December 7, 2020
*Due to public health concerns and guidance, in accordance with Iowa Code Sections
21.4(1)(b) and 21.8, this meeting of the Waukee City Council was conducted electronically as
holding the meeting in person was impossible or impractical.
(A) Call to Order – The regular meeting of the Waukee City Council was called to order by Mayor
Pro Tem Bottenberg at 5:30 p.m. at Waukee City Hall, 230 W. Hickman Rd. and electronically
via Zoom pursuant to the electronic meeting provisions of Iowa Code Sections 21.4(1)(b) and
21.8.
(B) Pledge of Allegiance (temporarily suspended)
(C) Roll Call – The following members were present: Council Members R. Charles Bottenberg
(electronically), Chris Crone, Larry R. Lyon (electronically), Ben Sinclair (electronically). Absent:
Mayor Courtney Clarke; Council Member Anna Bergman.
Also in attendance: City Administrator Tim Moerman, Finance Director Linda Burkhart
(electronically), Development Services Director Brad Deets (electronically), Public Works
Director/City Engineer Rudy Koester (electronically), Parks & Recreation Director Matt Jermier

(G) Presentations:
1) Independent Auditor’s Final Report for the fiscal year ending June 30, 2020 –
Presentation made by Robert Endriss with Deman & Co.
2) Resolution: Consideration of approval of the Independent Auditor’s Final Report for
the fiscal year ending June 30, 2020 – Council Member Lyon moved to approve the
resolution; seconded by Council Member Sinclair. Results of vote: Ayes: Bottenberg, Crone,
Lyon, Sinclair. Nays: None. Absent: Bergman. Motion carried 4 – 0 – 1. (Resolution
#2020-457)
(H) Public Hearings:
1) On an ordinance to amend Chapter 169, Zoning Ordinance, City of Waukee, Iowa, by
rezoning certain property from A-1 to R-1, a property known as Castle Property –
Mayor Pro Tem Bottenberg opened the public hearing and asked if any written
correspondence had been received; City Clerk Schuett replied in the negative. Development
Services Director Deets presented on the proposed rezoning application, noting that the
property was recently annexed by the City. He then reviewed a development concept plan,
stating that the property was not included within the City’s comprehensive development plan,
but that the proposed zoning is consistent with other planned zoning in the area. There may
be a request in the future to modify the comprehensive plan to allow for some commercial
development near the subject property. Council Member Sinclair asked if there were any
plans to connect the subject property to the parcel to the north; Mr. Deets replied in the
negative, stating that City staff would not advocate for a street connection and adding that
there would be landscaping and berming requirements if the parcel to the north develops as
commercial property. No comments were made by the public in attendance.

2) On the annexation of consenting property by the City of Waukee, Iowa [Boley
Property] – Mayor Pro Tem Bottenberg opened the public hearing and asked if any written
correspondence had been received; City Clerk Schuett replied in the negative. Development
Services Director Deets presented on the voluntary annexation application, citing some
interest in further development of the property. No comments were made by the public in
attendance.
3) On plans, specifications, form of contract and estimate of cost [NW Douglas Parkway
Project, NW 10th Street to NW 2nd Street] – Mayor Pro Tem Bottenberg opened the public
hearing and asked if any written correspondence had been received; City Clerk Schuett
replied in the negative. Public Works Director/City Engineer Koester presented on the
project, noting that rough grading was completed as part of Triumph Park site work. No
comments were made by the public in attendance.
4) On plans, specifications, form of contract and estimate of cost [NW 2nd Street Project,
NW Venture Drive to NW Douglas Parkway] – Mayor Pro Tem Bottenberg opened the
public hearing and asked if any written correspondence had been received; City Clerk
Schuett replied in the negative. Public Works Director/City Engineer Koester presented on
the project, adding that it would help complete the roadways surrounding Northwest High
School. No comments were made by the public in attendance.
(I) Public Hearing Action Items:
1) Ordinance: Consideration of approval of an ordinance to amend Chapter 169, Zoning

Crone introduced the ordinance and moved to approve the first reading in title only;
seconded by Council Member Sinclair. Results of vote: Ayes: Bottenberg, Crone, Lyon,
Sinclair. Nays: None. Absent: Bergman. Motion carried 4 – 0 – 1.
2) Resolution: Consideration of approval of a resolution approving the annexation of
consenting property by the City of Waukee, Iowa [Boley Property]– Council Member
Lyon moved to approve the resolution; seconded by Council Member Crone. Results of
vote: Ayes: Bottenberg, Crone, Lyon, Sinclair. Nays: None. Absent: Bergman. Motion
carried 4 – 0 – 1. (Resolution #2020-458)
3) NW Douglas Parkway Project, NW 10th Street to NW 2nd Street
A. Resolution: Consideration of approval of a resolution approving plans,
specifications, form of contract and estimate of cost – Council Member Crone
moved to approve the resolution; seconded by Council Member Lyon. Results of vote:
Ayes: Bottenberg, Crone, Lyon, Sinclair. Nays: None. Absent: Bergman. Motion carried
4 – 0 – 1. (Resolution #2020-459)
B. Resolution: Consideration of approval of a resolution awarding contract – Council
Member Crone moved to approve the resolution; seconded by Council Member Lyon.
Public Works Director/City Engineer Koester reviewed the bid tabulation, recommending
award to Elder Corporation of Des Moines, IA. Council Member Bottenberg speculated
that the low bid was a result of Elder Corporation already doing work in the vicinity; Mr.
Koester agreed that was likely a reason. Results of vote: Ayes: Bottenberg, Crone,
Lyon, Sinclair. Nays: None. Absent: Bergman. Motion carried 4 – 0 – 1. (Resolution
#2020-460)
C. Resolution: Consideration of approval of a resolution approving contract and
bond – Council Member Crone moved to approve the resolution; seconded by Council
Member Sinclair. Results of vote: Ayes: Bottenberg, Crone, Lyon, Sinclair. Nays: None.
Absent: Bergman. Motion carried 4 – 0 – 1. (Resolution #2020-461)
4) NW 2nd Street Project, NW Venture Drive to NW Douglas Parkway

