MEETING DATE: June 3, 2019
AGENDA ITEM: On an ordinance to amend Chapter 301, Zoning Ordinance, City of
Waukee, Iowa by rezoning and changing certain property therein from
A-1 (Agricultural District) to R-2 (One & Two Family Residential
District), a parcel to be known as Alyvia Plat 1.
FORMAT: Public Hearing
SYNOPSIS INCLUDING PRO & CON: The applicants, John & Brenda Currier, request
approval for a rezoning of approximately 10-acres of property located
north of NE Badger Lane and east of N. Warrior Lane. The specific
request is to rezone the property from A-1, Agricultural District to R-2,
One & Two Family Residential District in order to allow for the
development of a single family residential subdivision.
The subject property is currently in use as an acreage with one dwelling
unit located on it. The existing home on the property is intended to
remain while the rest of the structures are to be demolished. The concept
plan identifies a total of 12 single family lots. All lots comply with the
minimum requirements of the R-2 zoning district. The lots range in size
from 11,841 square feet to 60,629 square feet. All lots will be accessed
from an extension of NE Bobcat Drive with the exception of Lot 1,
which will utilize the existing access from N. Warrior Lane. Lot 1 will be
where the existing home is located. Outlot X on the concept plan is the
Little Walnut Creek corridor. Staff is working with the developer to
acquire this property for parkland dedication.
The Imagine Waukee 2040: Comprehensive Plan identifies the subject
property as Single Family Residential, which is defined as traditional forms
of single family housing with lot sizes ranging from 8,000 square feet to 0.50-
acres in area with an average density of 2 to 4 units per acre. With the
exception of one proposed lot (Lot 1) in this development all proposed lots
are no more than 0.50-acres in area and the proposed density of the plat is
1.32 units per acre.
COMMISSION/BOARD/COMMITTEE COMMENT: The Planning and Zoning
Commission reviewed the request at their May 28, 2019, meeting and
recommended approval.
Approval of a Rezoning related to a change from A-1 (Agricultural District) to R-2 (Single
Family Residential District) [Alyvia Plat 1]

Senior Planner, Andy Kass introduced the request for approval of a rezoning as submitted by the
applicant, John and Brenda Currier, for a single family residential development. The subject
property is located north of NE Badger Lane and east of N Warrior Lane, containing
approximately 10 acres.
Mr. Kass explained that the property is currently used as an acreage with one single family home
located on it. Mr. Kass explained that the concept plan identifies 12 lots for single family
residential development and that the existing home would remain, but all other structures would
be demolished with plat improvements. Mr. Kass explained that the applicant has submitted the
necessary consent to the rezoning from surrounding property owners. The applicant noted that
they had also contacted the Clive neighbors. Mr. Kass stated that neighborhood notices were sent
out on May 20, 2019.
Mr. Kass explained that there would be three outlots that would be tied to the neighboring lots to
be owned and maintained, but that these outlots are within the floodplain. Outlot X would be
dedicated to the City of Waukee for parkland. Mr. Kass explained that the parkland would be
used for a greenbelt trail system that would eventually tie into Clive’s trail system. Mr. Kass
explained that the proposal is in conformance with both the requirements of the R-2 zoning
district and the comprehensive plan.
Commissioner Streit questioned if the existing home would still have access off of N Warrior
Lane. Mr. Kass explained that it would.
Commissioner Hoifeldt questioned if it was ever intended that NE Bobcat Drive would go all the
way to Warrior Lane. Mr. Kass explained that it was not intended to connect out to Warrior Lane.
Commissioner Streit questioned what type of zoning is in Clive, located to the north. Brad Deets,
Development Services Director, explained that the area to the north in Clive is large lot, single
family residential.
Commissioner Streit questioned if it would be possible for another lot to get access off of Warrior
Lane. Mr. Kass explained that would not be possible and that only Lot 1 would have access off of
Warrior Lane. Mr. Kass also explained that generally individual lot access would not be allowed
off of a major collector.
Commissioner Tietz questioned where the sewer and water comes from. Mr. Kass explained that
both of these would come from the east.
There was brief discussion on the future of paving Warrior Lane. Mr. Deets explained that the
future paving of Warrior Lane would be a City project.
Commissioner Streit moved to approve the rezoning for Alyvia Plat 1. The motion was seconded
by Commissioner Koshy. Ayes: Tietz, Streit, Broderick, Hoifeldt, and Koshy. Nays: None.
Motion Carries.
STAFF REVIEW AND COMMENT: The proposed rezoning is consistent with the Imagine
Waukee 2040: Comprehensive Plan. Staff recommends approval of the
request based on it conformance with the Comprehensive Plan.
RECOMMENDATION: Introduce the Ordinance and approve the first consideration.

BACKGROUND
The subject property is located north of NE Badger Lane and east of N. Warrior Lane encompassing a total of 10 acres.
The applicant has submitted a rezoning request to rezoning the property from A-1 (Agricultural District) to R-2 (One &
Two Family Residential District). The property is currently in use as an acreage with one single family home located on
it. The applicant has submitted the necessary consent to the rezoning with consent from 72% from neighboring property
owners for the area proposed to be rezoned. The rezoning sign was placed on the property on May 20, 2019.
Notification to adjacent property owners was mailed on May 20, 2019. To date, staff has not received any
correspondence either for or against the proposed rezoning.
PROJECT DESCRIPTION
The concept plan identifies a total of 12 lots for single family residential development. The lots range in size from 11,841
square feet to 60,629 square feet. The existing single family home on proposed Lot 1 will remain on the property. All
other existing buildings are intended to be demolished as part of the plat improvements. Three outlots are proposed on
the rear of three lots as these portions are located within the mapped floodplain of Little Walnut Creek. The outlots
will be required to be owned by the respective owners of each lot. The bulk regulations for the R-2 zoning district are
summarized below.

All streets within the development will be built to City of Waukee standards. NE Bobcat Drive will be extended from
the east to the west and will end in a cul-de-sac. No trails are included as part of this street extension. Five-foot-wide
sidewalks will be constructed as each lot is developed.

PARKLAND
Based on the number of lots a total of 0.234 acres of parkland is required to be dedicated. It is expected that Outlot X
on the north side of the plat will be dedicated to the City for parkland. Outlot X is located within the floodplain of Little
Walnut Creek. The intent in the future is to extend a greenbelt trail through the area.
COMPREHENSIVE PLAN
The Imagine Waukee 2040: Comprehensive Plan identifies the subject property as Single Family Residential which is defined

STAFF RECOMMENDATION
The proposed rezoning is in general conformance with the Comprehensive Plan as discussed above. The proposed
rezoning is also consistent with surround zoning and future land uses identified in the area.
