AGENDA ITEM: Consideration of approval of a resolution approving extension of zoning
regarding certain Planned Unit Development provisions (University
Woods)
FORMAT: Resolution
SYNOPSIS INCLUDING PRO & CON: The property located at 15705 SE University
Avenue which is generally located on the north side of University
Avenue and east of The Winhall Apartments was subject to a rezoning of
the property that was approved in August 2017.
The approved rezoning allowed for the use of the property as a senior
living development as well as a skilled recovery center as had previously
been approved for the property.
The Planned Development document included a provision related to the
commencement of the project and specifically stated that if construction
of the project had not commenced by January 1, 2019, then the City
Council would have the option to rezone the property back to the
previous zoning of the property that was completed in 2012. This would
require the City Council follow the same process as it does for any
rezoning applications including a review of the zoning change by the
Planning and Zoning Commission and a public hearing before the City
Council.
The provision also stipulated that the property owner had the option to
request an extension of the zoning approved in 2017 for one year out to
January 1, 2020. Staff has received a request from the property owner to
extend the zoning provisions approved in 2017 to January 1, 2020.

STAFF REVIEW AND COMMENT: Staff would recommend approval of the extension
request.
RECOMMENDATION: Approve the resolution.

APPROVING THE FINAL PLAT FOR TWIN OAKS
IN THE NAME AND BY THE AUTHORITY OF THE CITY OF WAUKEE, IOWA
WHEREAS, the City of Waukee, Dallas County, State of Iowa, is a duly organized Municipal
Organization; AND,
WHEREAS, JEFFERY WYCOFF, has requested final plat approval of Twin Oaks (the “Plat”); AND,
WHEREAS, the City of Waukee Planning and Zoning Commission recommended approval of the Plat
on November 13, 2018, subject to remaining staff comments and review of the legal documents; AND,
WHEREAS, the Final Plat for Twin Oaks and the documents relating thereto will comply with
Section §303 - Land Subdivision Ordinance of the Waukee Municipal Code.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Waukee, Iowa on this
7th day of January, 2019, that the Final Plat for Twin Oaks be and the same is hereby accepted and
approved by the City Council of the City of Waukee.
BE IT FURTHER RESOLVED that the City of Waukee does hereby accept the following easements
and documents to be filed with the Plat:
1. Warranty Deed (Street Lot A);
2. Public Utility Easement;
3. Public Surface Water Flowage and Storm Water Detention Easement

Honorable Council Members,
This letter is written on behalf of University Woods, L.L.C., owner of the tract of land described
in “Exhibit A” to this letter.
The City has approved entitlements for a Senior Living Residential Community in Ordinance
No. 2854, passed August 7, 2017.
Pursuant to paragraph 7 in the Ordinance, we respectfully request a one-year extension of the
approved site plan and start-up date.
