MINUTES OF THE August 20th, 2020 BOARD OF ADJUSTMENT MEETING
Call to Order. The August 20th, 2020 Board of Adjustment meeting was called to order at 5:30
P.M. by Chairman Garcia.
Roll Call. The following Board Members were present: Breckenridge, Garcia, Bisgard, and
Drees. Board member Meyers was absent. City Staff in attendance: Andy Kass, Melissa DeBoer
and Kathryn Purvis.
Agenda Approval. Board Member Garcia made a motion, seconded by Board Member
Breckenridge, to approve the agenda for August 20th, 2020. Ayes: Breckenridge, Garcia,
Bisgard, and Drees. Nays: None. Motion carried.
Approve the July 16th, 2020 Board of Adjustment Minutes. Board Member Bisgard made a
motion, seconded by Board Member Drees, to approve the Board of Adjustment meeting
minutes for July 16th, 2020. Ayes: Breckenridge, Garcia, Bisgard, and Drees. Nays: None.
Motion carried.
Application for 220 Corene Avenue (Lot 48, Corene Acres Plat 10)- Variance from
165.07(4) B of the Waukee Municipal Code to allow a deck larger than 50 square feet to be
located in the front yard.
Senior City Planner, Melissa DeBoer, introduced the request for a variance as submitted
by the applicant Ben Wiese and homeowners Kim and Dave Maldonado. The Variance, if
approved, would allow the construction of a deck approximately 64 square feet in size within the
front yard of the property. The subject property is generally located south of Corene Avenue and
east of 2nd Street Court. A notice of the proposed variance request was mailed to surrounding
property owners within a 310 foot radius and to date no correspondence has been shared with
staff for or against the request.
Mrs. DeBoer advised that the applicants have noted that the current stoop that is to be
replaced by the deck is already larger than the allowed 50 square foot maximum. The applicants
have also indicated that to just replace the stoop would cause financial hardship as additional
sidewalk and landscaping would be necessary to meet the ordinance. The applicants have also
stated that other homes currently have decks and patios larger than the ordinance suggests, and
that the deck is a solution that upgrades the façade of the home, which benefits the general
public.
Mrs. DeBoer advised that City Staff does not make recommendations in the case of a
variance, but offered a few notes for the Board to keep in mind. The ordinance in question is
recently adopted in 2019, meaning any deck prior to that was not affected by the restrictions.
Mrs. DeBoer also advised that the applicants could have a rear deck over 50 square feet.
Board member Garcia moved to approve the variance for 220 Corene Avenue ( Lot 48, Corene
Acres Plat 10)- variance from 165.07(4)B of the Waukee Municipal Code to allow a deck larger
than 50 square feet to be located in the front yard. The motion was seconded by Board member
Breckenridge. Ayes: Breckenridge, Garcia, Bisgard, and Drees. Nays: None. Motion carried.
New Business
Senior City Planner, Andy Kass, advised that there are more requests coming in the
future, and that staff is going to review the ordinance regarding front decks, and see if there is a
way to increase the maximum allowed size.
Adjournment
Board member Garcia moved to adjourn the meeting. The motion was seconded by board
member Breckenridge. Ayes: Breckenridge, Garcia, Bisgard, and Drees. Nays: None. Motion
carried.
The August 20th, 2020 Board of Adjustment Meeting was adjourned at 5:43 PM.
