The City and the Consultant agree to amend the original agreement to include additional services associated with: Additional Project Coordination to finalize adjacent Easements Additional Project Coordination for Utility Relocations Additional Design Survey Services to incorporate adjacent Development Agreements Additional Design Services to incorporate adjacent Development Agreements FISCAL IMPACT INCLUDING COST/BENEFIT ANALYSIS: The total Hourly Not-to-Exceed fees for the professional engineering services described in the agreement are as follows: I.Basic Services of the Consultant a.Task A –Stratford Crossing Easements $ 16,300.00 b.Task B –Utility Relocations (MidAmerican Energy) $ 19,400.00 c.Task C – Moore Parcel Development Agreement $ 15,500.00 d.Task D –Utility Relocations (Century Link, UPN & Mi-fiber) $ 8,000.00 e.Task E –Utility Relocations (City Gas) $ 8,000.00 f.Task F – Credit costs incurred for water main lowering ($ 9,902.39) TOTAL $ 57,297.61 COMMISSION/BOARD/COMMITTEE COMMENT: STAFF REVIEW AND COMMENT: RECOMMENDATION: Approve Resolution and Agreement. Engineering Services Amendment No. 1 PREPARED BY: Beth Richardson REVIEWED BY: Rudy Koester RK AGENDA ITEM: I7 THE CITY OF WAUKEE, IOWA RESOLUTION 2020- APPROVING ENGINEERING SERVICES AGREEMENT AMENDMENT NO. 1 BETWEEN FOTH INFRASTRUCTURE AND ENVIRONMENT, LLC, AND THE CITY OF WAUKEE [NORTH 10TH STREET IMPROVEMENT PROJECT, HICKMAN ROAD TO NW DOUGLAS BOULEVARD] IN THE NAME AND BY THE AUTHORITY OF THE CITY OF WAUKEE, IOWA WHEREAS, the City of Waukee, Dallas County, State of Iowa, is a duly organized Municipal Organization; AND, WHEREAS, on February 4, 2019, the Waukee City Council approved an Agreement for Professional Consulting Services with Foth Infrastructure and Environment, LLC, related to the design and construction administration of improvements to North 10th Street from Hickman Road north to NW Douglas Boulevard (Resolution #19-051); AND, WHEREAS, Engineering Services Agreement Amendment No. 1 is proposed to address additional project coordination and design services; NOW THEREFORE BE IT RESOLVED by the City Council of the City of Waukee that the Engineering Services Agreement Amendment No. 1 between Foth Infrastructure and Environment, LLC, and the City of Waukee [North 10th Street Improvement Project, Hickman Road to NW Douglas Boulevard] is hereby approved. Lyon Ben Sinclair Foth Infrastructure and Environment, LLC N. 10th Street Improvements Project Number 19W003.00 Hickman Rd to NW Douglas Blvd Waukee, Iowa Page 1 ENGINEERING SERVICES AMENDMENT NO. 1 PROJECT NO. 19W003.00 THIS AMENDMENT, made and entered into this day of 2020 by and between, the CITY OF WAUKEE, IOWA, hereinafter referred to as the “City”, and FOTH INFRASTRUCTURE AND ENVIRONMENT, LLC., hereinafter referred to as the "Consultant", for professional services in connection with the preliminary survey and mapping, functional design, project coordination, preliminary design, final plans and specifications, for the proposed construction of N 10th Street Improvements, from Hickman Road to NW Douglas Boulevard, hereby amends the original Agreement dated February 4th, 2019 as follows: The City and Consultant agree to amend the original Agreement to include additional services associated with:  Additional Project Coordination to finalize adjacent Easements  Additional Project Coordination for Utility Relocations  Additional Design Survey Services to incorporate adjacent Development Agreements  Additional Design Services to incorporate adjacent Development Agreements I. Basic Services of the Consultant TASK A – Additional Services for Stratford Crossing Easements The Consultant completed the following additional service as part of the project. Task A.1 Exhibit Preparation Exhibits for the project meetings consisted of aerial mosaics for the project with the major project features indicated on the aerial photograph. Include coloring, lettering, and other techniques to delineate the proposed design concepts and right of-way needs, including typical sections of the roadway. The figure indicated right-of-way needs, property lines, property ownership, access control lines, grading limits, and new project improvements. Task A.2 Project Coordination with Adjacent Landowner’s Engineering Consultant The Consultant conducted additional meetings to address specific conflicts and concerns. Meetings coordinated the proposed City project with proposed site improvements required to ensure underground utilities do not conflict with roadway improvements or future commercial site develop. Task A.3 Additional Platting Services Provided acquisition plats and legal descriptions for property to be acquired for the Project and perform land corner and lot surveys as needed for the preparation of the acquisition plats and legal descriptions for each parcel. Said plats and legal descriptions shall comply with requirements of the Iowa Code and shall be prepared by or under the direct supervision of a licensed land surveyor under the laws of the State of Iowa. The following numbers of additional plats were delivered. Permanent (Fee Title) Right-of-Way Acquisition Plat 3 Permanent Easements Public Utility Easement 1 Public Facility and Use Easement 2 Legal Descriptions Sign Easements 3 Task A Subtotal - $16,300.00 Foth Infrastructure and Environment, LLC N. 10th Street Improvements Project Number 19W003.00 Hickman Rd to NW Douglas Blvd Waukee, Iowa Page 2 TASK B –Additional Services for Utility (MidAmerican Energy) Relocations The Consultant completed the following additional service as part of the project. Task B.1 Project Coordination with MidAmerican The Consultant