(A) Call to Order – The regular meeting of the Waukee City Council was called to order by Mayor
Peard at 5:30 p.m. in the Council Chambers at Waukee City Hall, 230 W. Hickman Rd.
(B) Pledge of Allegiance
(C) Roll Call – The following members were present: Mayor William F. Peard; Council Members
Anna Bergman, R. Charles Bottenberg, Courtney Clarke, Shelly Hughes, Larry R. Lyon. Absent:
None.
Also in attendance: City Administrator Tim Moerman, Finance Director Linda Burkhart, Public
Works Director/City Engineer Rudy Koester, Senior Planner Andy Kass, Human Resource
Director Michelle Lindsay, Community and Economic Development Director Dan Dutcher,
Marketing and Communications Director Summer Evans, Parks and Recreation Director Matt
Jermier, Police Chief John Quinn, City Clerk Rebecca D. Schuett, City Attorney Steve Brick.
(D) Open Forum – 1) Matt Chapman, 1002 Collins Dr., updated the council on activity on behalf of
Midwest Country Estates residents, including the decision to establish a neighborhood
organization. 2) Lisa Bean, 29762 310th St., noted that she owns a portion of Sugar Creek
corridor and is working with the Iowa Natural Heritage Foundation to create a conservation
corridor. She requested that the council share that corridor vision and pay attention to property
development in the area. 3) Laurie Keller, 605 Meredith Dr., addressed Agenda Item #J12 and
asked that her property be readdressed as 605 NW Meredith Dr. instead of 205 NW Meredith
Dr., citing its closer proximity to 6th St. and concerns with public safety being able to locate the
property in an emergency. 4) Sheri Harberts, a resident of Midwest Country Estates, thanked
the mayor for sending a letter to park owners Havenpark. She asked about the City’s 5-year
vision for the park and wondered if rent stabilization legislation was allowed in the State of Iowa.
City Administrator Moerman replied that there were no City plans for the park as long as it
remains properly zoned as a mobile home residential district and continues operating as such.
Ms. Harberts asked if the City would enforce the park improvements that Haverpark promised to
make; Mr. Moerman replied that the City could only enforce city ordinances.
(E) Agenda Approval – Council Member Lyon moved to approve the agenda; seconded by Council
Member Clarke. Results of vote: Ayes: Bergman, Bottenberg, Clarke, Hughes, Lyon. Nays:
None. Motion carried 5 – 0.
(F) Mayor’s Report – Mayor Peard and council members will take part in strategic planning
sessions on 04/18 and 04/19. The Easter Egg Hunt is 04/20; Spring Clean-up is the week of
04/29. Former Secretary of Agriculture Tom Vilsack will be keynote speaker at the 04/23
Waukee Leadership Institute graduation.
(G) Presentations: None
(H) Public Hearings:
1) On an ordinance to amend Chapter 301, Zoning Ordinance, City of Waukee, Iowa, by
rezoning and changing certain property therein from A-1 to R-1, a property known as
The Reserve at Daybreak, 675 Century Circle Property – Mayor Peard opened the public
hearing and asked if any written correspondence had been received; City Clerk Schuett
replied in the negative. Senior Planner Kass reviewed the zoning application for a portion of
Lot 7 in The Reserve at Daybreak Plat 1. The outlot is undevelopable as it is in the FEMA
flood plain. The rezoning application is to make the lot consistently zoned as a whole.
Council Member Hughes asked if there was currently a building on the lot; Mr. Kass replied
in the negative. Council Member Clarke asked for clarification on why the outlot was being
rezoned if it would be undevelopable whether it was A-1 or R-1; Mr. Kass reiterated that the
rezoning would make the zoning consistent. Council Member Clarke asked if it was clear to
the concerned resident (Lisa Bean) that the outlot was undevelopable; Mr. Kass voiced his
belief that the resident wanted the council to be aware of her corridor preservation activities.

Mr. Kass added that it was good practice on the City’s part to keep structures out of a flood
plain. Mayor Peard asked if anyone in attendance wished to speak on the matter: 1) Lisa
Bean, 29762 310th St., noted her confusion over the rezoning, asking if the area in question
could be used for a recreational trail. She added her concern that continued construction in
the area may increase environmental stresses. City Administrator Moerman noted that only
the first reading of the ordinance would be considered by council at this meeting, stating that
Development Services Director Brad Deets would have the opportunity to visit with Ms. Bean
regarding her concerns prior to the second reading. He also stated that green corridors
could be discussed by council during their goal setting sessions later in the week.
(I) Public Hearing Action Items:
1) Ordinance: Consideration of approval of an ordinance to amend Chapter 301, Zoning

Property [introduction; first reading] – Council Member Lyon introduced the ordinance
and moved to approve the first reading in title only; seconded by Council Member Hughes.
Senior Planner Kass reiterated that the City is interested in preserving greenways, noting
that the Sugar Creek area is environmentally unique and that it could be used for
recreational purposes. City Attorney Brick asked if the outlot was the only undevelopable
portion; Mr. Kass replied in the affirmative. Results of vote: Ayes: Bergman, Bottenberg,
Hughes, Lyon. Nays: Clarke. Motion carried 4 – 1.
(J) Action Items:
1) Consent Agenda: Council Member Clarke moved to approve the Consent Agenda;
seconded by Council Member Bottenberg. Results of vote: Ayes: Bergman, Bottenberg,
Clarke, Hughes, Lyon. Nays: None. Motion carried 5 – 0.

whether to install horizontal or vertical entrance signage at the University Avenue location;

Council Member Clarke moved to approve the resolution; seconded by Council Member
Lyon. Community and Economic Development Director Dutcher reviewed the purchase
offer, noting that the property was planned as the location of the future second public safety
building. As part of the agreement, the current property owner would be allowed to farm the
parcel over the next five years. Council Member Bergman stated that she would abstain due
to a professional conflict of interest. Results of vote: Ayes: Bottenberg, Clarke, Hughes,
Lyon. Nays: None. Abstentions: Bergman. Motion carried 4 – 0 – 1. (Resolution #19-147)
12) Resolution: Consideration of approval of a resolution approving the amendment of
certain addresses within the City of Waukee – Council Member Lyon moved to approve
the resolution; seconded by Council Member Clarke. Senior Planner Kass noted that there
are certain parcels in the city that are inconsistently or incorrectly addressed. Most impacted
property owners will not have to request an address change through the post office, but City
staff will work with those property owners that do have to follow the more formal post office
procedures. Mr. Kass noted some correspondence and phone calls received from
concerned property owners. Regarding the request made by Laurie Keller during Open
Forum, Mr. Kass stated that the 205 address would be consistent with the City grid system,
while the 605 address was not. Council Member Clarke asked if any other Meredith Dr.

homes would be impacted; Ms. Keller, 605 Meredith Dr., stated that hers was the only house
on Meredith Dr. in Waukee. Council Member Lyon asked if the Keller home could be
readdressed at a later date when development occurs in the area; Mr. Kass noted that it was
a council decision, but that staff recommended the change especially as it relates to
emergency services response. Council Member Bergman thanked Ms. Keller for expressing
her concerns, but stated that the council needed to keep public safety in mind. Ms. Keller
asked if the street signage would be changed to read NW Meredith Dr.; Mr. Kass replied in
the affirmative. Results of vote: Ayes: Bergman, Bottenberg, Clarke, Hughes, Lyon. Nays:
None. Motion carried 5 – 0. (Resolution #19-148)

Work Session: Goal setting and strategic planning for FY2020, first session – Mr. Sumek lead the
council through a review of status of the current fiscal year strategic plan and goals and began discussions
on possible goals for FY2020.
