Hickman Rd. (B) Pledge of Allegiance (C) Roll Call – The following members were present: Mayor Courtney Clarke; Council Members Anna Bergman, R. Charles Bottenberg (electronically), Chris Crone, Larry R. Lyon, Ben Sinclair. Absent: None. Also in attendance: City Administrator Tim Moerman, Finance Director Linda Burkhart, Development Services Director Brad Deets, Public Works Director/City Engineer Rudy Koester, Human Resources Director Michelle Lindsay, IT Director Son Le, Police Lt. Jeremy Long, Police Sgt. Brandon Pettit, City Clerk Rebecca D. Schuett, City Attorney Steve Brick. (D) Open Forum (E) Agenda Approval – Council Member Lyon moved to approve the agenda; seconded by Council Member Sinclair. Results of vote: Ayes: Bergman, Bottenberg, Crone, Lyon, Sinclair. Nays: None. Motion carried 5 – 0. (F) Monthly Mayor’s Report – Mayor Clarke reported on FY2020 building permit statistics, then provided an update on certain public improvement and street projects. She noted that the council would discuss the fireworks use ordinance during a future work session. (G) Presentations: 1) Waukee Leadership Institute – Rick Kyser, President of the Waukee Leadership Institute, reviewed that organization’s purpose, activities, past projects and current board membership. (H) Public Hearings: 1) On an ordinance to amend Chapter 169, Zoning Ordinance, City of Waukee, by rezoning and changing certain property therein from C-4/PD-1 to C-4 and C-1A, a property addressed as 15705 University Avenue – Mayor Clarke opened the public hearing and asked if any written correspondence had been received; City Clerk Schuett replied in the affirmative, citing an email from Ron Marr, 2935 SE Timberline Dr., expressing no strong opinion on the rezoning application but suggesting it be developed by the City as a park. Development Services Director Deets noted the long rezoning history of the subject property, dating back to 2008. The current request is for a combination of commercial and office development. The proposed lot sizes will limit certain types of uses. A landscape buffer has been identified in the past and the developer is aware of the need to save mature trees, but some will need to be removed. Mayor Clarke asked for public comment: 1) Amanda Jorgensen, 1410 SE Rosewood Ct., questioned why the property was being rezoned as there are no potential users at this time. She noted that the 2040 Comprehensive Plan shows the subject property as residential development, adding that she believed it would be developed as such when she purchased her property some years ago. She expressed concern with some potential allowable uses, specifically convenience stores and drive-thrus, as those uses don’t fit in with the neighborhood. She voiced her concern that she was not contacted by the developer for permission to apply for rezoning and that the developer obtained 58% consent via a non-resident apartment owner and a commercial property owner across the street. She expressed additional concerns with parking, possible light pollution, traffic flow and stormwater detention. Mayor Clarke replied that many of Ms. Jorgensen’s concerns would be addressed during the site planning process and encouraged her to bring those concerns forward again at that time. Mr. Deets reviewed the City’s rezoning and site planning process, parking requirement calculations and exterior lighting regulations. He added that turn lanes off University Ave. would need to be added by the developer at their cost, the retail portion would be located away from the abutting residential, I1B 2 and the remaining office development would likely have users with typical daytime hours of operation. 2) Maria Christian, 1400 SE Rosewood Ct., asked the council to vote against the rezoning. She voiced concern with a potential convenience store development, citing lack of entrances, increased traffic and additional litter. She also noted possible light pollution, especially from a convenience store. She reiterated Ms. Jorgensen’s concern that she was not contacted by the developer during the application process. Finally, she stated that she was upset by the removal of additional trees, noting how it negatively impacts wildlife. Andy Roland, applicant, addressed the council and discussed his intent for light retail uses, such as a coffee shop or deli, and stated that he was willing to exclude gas stations from allowable uses, noting that he didn’t believe such a use would fit on the lot. 3) Lindsay Brudtkuhl, 1050 SE Bluegrass Ct., voiced her concern that the change in zoning would allow for a gas station or food drive-thrus, adding that small professional office users would be okay. Ms. Jorgensen addressed the council again, asking why the property was proposed for rezoning now if there were no planned users; Mayor Clarke replied that a property owner can request rezoning at any time, adding that the current PD overlay zoning does not allow the current developer to market the property as they would like it