AGENDA ITEM: Public Hearing on an ordinance to amend Chapter 301, Zoning Ordinance,
City of Waukee Iowa, by rezoning certain property from A-1 to R-1, a
property known as The Reserve at Daybreak.
FORMAT: Public Hearing
SYNOPSIS INCLUDING PRO & CON: The applicant is requesting approval of a rezoning of 3.14-
acres of property located at the east end of Century Circle within The Reserve at Daybreak Plat 1. The
property was recently annexed into the City of Waukee and was included as a part of Lot 7, The
Reserve at Daybreak Plat 1. Lot 7 of The Reserve at Daybreak Plat 1 is 4.76-acres in area and is
currently split zoned between R-1 and A-1. The proposed rezoning would make the zoning of all of
Lot 7 the same.
Notification of the rezoning was sent to surrounding property owners on April 1, 2019, and the City
received correspondence from one adjoining property owner, which is attached for your review. The
adjacent property owner is concerned that the area being rezoned includes a portion of Sugar Creek
and the desire for the area of Sugar Creek to remain a green space. The area of the rezoning that
includes a portion of Sugar Creek is within the FEMA 100-year flood area and was platted as an outlot
with The Reserve at Daybreak Plat 1. Since this area was platted as an outlot it should remain
relatively undisturbed and could in the future, if feasible, serve as part of the planned greenbelt trail
system.
The proposed rezoning request is generally consistent with both theprevious Comprehensive Plan and
new Waukee 2040 Comprehensive Plan.
FISCAL IMPACT INCLUDING COST/BENEFIT ANALYSIS:
COMMISSION/BOARD/COMMITTEE COMMENT: The Planning and Zoning Commission
reviewed the request at their April 9, 2019 meeting and recommended
approval:
Approval of a Rezoning Related to a Change from A-1 (Agricultural District) to R-1 (Single
Family Residential District) [The Reserve at Daybreak]
City Planner, Melissa DeBoer, introduced the request for a rezoning as submitted by the applicant,
Reserve at Daybreak, LLC. If approved, the subject property containing 3.14 acres, would be rezoned
for single family development as is consistent with the adjacent property. At this time staff has
received one letter opposing the rezoning with the stated concern of keeping Sugar Creek as open
space or conservation land. Mrs. DeBoer advised the commission that the property does contain a
flood plain area correlated with Sugar creek.
At this time staff would recommend approval of the rezoning subject to any remaining staff comments.

Commissioner Streit questioned what the purpose behind the rezoning was. Director of
Development, Brad Deets, advised it was more of a cleanup item, as it was sold off to the
applicant due to the previous owner being unable to develop it.
Commissioner Koshy asked for further staff commentary on the submitted objection. Mr.
Deets advised that the homeowners have approached staff regarding the space to one day tie
the green belt corridor by the creek bed in order to maintain as much natural land as possible.
Commissioner Broderick verified that the concerns would not be invalidated in the event of an
approval. Having homeowners who care for the future of the natural land is important. Mr.
Deets advised that the concerns would be taken seriously by Staff.
Commissioner Streit moved to approve the Rezoning from A-1 (Agricultural District) to R-1 (Single
Family Residential District) [The Reserve at Daybreak] subject to any remaining staff comments. The
motion was seconded by Commissioner Koshy. Ayes: Tietz, Streit, Broderick, and Koshy. Nays:
None. Motion Carries.
STAFF REVIEW AND COMMENT: The proposed rezoning is consistent with the existing land
uses in the area and the newly adopted comprehensive plan, Imagine Waukee
2040. In addition, the proposed rezoning will prevent the property from being
split zoned as it is today. The sensitive environmental areas should remain
protected within the Outlot that has already been established, as no buildings
will be allowed to be constructed within the Outlot.
RECOMMENDATION: Staff would recommend holding the Public Hearing

BACKGROUND
The subject property is located west of Ute Avenue and north of Ashworth Road. The property was recently annexed
into the City of Waukee from Dallas County. The parcel proposed to be rezoned is part of Lot 7 of The Reserve at
Daybreak Plat 1.
The applicant has submitted the necessary petition and consent to the rezoning. Staff has received consent to the zoning
change from 100% of City of Waukee property owners within 200 feet of the property proposed to be rezoned.
Notification of the rezoning request was sent on April 1, 2019. Staff has received no correspondence in support or in
opposition to the proposed rezoning.
PROJECT DESCRIPTION
The proposed rezoning includes a portion of Lot 7 of The Reserve at Daybreak Plat 1. The property to be rezoned is a
total of 3.14 acres. The applicant is proposing to rezone this land from A-1 (Agricultural District) to R-1 (Single Family
Residential District) to allow for the development of single-family residential homes. The R-1 zoning is consistent with
the rest of The Reserve at Daybreak development.
STAFF RECOMMENDATION
The proposed rezoning is in general conformance with the Comprehensive Plan and the original development plan for
The Reserve at Daybreak. Staff recommends approval of the rezoning.

I am not able to attend tonight’s meeting.
The rezoning of the 3.14 acres under cons ideration concerns me becaus e from the map it appears to include part of
Sugar Creek. I was under the impres s ion that the long-rang e plan for the s ugar creek corridor maintains it as a g reen
s pace. There is very little left of Iowa’s natural s paces . The Sugar C reek corridor has very interes ting g eological terrain,
oak s avannah, and is an important wild life refug e.
We are currently working with Iowa Natural Heritag e to s et up cons ervation eas ements along the creek on our
property.
I hope the long range plan takes that into account and we can develop a cohes ive plan for a green belt along Sug ar
Creek .