conducted additional meetings to address specific conflicts and concerns. Meetings coordinated the proposed City project with proposed relocations required to ensure MidAmerican facilities should not be impacted with future projects. Task B.2 Additional Platting Services Provided acquisition plats and legal descriptions for property to be acquired for the Project and perform land corner and lot surveys as needed for the preparation of the acquisition plats and legal descriptions for each parcel. Said plats and legal descriptions shall comply with requirements of the Iowa Code and shall be prepared by or under the direct supervision of a licensed land surveyor under the laws of the State of Iowa. The following numbers of additional plats were delivered. Permanent Easements Public Facilities and Use Easement 3 Task B.3 Additional Design Services The Consultant designed a proposed profile the length of the project to avoid existing utilities installed by the High School Site as well as proposed utilities installed with the NW 10th Street Project. This task also includes creation of plan and profile sheets detailing running line and depths to be staked in the field. Task B.4 Additional Construction Survey The Consultant performed construction stating to establish correct running line and depth to ensure MidAmerican Energy’s contractor installed the utility in the correct location. Task B Subtotal - $19,400.00 TASK C – Additional Services for Moore Parcel Development Agreement The Consultant completed the following additional service as part of the project. Task C.1 Exhibit Preparation Exhibits for the project meetings consisted of aerial mosaics for the project with the major project features indicated on the aerial photograph. Include coloring, lettering, and other techniques to delineate the proposed design concepts and right of-way needs, including typical sections of the roadway. Task C.2 Additional Topographic Survey The Consultant performed the following additional topographic surveys to determine, the potential revised location of the house and the amount of additional earthwork needed for driveway and sidewalk tie in elevations. This information was used to develop the existing ground DTM for the Project site. Task C.3 Additional Design Services The Consultant designed a preliminary site plan meeting City of Waukee standards for potential house relocation. Task C Subtotal - $15,500.00 TASK D –Additional Services for Utility (Century Link, UPN and mi-Fiber) Relocations The Consultant completed the following additional service as part of the project. Task D.1 Project Coordination with Utility Companies The Consultant conducted additional meetings to address specific conflicts and concerns. Meetings coordinated the proposed City project with proposed relocations required to ensure CenturyLink and mi-Fiber facilities should not be impacted with future developments adjacent to NW 10th Street. Foth Infrastructure and Environment, LLC N. 10th Street Improvements Project Number 19W003.00 Hickman Rd to NW Douglas Blvd Waukee, Iowa Page 3 Task D.2 Additional Construction Survey The Consultant performed construction stating to establish correct running line and depth to ensure utility’s contractor installed the conduits in the correct location for connections from existing facilities into the new Joint Utility Trench. Task D Subtotal - $8,000.00 TASK E –Additional Services for Utility (City Gas) Relocations The Consultant completed the following additional service as part of the project. Task E.1 Project Coordination with Utility Companies The Consultant conducted additional onsite meetings to address specific conflicts and concerns. Meetings coordinated the proposed roadway project with proposed relocations required to ensure City’s Gas Main facilities should not be impacted with future developments adjacent to NW 10th Street. Task E.2 Additional Construction Survey The Consultant performed construction stating along NW 10th Street and NW Sunrise Drive to establish correct running line and depth to ensure City’s gas contractor installed the main in the correct location to avoid upcoming sewer and water installations. Task E Subtotal - $8,000.00 TASK F – Credit equal to the costs incurred for water main lowering underneath NW Sunrise Drive The Consultant provided a finished grade profile based on typical section to which the water main was installed. This profile did not accurately account for the construction of NW Sunrise Drive and resulted in the main not having the necessary cover. Task F Subtotal - ($9,902.39) Foth Infrastructure and Environment, LLC N. 10th Street Improvements Project Number 19W003.00 Hickman Rd to NW Douglas Blvd Waukee, Iowa Page 4 In consideration for these services, the City agrees to adjust the compensation for services performed by the Consultant. These fees are based on the standard hourly rates of the Consultant’s personnel actually engaged in the performance of the services, plus direct out-of-pocket costs for expenses incurred by personnel who are actually engaged in the work and other direct costs. The total Hourly Not-to-Exceed fees for the professional engineering services as described in this amendment are as follows: I. Basic Services of the Consultant Task A $ 16,300.00 Task B $ 19,400.00 Task C $ 15,500.00 Task D $ 8,000.00 Task E $ 8,000,00 Task E $ -9,902.39 Total $ 57,297.61 THIS AMENDMENT is subject to all provisions of the original Agreement. THIS AMENDMENT, together with the original Agreement represents the entire and integrated AGREEMENT between the City and Consultant. THIS AMENDMENT executed the day and year written above.
