AGENDA ITEM: Consideration of approval of a resolution approving Preannexation Agreement
[Brian D. and Marcie A. Curnes]
FORMAT: Resolution
SYNOPSIS INCLUDING PRO & CON: The subject property is located within the unincorporated
portion of Dallas County. The property owners have expressed a desire to
connect to the City water main along R-22. In order to do so the property
owner was required to sign a pre-annexation agreement which has been
attached for review.
Annexation of the property into the City of Waukee will be completed at such
a time that the corporate limits are adjacent to the property.
FISCAL IMPACT INCLUDING COST/BENEFIT ANALYSIS:

STAFF REVIEW AND COMMENT: City staff recommends City Council approval of the pre-
annexation agreement with the property owner.
RECOMMENDATION: Approve the resolution.

RESOLUTION 19
APPROVING PREANNEXATION AGREEMENT
[BRIAN D. AND MARCIE A. CURNES]
IN THE NAME AND BY THE AUTHORITY OF THE CITY OF WAUKEE, IOWA
WHEREAS, the City of Waukee, Dallas County, State of Iowa, is a duly organized Municipal
Organization; AND,
WHEREAS, Brian D. and Marcie A. Curnes, submitted a preannexation agreement and application
for voluntary annexation seeking Council approval of the annexation agreement and the Voluntary
Annexation of their property to the City; AND,
WHEREAS, the City Council having considered the preannexation agreement with Brian D. and
Marcie A. Curnes, finds that the same should be approved subject to the completion of the annexation
of the property that is the subject of said agreement.
BE IT THEREFORE RESOLVED that the preannexation agreement submitted for consideration by
the City Council of the City of Waukee and executed by the property owner Brian D. and Marcie A.
Curnes, should be and the same is hereby approved subject to completion of the annexation of the
property that is the subject of said agreement as contemplated therein.
Passed by the City Council of the City of Waukee, Iowa, and approved the 4th day of February 2019.
