AGENDA ITEM: Consideration of approval of a resolution approving final plat for The
Landing at Shadow Creek Plat 5
FORMAT: Resolution
SYNOPSIS INCLUDING PRO & CON: The applicant is requesting approval of a final plat
for an approximately 10.19-acre subdivision located west of NE Addison
Drive and south of NE Douglas Parkway. The proposed final plat
includes a total of one (1) lot for a townhomes development. The
townhome development is a 74-unit project that is the second phase of
the Somerset Oaks development. Access to the development will be
provided via NE Douglas Parkway. Streets interior to the development
will be privately owned and maintained.
FISCAL IMPACT INCLUDING COST/BENEFIT ANALYSIS:
COMMISSION/BOARD/COMMITTEE COMMENT: The Planning and Zoning
Commission reviewed the request at their meeting on January 8,
2019 and recommended approval subject to remaining staff
comments:
Approval of a Final Plat for the Landing at Shadow Creek Plat 5
Senior Planner, Andy Kass, introduced the request for approval of a final plat as submitted by the
applicant, Somerset Oaks Two, LLC. The subject property is located south of NE Douglas
Parkway and west of NE Addison Drive containing approximately 10.2 acres. The final plat
indicates that the second phase of the Somerset Oaks townhome project is intended for the site,
creating an additional 74 townhomes for rental purposes. All internal streets are privately owned
and maintained as are all of the utilities. Storm water detention areas are also owned and
maintained by the property owner. All site related easements are located on this final plat.
At this time staff recommends approval of the final plat for The Landing at Shadow Creek Plat 5
subject to remaining staff comments and review of the legal documents.
Commissioner Streit questioned if this is the general area that a car wash was anticipated. Mr.
Kass advised that this was close to the location. The car wash project is proposed on the corner of
NE Douglas Parkway and NE Addison Drive.
Commissioner Broderick moved to approve a final plat for The Landing at Shadow Creek Plat 5
subject to remaining staff comments and review of the legal documents. Commissioner Sandie

seconded the motion. Ayes: Sandie, Streit, Tietz, Broderick and Koshy. Nays: None. Motion
Carries.
STAFF REVIEW AND COMMENT: Staff’s position is that the proposed final plat meets the
intent and the requirements of the R-4 Zoning District, the
comprehensive plan, and the Subdivision Ordinance.
RECOMMENDATION: Staff recommends approval of the Final Plat for The Landing at
Shadow Creek Plat 5.

APPROVING THE FINAL PLAT FOR THE LANDING AT SHADOW CREEK PLAT 5
IN THE NAME AND BY THE AUTHORITY OF THE CITY OF WAUKEE, IOWA
WHEREAS, the City of Waukee, Dallas County, State of Iowa, is a duly organized Municipal
Organization; AND,
WHEREAS, SOMERSET OAKS TWO, LLC, has requested final approval of The Landing at Shadow
Creek Plat 5 (the “Plat”); AND,
WHEREAS, the City of Waukee Planning and Zoning Commission recommended approval of the Plat
on January 8, 2019, subject to remaining staff comments and review of the legal documents; AND,
WHEREAS, the Final Plat for The Landing at Shadow Creek Plat 5 and the documents relating
thereto will comply with Section §303 - Land Subdivision Ordinance of the Waukee Municipal Code.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Waukee, Iowa on this
21st day of January, 2019, that the Final Plat for The Landing at Shadow Creek Plat 5 be and the same
is hereby accepted and approved by the City Council of the City of Waukee.
BE IT FURTHER RESOLVED that the City of Waukee does hereby accept the following easements
and documents to be filed with the Plat:
1. Public Utility Easement;
2. Gas Main Easement;
3. Public Overland Flowage Easement;
4. Private Water Main Easement;
5. Private Sanitary Sewer Easement;
6. Private Storm Water Detention Easement; and
7. Private Ingress/Egress Easement;

HISTORY
The subject property was rezoned in 2015 to R-4 as part of the Landing at Shadow Creek Plat 4 rezoning. The applicant
intends to construct a second phase of the existing Somerset Oaks development that is directly to the west of the
subject property. The second phase was approved by the City Council in 2018. The first phase of Somerset Oaks
consisted of 19 buildings with a total of 100 townhome units and was completed in early 2018.
PROJECT DESCRIPTION
LOTS
The final plat identifies one (1) lot to be platted. Lot 1 is 10.19-acres in area. Not outlots are included as part of the final
plat. The proposed townhome development will be owned by one company and all units are rentals, so individual lots
for each unit are not required.
STREETS AND TRAIL
No public streets are included as part of this development. All internal streets will be privately owned and maintained.
No trails are included as part of the development. Five-foot-wide sidewalks will be constructed along NE Douglas
Parkway when the property develops. Sidewalks are included along one side of each private street within the
development.
UTILITIES
All utilities within the development will be privately owned and maintained. Storm water detention areas will also be
owned and maintained by the property owner.
PARKLAND
Parkland dedication was satisfied with The Landing at Shadow Creek Plat 4.
STAFF RECOMMENDATION
The plat is in conformance with the Subdivision and Zoning Ordinances. Staff recommends approval of the final plat for
The Landing at Shadow Creek Plat 5 subject to remaining staff comments and review of the legal documents.