2) Ordinance: Consideration of approval of an ordinance amending Chapter 204D,
Waukee Municipal Code, by repealing the current chapter and enacting in lieu thereof
Chapter 204D, Post Construction Storm Water Management [introduction; first
reading]– Council Member Lyon introduced the ordinance and moved to approve the first
reading in title only; seconded by Council Member Crone. Public Works Director/City
Engineer Koester noted that the proposed updates were a result of recommendations
through the Capital Crossroads project. He added that City staff would ask the council to
waive consideration of the third reading at the Dec. 21 regular meeting. Results of vote:
Ayes: Bottenberg, Crone, Lyon, Sinclair. Nays: None. Absent: Bergman. Motion carried 4 –
0 – 1.
3) Ordinance: Consideration of approval of an ordinance to amend Chapter 222, Waukee
Municipal Code, by repealing the current chapter and in lieu thereof adopting by
reference the 2018 edition of the International Codes, with amendments,
modifications, additions and deletions as specified [second reading] – Council Member
Crone moved to approve the second reading of the ordinance in title only; seconded by
Council Member Lyon. Results of vote: Ayes: Bottenberg, Crone, Lyon, Sinclair. Nays:

noting plans for the future extension of Douglas Pkwy. The developer has bonded for any

7) Resolution: Consideration of approval of a resolution approving final plat for James
Pointe Plat 1 – Council Member Sinclair moved to approve the resolution; seconded by
Council Member Crone. Development Services Director Deets briefly reviewed the plat,
noting plans for a future signalized intersection at Hickman Rd./NW 17th St. The developer
has bonded for certain improvements that cannot be completed until the adjoining property
develops. Results of vote: Ayes: Bottenberg, Crone, Lyon, Sinclair. Nays: None. Absent:
Bergman. Motion carried 4 – 0 – 1. (Resolution #2020-480)
8) Resolution: Consideration of approval of a resolution approving site plan for
Redwood at Waukee Hickman Road – Council Member Crone moved to approve the
resolution; seconded by Council Member Lyon. Development Services Director Deets
reviewed the site plan for townhome development, noting a large regional detention pond on
site that will serve the townhome parcel and several of the commercial and light industrial
lots to the south. He then reviewed building exterior elevations. Council Member
Bottenberg asked if the detention area would be a wet-bottomed pond; Mr. Deets replied in
the affirmative. Results of vote: Ayes: Bottenberg, Crone, Lyon, Sinclair. Nays: None.

9) Resolution: Consideration of approval of a resolution approving Chapter 28E

*Due to public health concerns and guidance, in accordance with Iowa Code Sections 21.4(1)(b) and
21.8, this meeting of the Waukee City Council was conducted electronically as holding the meeting
in person was impossible or impractical.
A. Call to Order – The work session meeting of the Waukee City Council was called to order by Mayor
Clarke at 5:36 p.m. at Waukee City Hall, 230 W. Hickman Rd. and electronically via Zoom pursuant to
the electronic meeting provisions of Iowa Code Sections 21.4(1)(b) and 21.8.
B. Roll Call – The following members were present: Mayor Courtney Clarke; Council Members R. Charles

1) 2021 legislative session preview – Doug Struyk and Jim Carney with Carney & Appleby
(participating electronically) presented on legislation anticipated to be proposed during the
upcoming session.
2) FY2020-2021 Strategic Plan: Economic development strategy – business start-ups – City
Administrator Moerman asked the council for input on what kinds of business to target, what
amenities might attract such business, and potential partnerships.
3) Capital Improvement Program for Fiscal Years 2022-2026 – City Administrator Moerman,
Finance Director Burkhart, Development Services Director Deets and Public Works Director/City
Engineer Koester reviewed the proposed program and how the projects would be financed.
4) FY2022 City contributions to non-profit organizations – City Administrator Moerman
summarized the funding requests received and reviewed some possible reporting criteria.
5) FY2020-2021 Strategic Plan: Neighborhood planning – Development Services Director Deets
proposed a professional services agreement to undertake a neighborhood master plan.

7) Interior storage discussion – Development Services Director Deets discussed a possible zoning
ordinance amendment to allow for interior storage facilities with upgraded exterior elevations in
commercial zoning districts.
