AGENDA ITEM: Consideration of approval of a resolution approving a development
agreement [Commons at Greenway Park Plat 1]

SYNOPSIS INCLUDING PRO & CON: The City Council has previously approved
construction drawings for the Commons at Greenway Park Plat 1, which includes the extension of
NW Venture Drive west of the Waukee YMCA. As a part of the improvements and construction
of NW Venture Drive, a culvert is required to be installed within a major water way that carries
storm water from south of Hickman through the Broderick property and eventually outletting into
Little Walnut Creek.
The proposed development agreement relates to the City’s participation in the construction of the
box culvert to allow for the extension of NW Venture Drive.
FISCAL IMPACT INCLUDING COST/BENEFIT ANALYSIS: $288,550.00
COMMISSION/BOARD/COMMITTEE COMMENT:
STAFF REVIEW AND COMMENT: The City’s practice is to participate in the installation of
culverts that are required due to major water crossings. The proposed
cost has previously been budgeted as a part of the Capital Improvements
Plan.
RECOMMENDATION: Approve the resolution.

RESOLUTION 2020-
DEVELOPMENT AGREEMENT BETWEEN CITY OF WAUKEE AND PHILIP E
BRODERICK, LLC, CHARLOTTE R. BRODERICK, LLC AND WAUKEE COMMONS,
LC [COMMONS AT GREENWAY PARK PLAT 1]
IN THE NAME AND BY THE AUTHORITY OF THE CITY OF WAUKEE, IOWA
WHEREAS, the City of Waukee, Iowa is a duly organized municipality within Dallas County;
AND,
WHEREAS, Waukee Commons, L.C. on behalf of Philip E. Broderick LLC and Charlotte R.
Broderick, LLC, (collectively “Developer”) has submitted construction drawings and a final plat
for Commons at Greenway Park Plat 1; AND,
WHEREAS, the improvements for Commons at Greenway Park Plat 1 include the extension of
NW Venture Drive including the construction of a box culvert to accommodate storm water
conveyance of the development as well as other parts of the City; AND,
WHEREAS, in order to address the increased financial burden associated with the box culvert
construction, the parties have reached an agreement in order to incentivize the Developer to
commence and complete the improvements to NW Venture Drive.
NOW THEREFORE BE IT RESOLVED by the City of Waukee City Council in session this
2nd day of March 2020, that it hereby approves the Development Agreement between the City of
Waukee and Philip E. Broderick, LLC, Charlotte R. Broderick, LLC and Waukee Commons, LC
[Commons at Greenway Park Plat 1].
