AGENDA ITEM: Consideration of approval of a motion setting July 1, 2019, as the date of
public hearing on an ordinance to amend Chapter 301, Zoning
Ordinance, City of Waukee, Iowa, by rezoning and changing certain
property therein from A-1 (Agricultural District) to R-4 (Row Dwelling
and Townhome Dwelling District) and PD-1 (Planned Development
Overlay) [LA Grant & University Townhomes]
FORMAT: Consent
SYNOPSIS INCLUDING PRO & CON: Philip E. Broderick, owner, and Hubbell Realty
Company, developer, have requested rezoning of approximately 18.41
acres of property from A-1 Agricultural District to R-4 Row Dwelling
and Townhome Dwelling District/ PD-1 Planned Development Overlay.
The property is located at the southwest corner of the intersection of SE
University Avenue and SE LA Grant Parkway.
In order to set a public hearing to discuss a rezoning, the applicant is
required to receive written consent from 50% of the surrounding property
within a 200 foot radius of the property. Alternatively, the City Council
can set a public hearing date on behalf of the applicant. The applicant
has indicated that they have been unsuccessful in receiving the 50%
consent from surrounding property owners.
FISCAL IMPACT INCLUDING COST/BENEFIT ANALYSIS:
COMMISSION/BOARD/COMMITTEE COMMENT:
STAFF REVIEW AND COMMENT: Staff would recommend approval of the City Council
setting the public hearing date for June 3, 2019 to discuss this matter
further. Council action to set the public hearing date does not indicate
support for the project. Rather, it represents the Council’s willingness to
allow the public hearing process to continue.
RECOMMENDATION: Approve the motion.