developed. Mr. Deets stated that the current zoning was very specific for a senior living/skilled recovery center development. He added that while a convenience store would be an allowable use, the lot size was too small and most developers prefer to locate them on corner lots. The applicant has stated his amenability to further use restrictions; an agreement could be drafted to reflect any such restrictions. Council Member Bergman noted past concerns from neighbors about the landscape buffer, stating that at the last rezoning approval the council made it clear that maintaining the buffer was a priority. She stated that she had no objection to the rezoning request but added that the City should keep an eye on how the buffer is maintained. Mayor Clarke asked about the process moving forward; City Attorney Brick stated that the council could modify the motion for approval of the ordinance after a signed agreement is submitted by the developer and before the final reading. Council Member Sinclair asked about the underground parking noted on the concept plan; Mr. Deets stated that the concept plan showed potential underground parking, which would count toward the minimum parking requirements. Council Member Sinclair stated that there were opportunities to amend the allowable uses prior to the final ordinance reading and reiterated Mayor Clarke’s recommendation that the neighbors stay involved during the site planning process. Council Member Bottenberg noted that he would recuse himself from voting due to a professional conflict of interest. Mayor Clarke concluded by stating that green spaces are a council priority, but that the subject property may not fit into that plan. 2) On an ordinance to amend Chapter 169, Zoning Ordinance, City of Waukee, by rezoning and changing certain property therein from A-1 to C-1, a property known as Stratford Crossing – Mayor Clarke opened the public hearing and asked if any written correspondence had been received; City Clerk Schuett replied in the negative. Development Services Director Deets noted that a small parcel was recently annexed by the City and can now be rezoned to become part of existing C-1 zoning in Stratford Crossing. It is a staff- initiated rezoning as it is concerned a clean-up item. No comments were made by the public in attendance. 3) On an ordinance to amend Chapter 303, Land Subdivision Regulations for the City of Waukee, Iowa, by amending Section 303.156-303.158, Development Impact on Community Facilities – Mayor Clarke opened the public hearing and asked if any written correspondence had been received; City Clerk Schuett replied in the negative. Development Services Director Deets reviewed some of the more significant amendments, including increased total parkland dedication requirements and language specific to dedication of floodway areas. No comments were made by the public in attendance. 4) On the annexation of consenting properties [Waukee Public Safety Property] – Mayor Clarke opened the public hearing and asked if any written correspondence had been received; City Clerk Schuett replied in the negative. Development Services Director Deets stated that when the property was purchased for the future second Waukee Public Safety 3 Facility, a portion was located within Dallas County and must now be annexed. No comments were made by the public in attendance. 5) On plans, specifications, form of contract and estimate of cost [2020 Gas Transmission Modifications Project] – Mayor Clarke opened the public hearing and asked if any written correspondence had been received; City Clerk Schuett replied in the negative. Public Works Director/City Engineer Koester reviewed the project, including a sectional valve required in the event of an emergency shut-down. No comments were made by the public in attendance. (I) Public Hearing Action Items: 1) Ordinance: Consideration of approval of an ordinance to amend Chapter 169, Zoning Ordinance, City of Waukee, by rezoning and changing certain property therein from C- 4/PD-1 to C-4 and C-1A, a property addressed as 15705 University Avenue [introduction; first reading]– Council Member Lyon introduced the ordinance and moved to approve the first reading in title only; seconded by Council Member Crone. Development Services Director Deets reiterated that if the first reading is approved, City staff will work with the developer on language to restrict certain uses. Results of vote: Ayes: Bergman, Crone, Lyon, Sinclair. Nays: None. Abstentions: Bottenberg, due to a professional conflict of interest. Results of vote: Ayes: Bergman, Bottenberg, Crone, Lyon, Sinclair. Nays: None. Motion carried 5 – 0. (Resolution #2020-240) 5) 2020 Gas Transmission Modifications Project A. Resolution: Consideration of approval of a resolution approving plans, specifications, form of contract and estimate of cost – Council Member Crone moved to approve the resolution; seconded by Council Member Bergman. Results of vote: Ayes: Bergman, Bottenberg, Crone, Lyon, Sinclair. Nays: