AGENDA ITEM: Consideration of approval of a resolution approving Professional Services
Amendment with Shive Hattery Inc. [Waukee City Hall Improvements
Project]
FORMAT: Resolution
SYNOPSIS INCLUDING PRO & CON: It has been discovered that there were issues related to the
original design and construction of the two vestibules on the front of City
Hall. Both the consultant and the contractor have taken care of the additional
costs to correct the problems with the original design. The proposed
amendment to the Professional Services Agreement is to reduce the fees
charged by Shive Hattery which in turn will be included as increase to Ball
Team in the form of a change order of the project. The end result is that there
is no additional cost to the City.
FISCAL IMPACT INCLUDING COST/BENEFIT ANALYSIS: Reduction in $15,000 to
contract

APPROVING AMENDMENT TO AGREEMENT FOR PROFESSIONAL CONSULTING
SERVICES WITH SHIVE HATTERY [WAUKEE CITY HALL EXTERIOR
IMPROVEMENT PROJECT]
IN THE NAME AND BY THE AUTHORITY OF THE CITY OF WAUKEE, IOWA
WHEREAS, the City of Waukee, Dallas County, State of Iowa, is a duly organized Municipal
Organization; AND,
WHEREAS, the City retained the services of Shive Hattery, related to the design development
and construction and bid administration for the Waukee City Hall Exterior Improvement Project;
AND,
WHEREAS, this Amendment relates to a reduction in fees due to additional improvements that
were required to be made to the vestibules associated with the City Hall Project which were
related to the original design resulting in a reduction in fees by $15,000.00;
NOW THEREFORE BE IT RESOLVED by the City Council of the City of Waukee that the
Amendment to Agreement for Professional Consulting Services with Shive Hattery [Waukee
City Hall Exterior Improvement Project] is hereby approved.
Passed by the City Council of the City of Waukee, Iowa, and approved the 7th day of December
2020.

City of Waukee, IA and Shive-Hattery, Inc. (S-H) agree to amend the Original Agreement as follows:
AMENDED SCOPE OF SERVICES
1. Deduction of professional services fees for the costs incurred by the City of Waukee for
repairs to the vestibules as a result of a design error.
CLIENT RESPONSIBILITIES
No changes.
SCHEDULE
The Schedule is revised as follows: Completion by December 31, 2020.

• Fixed - We will provide the additional Scope of Services for the lump sum fees listed above.

The terms of this proposal are valid for 30 days from the date of this proposal.

No changes.
AGREEMENT
When accepted by both parties, this Amendment will amend the Original Agreement and is subject to all
other terms and conditions of the Original Agreement. Original, facsimile, electronic signatures or other
electronic acceptance by the parties (and returned to Shive-Hattery) are deemed acceptable for binding
the parties to the Amendment. The Client representative signing this Amendment warrants that he or
she is authorized to enter into this Amendment on behalf of the Client.
