HomeMy WebLinkAbout2019-07-15-H01 El Dorado Hills Plat 1 Rezoning_PH AGENDA ITEM: CITY OF WAUKEE, IOWA CITY COUNCIL MEETING COMMUNICATION MEETING DATE: July 15, 2019 AGENDA ITEM: Public Hearing on an ordinance to amend Chapter 301, Zoning Ordinance, City of Waukee Iowa, by rezoning certain property from A-1 to R-1, a property known as El Dorado Hills Plat 1. FORMAT: Public Hearing SYNOPSIS INCLUDING PRO & CON: The applicant is requesting approval of a rezoning of 12.88-acres of property located east of Ute Avenue and north of Ashworth Road. The property was recently annexed into the city of Waukee, from Dallas County. The request is to rezone the property from A-1 (Agricultural District) to R-1 (Single Family Residential District). The concept plan shows a total of 9 single-family lots, with the existing house to remain on one of the proposed lots. Notification of the rezoning was sent to surrounding property owners on June 27, 2019, and the City has not received any correspondence for or against the proposed rezoning. The proposed rezoning request is generally consistent with both the Imagine Waukee 2040: Comprehensive Plan. FISCAL IMPACT INCLUDING COST/BENEFIT ANALYSIS: COMMISSION/BOARD/COMMITTEE COMMENT: The Planning and Zoning Commission reviewed the request at their July 9, 2019 meeting and recommended approval: Approval of a Rezoning Related to a Change from A-1 (Agricultural District) to R-1 (Single Family Residential District) [El Dorado Hills Plat 1] City Planner Melissa DeBoer introduced the request for approval of a rezoning for a single family residential development as submitted by the applicant, Eldorado Hills, LLC. the subject property is located north of Ashworth Road and East of Ute Avenue/R-22, containing approximately 12.88 acres. The subject property is currently undergoing annexation into the city limits. The applicant has submitted the necessary consent to the rezoning and notification to adjacent property owners was mailed on June 27th, 2019. To date, staff has not received any correspondence for or against the proposed rezoning. Mrs. DeBoer advised that the concept plan indicates 9 single family lots ranging in size from 20,945 square feet to 94,760 square feet. The existing single family home on proposed lot 6 will remain on the property. the concept plan also identifies two proposed outlots on the rear of two corresponding lots as the areas are located within the mapped flood plain of Sugar Creek. One street will be constructed as part of this development. City Staff is currently working with the applicant on parkland dedication as the City’s future plans consisted of a greenbelt trail and open space surrounding the creek. H1 The proposed rezoning is in general conformance with the comprehensive plan and surrounding areas. Staff would recommend approval at this time.  Commissioner Broderick questioned what the parkland would look like. Mrs. DeBoer advised that the City’s ideal dedication would be the areas near the creek for a future trail extension.  Commissioner Tietz questioned what the speed limit is on Ute Avenue/R-22 and if it would be lowered in the future. Andy Kass, the Senior City Planner, advised that it’s possible that it will be lowered in the future, there’s more than one jurisdiction to work into that agreement as part of the bordering property is within Dallas County. All developments approved in recent years have built deceleration lanes.  Commissioner Hoifeldt questioned if any City Services would be extended through the creek bed to reach the development. Mr. Kass advised that there is already a sewer line to extend off of and a new lift station would not be needed as it flows to the south in order to connect to the WRA main recently completed.  Jarred Murray a representative for the applicant advised that the developer had not received any correspondence for or against the development at this time. Commissioner Koshy moved to approve the rezoning related to a change from A-1 (Agricultural District) to R-1 (Single Family Residential District) [El Dorado Hills Plat 1] subject to any staff comments. The motion was seconded by commissioner Hoifeldt. Ayes: Tietz, Broderick, Hoifeldt, and Koshy. Nays: None. Motion Carries. STAFF REVIEW AND COMMENT: The proposed rezoning is consistent with the existing land uses in the area and the newly adopted comprehensive plan, Imagine Waukee 2040. The applicant has submitted a rezoning request to rezone the property from A-1 (Agricultural District) to R-1 (Single Family Residential District). The property is currently in use as an acreage with one single-family home located on it. The property is currently in the process of being annexed into Waukee, from Dallas County. The applicant has submitted the necessary consent to the rezoning with consent from 69% from neighboring property owners for the area proposed to be rezoned. The rezoning sign was placed on the property on June 20, 2019. Notification to adjacent property owners was mailed on June 27, 2019. To date, staff has not received any correspondence either for or against the proposed rezoning. PROJECT DESCRIPTION The concept plan identifies a total of 9 lots for single-family residential development. The lots range in size from 20,945 square feet to 94,760 square feet. The existing single-family home on proposed Lot 6 will remain on the property. The detached garage is intended to be demolished as part of the plat improvements. Two outlots are proposed on the rear of two lots as these portions are located within the mapped floodplain of Sugar Creek. One street will be constructed as part of this development. The bulk regulations for the R-1 zoning district are summarized below. Table 1: Standard R-1 requirements. COMPREHENSIVE PLAN The Imagine Waukee 2040: Comprehensive Plan identifies the subject property as Open Space. A large portion of this plat, specifically the areas adjacent to the creek, will be dedicated to open space and the rest of the plat will be large lot, single- family residential. STAFF RECOMMENDATION The proposed rezoning is in general conformance with the Comprehensive Plan. The proposed rezoning is also consistent with surround zoning and future land uses identified in the area.
