HomeMy WebLinkAbout2020-12-07-J01B 11162020_11202020_11302020_minutesWAUKEE CITY COUNCIL MINUTES November 16, 2020 *Due to public health concerns and guidance, in accordance with Iowa Code Sections 21.4(1)(b) and 21.8, this meeting of the Waukee City Council was conducted electronically as holding the meeting in person was impossible or impractical. (A) Call to Order – The regular meeting of the Waukee City Council was called to order by Mayor Clarke at 5:30 p.m. at Waukee City Hall, 230 W. Hickman Rd. and electronically via Zoom pursuant to the electronic meeting provisions of Iowa Code Sections 21.4(1)(b) and 21.8. (B) Pledge of Allegiance (temporarily suspended) (C) Roll Call – The following members were present: Mayor Courtney Clarke; Council Members R. Charles Bottenberg (electronically), Chris Crone, Larry R. Lyon (electronically), Ben Sinclair (electronically). Absent: Council Member Anna Bergman. (Council Member Bergman began participating electronically at 5:38 p.m.) Also in attendance: City Administrator Tim Moerman, Development Services Director Brad Deets (electronically), Finance Director Linda Burkhart (electronically), Public Works Director/City Engineer Rudy Koester (electronically), Parks & Recreation Director Matt Jermier (electronically), Marketing & Communications Director Summer Evans (electronically), IT Director Son Le (electronically), Human Resources Director Michelle Lindsay (electronically), Police Chief John Quinn, City Clerk Rebecca D. Schuett, City Attorney Steve Brick (electronically). (D) Open Forum – 1) John Dvorak, 645 Silverleaf Ln., addressed the council regarding Agenda Item #I13 (discussion of Silverleaf Ln. alignment). He stated that it appeared that the Development Services Department was promoting one alignment option over any others. He then listed what he saw as the positives and negatives of each of the three presented options, adding that he favored a lack of neighborhood connectivity from Willow Pines. Mayor Clarke said that she disagreed that City staff were only promoting one option, adding that one of the council’s goals is strong neighborhood design and that the alignment is ultimately the council’s decision. 2) Mike Lang, 3100 Caterine Ct., spoke on the same matter as Mr. Dvorak, noting existing access points to Willow Pines (Silverleaf Ln. and Jackpine Dr.) and stating that it was unlikely that both access points would be simultaneously closed to traffic. (Council Member Bergman began participating electronically at 5:38 p.m.) (E) Agenda Approval – Council Member Crone moved to approve the agenda; seconded by Council Member Sinclair. Results of vote: Ayes: Bergman, Bottenberg, Crone, Lyon, Sinclair. Nays: None. Motion carried 5 – 0. (F) Presentations: None (G) Public Hearings: 1) On a proposed North Waukee Residential Urban Renewal Plan in the City of Waukee – Mayor Clarke opened the public hearing and asked if any written correspondence had been received; City Clerk Schuett replied in the negative. Development Services Director Deets reviewed the plan area, which includes two market-rate multi-family developments currently under construction. The majority of the units within those developments are one-bedroom or smaller. Residential urban renewal areas are 10-year plans, whereas commercial areas are 20-year plans. Aproximately one-third of the TIF revenue generated by the North Waukee Residential Urban Renewal Plan will be set aside for low to moderate income (LMI) funding opportunities. The remaining two-thirds of revenue can be used for public improvement projects, with two Douglas Pkwy. extension projects identified for the use of those funds. A consultation hearing was held on October 26 with no one attending; the Planning & Zoning Commission also reviewed the plan and recommend approval. No comments were made by the public in attendance. J1B 2 (H) Public Hearing Action Items: 1) Resolution: Consideration of approval of a resolution determining an area of the City to be an economic development area, and that the rehabilitation, conservation, redevelopment, development or a combination thereof, of such area is necessary in the interest of the public health, safety or welfare of the residents of the City; designating such area as appropriate for urban renewal projects; and adopting the North Waukee Residential Urban Renewal Plan – Council Member Lyon moved to approve the resolution; seconded by Council Member Sinclair. Results of vote: Ayes: Bergman, Bottenberg, Crone, Lyon, Sinclair. Nays: None. Motion carried 5 – 0. He noted the 10th St. alignment, which was discussed at earlier council meetings, as well as other street extensions and a parkland dedication area that would be part of the greenbelt corridor system and connect to a larger park to the north. A stormwater detention pond will be maintained by a homeowner’s association. Council Member Bottenberg asked if there were any objections from neighbors regarding the alignment of 10th St.; Mr. Deets replied that he and Mayor Clarke hosted a neighborhood meeting following the rezoning approval and that the current street alignment was that which was presented at that meeting. While the townhomes are not being platted at this time, the developer agreed to certain concessions related to that part of the project, including building design and configuration, green space and buffering. Mayor Clarke added that during the neighborhood meeting, the townhome design concessions appeared to put many other concerns to rest. She added that she received correspondence after that meeting from neighbors who could not attend, and that those neighbors were comfortable with what was proposed. Consideration of approval of a motion approving 2021-2022 Tax Increment Financing (TIF) Indebtedness Certifications to the Dallas County Auditor C. Consideration of approval of a resolution approving the State of Iowa FY2020 Annual Urban Renewal Report and directing the Finance Director for the City of Waukee to file the report with the Department of Management (Resolution #2020-456) E. Work Session: 1) FY2020-2021 Strategic Plan: Economic development strategy, business start-ups – Mike Colwell with the Greater Des Moines Partnership presented on the types of start-up businesses that are attracted to the Des Moines metro and possible ways to attract such businesses. 2) Residential animal regulations – Development Services Director Deets noted a request from a resident to allow her to continue keeping a pot-bellied pig as a domestic animal in a residential zoning district. Mr. Deets stated that only Johnston allows such animals; all other metro cities, including Waukee, consider such animals as livestock and only permit them in agricultural zoning districts. He then reviewed the legal difference between emotional support and service animals. After much discussion, the council agreed to send the matter through the Board of Adjustment. 3) University Avenue Extension Project, west of Warrior Lane – Public Works Director/City Engineer Koester and Project Engineer Nate Hardisty (Shive-Hattery, Inc.) reviewed two possible road alignments. The council agreed to move forward with design of the more southerly alignment. 4) Des Moines Area Metropolitan Planning Organization TAP/SRTS Projects – Public Works Director/City Engineer Koester discussed various traffic signal and pedestrian crossing improvements for which the City can apply for grant funding. 5) City Hall Improvements Project update – Development Services Director Deets reviewed a proposed engineering agreement amendment and construction change order to address specific issues with the City Hall front vestibules. 2 6) Waukee Signage Project contract update – Development Services Director Deets noted various separate engineering agreements with Shive-Hattery, Inc., for signage improvements, recommending that all such contracts be consolidated into one contract with amendments. 7) EPA Risk and Resilience Assessment – Public Works Director/City Engineer Koester stated that the Environmental Protection Agency (EPA) requires a water system assessment for communities with a water system serving a certain number of customers.
