HomeMy WebLinkAbout2020-05-18-H02 Locust Street, Alley Vacation - ResolutionAGENDA ITEM: CITY OF WAUKEE, IOWA CITY COUNCIL MEETING COMMUNICATION MEETING DATE: May 18, 2020 AGENDA ITEM:Consideration of approval of a resolution approving the vacation and disposal of a street or alley pursuant to Iowa Code Sections 354.23, 364.12(2)(A) and 364.7(2020) [Locust Street and alleyway between Locust Street and Ashworth Drive] FORMAT:Resolution SYNOPSIS INCLUDING PRO & CON: FISCAL IMPACT INCLUDING COST/BENEFIT ANALYSIS: COMMISSION/BOARD/COMMITTEE COMMENT: STAFF REVIEW AND COMMENT: Staff would recommend approval of the vacation and disposal of Locust Street and the alley between Locust Street and Ashworth Drive. Following vacation, the street and alley will be conveyed to the Waukee Community School District. RECOMMENDATION: Approve the resolution. ATTACHMENTS: I. Proposed Resolution PREPARED BY:Becky Schuett REVIEWED BY: H2 THE CITY OF WAUKEE, IOWA RESOLUTION 2020- APPROVING THE VACATION AND DISPOSAL OF A STREET OR ALLEY PURSUANT TO IOWA CODE SECTIONS 354.23, 364.12(2)(A) AND 364.7 (2020) [LOCUST STREET AND ALLEYWAY BETWEEN LOCUST STREET AND ASHWORTH DRIVE] IN THE NAME AND BY THE AUTHORITY OF THE CITY OF WAUKEE, IOWA WHEREAS, the City of Waukee, Dallas County, State of Iowa, is a duly organized Municipal Organization; AND, WHEREAS, the City has previously acquired right of way for purposes of a street locally known as Locust Street; AND, WHEREAS, the City has previously acquired right of way for purposes of an alley way between Locust Street and Ashworth Drive; AND, WHEREAS, a portion of Locust Street described on attached Exhibit A is of no benefit to the public and may be vacated, conveyed, and/or otherwise disposed of pursuant to state code; AND, WHEREAS, the alleyway between Locust Street and Ashworth Drive as described on attached Exhibit B is of no benefit to the public and should be vacated, conveyed, and/or otherwise disposed of pursuant to state code; AND, WHEREAS, the Property depicted on Exhibits A and B has been used by the Waukee Community School District as part of Waukee Elementary school campus for many years. City and it is appropriate and in the best interest of the public that the portion of Locust Street described on attached Exhibit A and the alleyway between Locust Street and Ashworth Drive described on attached Exhibit B to the Waukee Community School District. NOW THEREFORE BE IT RESOLVED by the City of Waukee City Council in session this 18th day of May, 2020, that it hereby approves the vacation of the Locust Street right of way described on attached Exhibit A and the alleyway between Locust Street and Ashworth Drive as described on attached Exhibit B and approves the conveyance of the property to the Waukee Community School District. ____________________________ Courtney Clarke, Mayor Attest: ___________________________________ Rebecca D. Lyon Ben Sinclair EXHIBIT A All that part of the 80.00 foot wide Locust Street Right of Way North of and Adjacent to Block 14, Original Town of Waukee, Dallas County, Iowa, Lying Between the East Right of Way Line of 5th Street and the West Right of Way Line of 4th Street as they are presently established EXHIBIT B All that part of the 16.00 foot wide North-South Alley in Block 11, Original Town of Waukee, Dallas County, Iowa, lying between the North Right of Way Line of Locust Street and the Southwesterly Right of Way Line of Ashworth Drive as they are presently established.
