutcher, Parks & Recreation Director Matt Jermier, Marketing & Communications Director Summer Evans, Police Chief John Quinn, Police Sgt. Robert Gitzen, City Clerk Rebecca D. Schuett, City Attorney Steve Brick. (D) Open Forum (E) Agenda Approval – Council Member Lyon moved to approve the agenda, removing consideration of item I4; seconded by Council Member Bergman. (F) Presentations: 1) Waukee Area Chamber of Commerce quarterly report – Report made by Chamber Board Chairperson Bob Baumgart. (G) Public Hearings: 1) On the authorization of the imposition of tax to pay General Obligation Loan Agreement of not to exceed $1,200,000 – Mayor Pro Tem Bottenberg opened the public hearing and asked if any written correspondence had been received; City Clerk Schuett replied in the negative. City Administrator Moerman noted that the City had previously entered into an agreement with the City of West Des Moines to share in the costs of improvements to Ashworth Rd. The proposed action authorizes a loan agreement to finance Waukee’s portion of the project. No comments were made by the public in attendance. 2) On the issuance of not to exceed $12,800,000 General Obligation Urban Renewal Bonds – Mayor Pro Tem Bottenberg opened the public hearing and asked if any written correspondence had been received; City Clerk Schuett replied in the negative. City Administrator Moerman reviewed the projects to be financed through the bonds, including the public roads adjacent to and around the second high school facility. No comments were made by the public in attendance. (H) Public Hearing Action Items: 1) Resolution: Consideration of approval of a resolution instituting proceedings to take additional action for the levy of a tax to pay not to exceed $1,200,000 General Obligation Loan Agreement – Council Member Bergman moved to approve the resolution; seconded by Council Member Lyon. Results of vote: Ayes: Bergman, Bottenberg, Crone, Lyon, Sinclair. Nays: None. Motion carried 5 – 0. (Resolution #2020-061) 2) Resolution: Consideration of approval of a resolution levying a tax for the payment of a General Obligation Loan Agreement to the principal amount of not to exceed $1,200,000 – Council Member Lyon moved to approve the resolution; seconded by Council Member Bergman. Results of vote: Ayes: Bergman, Bottenberg, Crone, Lyon, Sinclair. Nays: None. Motion carried 5 – 0. Call to Order – The special meeting of the Waukee City Council was called to order by Mayor Clarke at 12:01 p.m. at Waukee City Hall, 230 W. Hickman Rd. B. Roll Call – The following members were present: Mayor Courtney Clarke (via telephone); Council Members Anna Bergman (via telephone), R. Charles Bottenberg (via telephone), Chris Crone (via telephone), Larry R. Lyon, Ben Sinclair. Absent: None. Also in attendance: Development Services Director Brad Deets, City Clerk Rebecca D. Schuett, City Attorney Steve Brick. C. Agenda Approval – Council Member Lyon moved to approve the agenda; seconded by Council Member Sinclair. Action Items: 1) Resolution: Consideration of approval of a resolution approving agreement and acquiring property interests related to the NW 10th Street Improvements Project – Council Member Lyon moved to approve the resolution; seconded by Council Member Sinclair. City Attorney Brick briefly reviewed the history of negotiations with the property owners, noting that a condemnation hearing was currently scheduled for February 21. He then reviewed the proposed agreements with the property owners and the current property tenants. Council Member Bergman voiced her concern with the City acting as a landlord for the property and also asked why the City would take all instead of part of the property; Mr. Brick explained why a partial taking was not economically feasible, adding that the City would not be paying any more for the property than was budgeted. Development Services Director Deets noted that the school district would pay for a portion of the purchase costs, as well. Mr. Brick then briefly reviewed state law related to tenant relocation. Council Member Lyon and Mayor Clarke spoke in favor of the agreements. Council Member Bergman suggested consideration of a policy to help avoid similar future issues; Mayor Clarke noted that she had requested at an earlier meeting that there be better due diligence in the future related to properties adjacent to roadway improvement projects.
