AGENDA ITEM:Consideration of approval of an ordinance correcting a scrivener’s error
in Ordinance No. 2915 amending Chapter 502, Waukee Municipal Code,
as specified [introduction; first, second, third (final) readings]
FORMAT:Ordinance
SYNOPSIS INCLUDING PRO & CON: On 10/01/2018, the City Council approved Ordinance
No. 2901, which added SE Bishop Drive to Sections 502.1 and
502.7. Ordinance No. 2915, approved by the City Council on
12/17/2018, inadvertently removed that street from Section 502.7.
FISCAL IMPACT INCLUDING COST/BENEFIT ANALYSIS:
COMMISSION/BOARD/COMMITTEE COMMENT:
STAFF REVIEW AND COMMENT: City staff recommends approval of the first reading of
the ordinance in title only and waiver of the second and third readings.
The Code of Iowa requires a vote of not less than three-fourths of all the
members of the council (or 4 out of 5, in Waukee’s case) in order to
waive readings of an ordinance.
RECOMMENDATION: Introduce the ordinance and move to approve the first reading in title
only, waive the second and third readings, and place the ordinance on
final passage.

AN ORDINANCE CORRECTING A SCRIVENER’S ERROR IN ORDINANCE NO. 2915
AMENDING CHAPTER 502, WAUKEE MUNICIPAL CODE, AS SPECIFIED BELOW:
WHEREAS, the City passed Ordinance No. 2915 on December 17, 2018 and said
ordinance contained a scrivener’s error the City now desires to correct.
BE IT ORDAINED by the City Council of the City of Waukee:
Section 1. Chapter 502, Waukee Municipal Code, Section 502.7 should be and the same
is hereby repealed and enacted in lieu thereof is as follows:
§502.7 No parking is permitted on the south side of the following east-west streets:
Arrowhead Drive
Badger Lane (NE)
Bailey Circle (loop street from 145 to 255 Bailey Circle)
Bel Aire Court

this ordinance are hereby repealed.

Section 3. Severability Clause. If any section, provision or part of this ordinance shall be
adjudged invalid or unconstitutional, such adjudication shall not affect the validity of the ordinance
as a whole or any section, provision, or part thereof not adjudged invalid or unconstitutional.
Section 4. Effective Date. This ordinance shall be in effect upon its final passage, approval
and publication as provided by law.

SECTION 502 “PARKING REGULATIONS,” CERTAIN PUBLIC STREETS AS

WHEREAS, the City of Waukee has determined that certain public streets should be added
to the no parking ordinances.
BE IT ORDAINED by the Council of the City of Waukee:
Section 1. Chapter 502, Waukee Municipal Code, Traffic Regulations, Section 502.1 is
hereby amended to add as follows:
§502.1 No parking is permitted on the either side of the following north-south
streets:
SE Bishop Drive between University Avenue and SE Emerald Drive
Section 2. Chapter 502, Waukee Municipal Code, Traffic Regulations, Section 502.7 is
hereby amended to add as follows:
§502.7 No parking is permitted on the south side of the following east-west streets:
