AGENDA ITEM: Consideration of approval of a resolution approving a final plat for
Alyvia Plat 1
FORMAT: Resolution
SYNOPSIS INCLUDING PRO & CON: The applicant is requesting approval of a final plat
for an approximately 10-acre subdivision generally located east of N.
Warrior Lane and north of NE Badger Lane. The plat includes 13 lots
total. The lots range in size from 0.27-acre to 1.39-acres in area. Twelve
of the lots are intended for single family residential development. One lot
(Lot 7) remains zoned A-1 (Agriculture) and will be owned by the
adjacent owner to the east at 900 NE Badger Lane. If Lot 7 is to be
developed in the future for single family residential, it will need to be
rezoned to R-2 (One & Two Family Residential). Lot 7 will be platted to
the standards of the R-2 district. Outlot X is 1.46-acres in area and will
be dedicated to the City to satisfy parkland dedication requirements.
Public improvements have been completed for the subdivision and all
lots will be served by public utilities.
FISCAL IMPACT INCLUDING COST/BENEFIT ANALYSIS:
COMMISSION/BOARD/COMMITTEE COMMENT: The Planning and Zoning
Commission reviewed the request at their meeting on April 14, 2020,
and recommended approval:
Approval of a Final Plat for Alyvia Plat 1
Senior Planner, Andy Kass, introduced the request for approval of a final plat as submitted by the
applicant, Silo 9, LLC. The subject property is generally located north of NE Badger lane and
east of N. Warrior lane, and contains approximately 10 acres. The property was rezoned in 2019
to allow for single-family residential development.
Mr. Kass advised, the final plat identifies a total of 13 lots ranging in size from 0.27 acres to 1.39
acres in area. All lots meet the minimum lot requirements for the R-2 zoning district. Lot 1
contains the currently existing residence. Lot 7 will remain zoned A-1 and is owned by the
property owner to the east. Outlots 4A, 5A, and 6A will be owned by the owners of lots 4, 5, and
6 and are located within the FEMA floodplain. No structures can be built in these Outlots, and
they must remain with their corresponding Lots. Outlot X is 1.46 acres in area and is anticipated
to be acquired by the City of Waukee for parkland dedication.

Mr. Kass advised that an extension of NE Bobcat Drive will be completed to provide access to
the proposed lots, sidewalks will be constructed by each lot as it develops. Public utilities will
services the site and Stormwater detention will be managed by a number of small dry-bottom
basins located throughout the development to be owned and maintained by a Homeowner’s
Association.
Staff would recommend approval subject to remaining staff comments, review of the legal
documents, and completion of public improvements.
Commissioner Hoifeldt questioned if the trees were able to be saved on the eastern
border. Mr. Kass advised that a majority of them were required to be removed to allow
for storm water management.
Commissioner Streit questioned if anything had changed since the rezoning. Mr. Kass
advised not at this time.
Commissioner Hoifeldt moved to approve the Final Plat for Alyvia Plat 1 subject to remaining
staff comments, review of the legal documents, and completion of the public improvements.
Commissioner Streit seconded the motion. Ayes: Broderick, Ward, Streit, Koshy, and Hoifeldt.
Nays: None. Motion Carries.
STAFF REVIEW AND COMMENT: Staff’s position is that the proposed final plat meets the
intent and the requirements of the Zoning and Subdivision Ordinance.
RECOMMENDATION: Staff recommends approval of the Final Plat for Alyvia Plat 1.

APPROVING THE FINAL PLAT FOR ALYVIA PLAT 1
IN THE NAME AND BY THE AUTHORITY OF THE CITY OF WAUKEE, IOWA
WHEREAS, the City of Waukee, Dallas County, State of Iowa, is a duly organized Municipal
Organization; AND,
WHEREAS, Silo 9 Plat 1, LLC, and Brian J. & Angela R. Helgens, have requested final plat approval of
Alyvia Plat 1 (the “Plat”); AND,
WHEREAS, the City of Waukee Planning and Zoning Commission recommended approval of the Plat on
April 14, 2020, subject to remaining staff comments and review of the legal documents; AND,
WHEREAS, the Final Plat for Alyvia Plat 1 and the documents relating thereto will comply with Section
§303 - Land Subdivision Ordinance of the Waukee Municipal Code.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Waukee, Iowa on this 20th
day of July, 2020, that the Final Plat for Alyvia Plat 1 be and the same is hereby accepted and approved by
the City Council of the City of Waukee.
BE IT FURTHER RESOLVED that the City of Waukee does hereby accept the following easements and
documents to be filed with the Plat:
1. Warranty Deed (Lots A & B);
2. Warranty Deed (Outlot X);
3. Public Storm Sewer Easement;
4. Overland Flowage Easement;
5. Public Sanitary Sewer Easement;
6. Public Utility Easement;
7. Public Gas Easement;
8. Snow Storage Easement;
9. Private Sanitary Sewer, Water and Strom Service Easement;
10. Private Storm Sewer, Detention and Overland Flowage Easements;
11. Private Storm Water Detention Easement; and
12. Private Storm Sewer Easement.

HISTORY
The subject property was rezoned in 2019 to allow for a single-family residential subdivision. The applicant has
submitted the final plat for review and approval. Public improvements are nearly complete for the plat.
PROJECT DESCRIPTION
LOTS
The final plat identifies thirteen lots to be included within the development. The lots range in size from 0.27-acre to
1.39-acres in area. All lots meet the minimum required lot area. The minimum required lot width is 65-feet and all lots
meet the minimum width. Lot 1 has an existing home located upon it. Lots 1 – 6 and 8 – 13 will be for single-family
residential use. Lot 7 is zoned A-1 and will be owned by the property owner to the east of Lot 7. If a single-family home
is to be built upon Lot 7 in the future the property will need to be rezoned.
Outlots 4A, 5A, and 6A will be owned by the owners of Lots 4, 5, and 6. The reason these portions are included as
outlots is that they are located within the FEMA floodplain. Outlot X is 1.46-acres in area and the City is working with
the applicant to acquire the property for parkland dedication.

STREETS AND TRAIL
An extension of NE Bobcat Drive will be completed to provide access to the proposed lots. Five-foot-wide sidewalks
will be constructed along each lots as they are developed.
UTILITIES
Extensions of public utilities to serve each lot have been completed.
Storm water detention for the development is provided in a number of small dry-bottom basins located throughout the
development. A note on the final plat indicates that these basins will be maintained by the homeowners association.
STAFF RECOMMENDATION
The proposed lots meet the minimum requirements of the Zoning Ordinance. The final plat is in general conformance
with the Subdivision Ordinance. Staff recommends approval subject to remaining staff comments, review of the legal
document, and completion of public improvements.
