WAUKEE CITY COUNCIL MINUTES
SPECIAL MEETING
March 13, 2020
A. Call to Order – The special meeting of the Waukee City Council was called to order by Mayor Clarke
at 12:01 p.m. at Waukee City Hall, 230 W. Hickman Rd.
B. Roll Call – The following members were present: Mayor Courtney Clarke (via telephone); Council
Members Anna Bergman (via telephone), R. Charles Bottenberg (via telephone), Chris Crone (via
telephone), Larry R. Lyon, Ben Sinclair. Absent: None.
Also in attendance: City Administrator Tim Moerman, Human Resource Director Michelle Lindsay, City
Clerk Rebecca D. Schuett.
C. Agenda Approval – Council Member Lyon moved to approve the agenda; seconded by Council
Member Sinclair. Results of vote: Ayes: Bergman, Bottenberg, Crone, Lyon, Sinclair. Nays: None.
Motion carried 5 – 0.
D. Action Items:
1) Resolution: Consideration of approval of a resolution approving release agreement –
Council Member Lyon moved to approve the resolution; seconded by Council Member Sinclair.
City Administrator Moerman briefly reviewed the agreement. Results of vote: Ayes: Bergman,
Bottenberg, Crone, Lyon, Sinclair. Nays: None. Motion carried 5 – 0. (Resolution #2020-081)
E. Comments – City Administrator Moerman stated that the City’s coronavirus strategy would be
communicated with elected officials later in the day.
Council Member Lyon moved to adjourn; seconded by Council Member Sinclair. Ayes: All. Nays: None.
Motion carried 5 – 0.

*Due to public health concerns and guidance, in accordance with Iowa Code Sections
21.4(1)(b) and 21.8, this meeting of the Waukee City Council was conducted electronically as
holding the meeting in person was impossible or impractical.
(A) Call to Order – The regular meeting of the Waukee City Council was called to order by Mayor
Clarke at 5:39 p.m. electronically via Zoom pursuant to the electronic meeting provisions of Iowa
Code Sections 21.4(1)(b) and 21.8.
(B) Pledge of Allegiance (temporarily suspended)
(C) Roll Call – The following members were present: Mayor Courtney Clarke; Council Members
Anna Bergman, R. Charles Bottenberg, Chris Crone, Larry R. Lyon, Ben Sinclair. Absent: None.

Management (PFM) highlighted recent market developments, resulting in an unfavorable
municipal bond market. He reviewed the bid tabulation, noting that eight bids were received
and all were competitive, but at a higher interest rate than expected. An alternative
approach to move forward through private sale would allow the City to seek proposals from
financial institutions instead of the municipal bond market. Mr. Burmeister recommended the
council reject all bids and move forward with a private placement agreement. Council
Member Sinclair asked if there was any reason not to move forward with a private placement
agreement; Mr. Burmeister advised that the private placement agreement would lock in the
rate at approximately 2.2% true interest cost and that, while the City could rebid in several
months, the market was uncertain. Finance Director Burkhart noted that the City has used
private placement in the past for a gas revenue bond. Council Member Bottenberg agreed
that the City did not have 6-9 months to see what happens in the market, but asked if the

bidding could be postponed for a year; Ms. Burkhart replied in the negative, as projects to be
financed with the bonds have already begun and the City has started making payments.
Mayor Clarke noted very unprecedented times in the municipal bond market and expressed
her belief that other entities would also be going with private placement. Council Member
Bottenberg moved to reject all bids; seconded by Council Member Lyon. Results of vote to
reject all bids: Ayes: Bergman, Bottenberg, Crone, Lyon, Sinclair. Nays: None. Motion
carried 5 – 0.
7) Resolution: Consideration of approval of a resolution approving Engagement
Agreement for Private Placement – Council Member Lyon moved to approve the
resolution; seconded by Council Member Crone. Mayor Clarke noted that a special council
meeting was needed later in the week to finalize the terms of the bond; Finance Director
Burkhart added that the approval was required by March 30. Results of vote: Ayes:
Bergman, Bottenberg, Crone, Lyon, Sinclair. Nays: None. Motion carried 5 – 0. (Resolution

8) Resolution: Consideration of approval of a resolution approving preliminary plat for
Indi Run Plat 3 – Council Member Crone moved to approve the resolution; seconded by
Council Member Sinclair. Development Services Director Deets briefly reviewed the plat,
which includes duplex lots. Council Member Sinclair asked about the expected price point
and if the units would be rentals; Mr. Deets replied that they would be ranch-style “for sale”
units in the $350,000-400,000 price range. Council Member Lyon asked if they would be
constructed as slab on grade; Mr. Deets replied in the negative, as the units would have full
basements. Results of vote: Ayes: Bergman, Bottenberg, Crone, Lyon, Sinclair. Nays:

planned for owner-occupied townhomes. Internal streets and storm water detention will be
owned and maintained by a homeowners association. He briefly reviewed exterior

Director Deets briefly reviewed the site plan, which includes certain unique site amenities as
well as a Raccoon River Valley Trail connection. Council Member Sinclair asked if the
roadway crossed the trail; Mr. Deets replied in the affirmative, adding that measures such as
signage and an extensive signaling system are in place to protect trail users and slow traffic.

21.8, this meeting of the Waukee City Council was conducted electronically as holding the meeting
in person was impossible or impractical.
A. Call to Order – The regular meeting of the Waukee City Council was called to order by Mayor Clarke
at 12:20 p.m. electronically via Zoom pursuant to the electronic meeting provisions of Iowa Code
Sections 21.4(1)(b) and 21.8.
B. Roll Call – The following members were present: Mayor Courtney Clarke; Council Members Anna