None. Motion carried 5 – 0. (Resolution #2020-241) B. Resolution: Consideration of approval of a resolution rejecting bids – Council Member Bergman moved to approve the resolution; seconded by Council Member Lyon. Public Works Director/City Engineer Koester reviewed the bid tabulation, noting that all bids received were significantly greater than the engineer’s estimate. There may have been a misunderstanding regarding which materials would be supplied. City staff recommend rejecting the bids and rebidding in the near future. Council Member Bergman noted that no Iowa contractors submitted bids; Mr. Koester stated that there are such contractors in the state but none submitted bids. Results of vote: Ayes: Bergman, Bottenberg, Crone, Lyon, Sinclair. Nays: None. Motion to reject bids carried 5 – 0. City Administrator Moerman reviewed the plan and current water usage concerns. Council Member Sinclair asked how often the plan is implemented; Mr. Moerman replied that this is the first time it has been implemented, but noted that water usage has come close to exceeding capacity in years past. Work Session: 1) Affordable housing programs – Development Services Director Deets informed the council of a recent submittal for efficiency and micro unit housing units. After some discussion, the council concurred that such units would be another housing option in the community, but not as part of the affordable housing plan. 2) Unbiased policing policy – Police Chief Quinn reviewed current department policies on body camera use, community outreach, use of force and regular reports on possible biased-based policing. He added that for additional oversight, the Iowa Communities Assurance Pool (ICAP) reviewed the policies and found them satisfactory. There was some discussion on whether to approve a City policy on the matter or maintain it as a department policy. The council directed City staff to obtain a legal opinion on the matter. 3) Street Financing and Priority Plan – City Administrator Moerman lead the council through a worksheet wherein street improvement projects were prioritized based on importance and available funding. 4) SE Waco Place on-street parking – Public Works Director/City Engineer Koester reviewed the proposed on-street parking locations to be implemented as a traffic calming tool. 2 5) Traffic Signal Enhancements Project update – Public Works Director/City Engineer Koester discussed the project construction schedule for vehicle detection improvements, traffic signal equipment and software upgrades. 6) Heart of the Warrior Trail western extension – Development Services Director Deets briefly reviewed plans to extend the trail from 6th St. west to 10th St. 7) Triumph Park Project update – Parks & Recreation Director Jermier discussed the construction schedule, noting that the bid documents would include multiple bid alternates. 8) Triangle redevelopment program – Development Services Director Deets noted an existing Downtown Façade Improvements Program, then discussed a potential Triangle Property Improvement Program to provide grants to downtown area businesses making other significant improvements to structures. 9) REMOVED FROM AGENDA 10) YMCA partnership – Mayor Clarke noted a letter from the Waukee Family YMCA detailing their request for funding and stating that any such funding would be used for resident scholarships. She noted the absence of Council Member Lyon and asked that the discussion be postponed until the August work session; the council agreed to the postponement. 11) REMOVED FROM AGENDA 12) Monthly COVID-19 financial impact report – Finance Director Burkhart updated the report given at the prior council work session. 13) Hickman Road/Alice’s Road access – Council Member Bergman stated that she was contacted by business owners along Alice’s Rd. near Hickman Rd. who were concerned about access to their businesses. Mayor Clarke noted that she and Development Services Director Deets had also met with a concerned business owner on the same subject. City Administrator Moerman added that staff had met with the developer on his concerns with access. The solution appears to be the extension of Laurel St., which won’t happen until the Etzel property begins to develop. After much discussion regarding alternatives for access, the council directed City staff to review possible development agreements for partial access. 14) Future council meetings – In light of increases in COVID-19 cases, and after some discussion, the council decided to go back to electronic meetings beginning in August. G. Council Liaison Reports – Reports made by Council Members Crone, Bergman. H. Comments – City Administrator Moerman informed the council of recent conversations with representatives of Central Iowa Water Trails and the Des Moines Visitors Bureau. Development Services Director Deets updated the council on recent and planned demolition of City-owned houses, as well as a possible future agreement regarding vineyard maintenance.
