AGENDA ITEM:Consideration of approval of a resolution approving Professional Services
Amendment with Shive-Hattery, Inc. for the Westown Meadows Park Project
in the amount of $7,800.00.
FORMAT:Consent Agenda
SYNOPSIS INCLUDING PRO & CON: The Request for Additional Services is due to the change
in scope for the design of the restroom and shelter structures within the park
project. Originally the contract did not include design and engineering of the
restrooms and shelters because the intent was to utilize a prefabricated
restroom and shelters. Through final design it was determined that we were
not going to get the end product that we anticipated and expect. This
amendment will cover the following:
1. Complete custom designed restroom bid documents including: Detailed
drawings, technical specifications, and architectural detailing for both the
restroom and the shelter structures.
A final presentation of the Westown Meadows Park Project will be presented
at the February work session prior to going out to bid.

RESOLUTION 19-
APPROVING PROFESSIONAL SERVICES AMENDMENT WITH SHIVE-HATTERY,
INC. [WESTOWN MEADOWS PARK IMPLEMENTATION PROJECT]
IN THE NAME AND BY THE AUTHORITY OF THE CITY OF WAUKEE, IOWA
WHEREAS, the City of Waukee, Dallas County, State of Iowa, is a duly organized Municipal
Organization; AND,
WHEREAS, on February 5, 2018, the Waukee City Council approved an Agreement for
Professional Consulting Services with Shive-Hattery, Inc., related to master planning of
Westown Meadows Park (Resolution #18-045); AND,
WHEREAS, on October 15, 2018, the Waukee City Council approved an Agreement for
Professional Consulting Services with Shive-Hattery, Inc., related to implementation of the
Westown Meadows Park Master Plan (Resolution #18-442); AND,
WHEREAS, due to the change in scope for the design of the park shelter and restroom
structures, Shive-Hattery, Inc., proposes an amendment to the implementation agreement;
NOW THEREFORE BE IT RESOLVED by the City Council of the City of Waukee that the
Professional Services Amendment with Shive-Hattery, Inc. [Westown Meadows Park
Implementation Project] is hereby approved.
Passed by the City Council of the City of Waukee, Iowa, and approved the 21st day of January,
2019.

ORIGINAL AGREEMENT DATE: October 15, 2018
AMENDMENT DATE: January 10, 2019
City of Waukee, IA and Shive-Hattery, Inc. (S-H) agree to amend the Original Agreement as follows:
SCOPE OF SERVICES:
Shive-Hattery, Inc. (S-H) will provide the following additional services:
1. Complete custom designed restroom bid documents including:
a. Detailed drawings
b. Technical specifications
2. Complete custom designed shelter bid documents including:
a. Architectural detailing
b. Structural engineering
c. Technical specifications
SCHEDULE
We will start our services upon receipt of this executed Agreement.
COMPENSATION:
We will provide the Scope of Services for fixed fee of seven thousand eight hundred dollars
($7,800.00)
It should be noted that during the process, unexpected items or events occur that sometimes result in
the need for additional services that cannot be identified in the proposa l stage. Should additional
services be required beyond the Scope of Services listed in this proposal, we will submit an other
amendment to our contract for your approval and signature prior to our proceeding with the additional
services.
The terms of this proposal are valid for 30 days from the date of this proposal.
TERMS AND CONDITIONS
No changes from the terms and conditions agreed-upon in the agreement dated October 15, 2018.

AGREEMENT
When accepted by both parties, this Amendment will amend the Original Agreement and is subject to all
other terms and conditions of the Original Agreement. Original, facsimile, electronic signatures or other
electronic acceptance by the parties (and returned to Shive-Hattery) are deemed acceptable for binding
the parties to the Amendment. The Client representative signing this Amendment warrants that he or
she is authorized to enter into this Amendment on behalf of the Client.
