AGENDA ITEM:Consideration of approval of a resolution approving Professional Services
Amendment #2 with Shive-Hattery, Inc. for the Westown Meadows Park
Project in the amount of $6,800.00.
FORMAT:Consent
SYNOPSIS INCLUDING PRO & CON: The Request for Additional Services is due to additional
construction administration services needed to complete the project. This
amendment will cover the following:
1. Provide Construction Phase Services in the amount of $6,800.00
a.The effort estimated to provide construction phase services
through completion of the project is $22,300.
b.A reduction in the amount of $1,500 is reflected for electrical
coordination that occurred during the construction phase but
should have been provided during the design phase.
c.Fee Summary:
i.Original Construction Phase Services Fee: $14,000
ii.Additional Construction Phase Services Fee: $8,300
iii.Reduction due to electrical coordination: -$1,500
iv.Total Increase of Construction Phase Services: $6,800
Playground installation should be completed by August 15th with rubberized
surface installation beginning August 15th. Seeding and landscaping should
begin September 1st.

RESOLUTION 19-
APPROVING PROFESSIONAL SERVICES AGREEMENT AMENDMENT NO. 2 WITH
SHIVE-HATTERY, INC. [WESTOWN MEADOWS PARK IMPROVEMENT PROJECT]
IN THE NAME AND BY THE AUTHORITY OF THE CITY OF WAUKEE, IOWA
WHEREAS, the City of Waukee, Dallas County, State of Iowa, is a duly organized Municipal
Organization; AND,
WHEREAS, on October 15, 2018, the Waukee City Council approved an Agreement for Professional
Consulting Services with Shive-Hattery, Inc. [Westown Meadows Park Implementation] (Resolution
#18-442); AND,
WHEREAS, on April 1, 2019, the Waukee City Council approved a Professional Services Agreement
Amendment No. 1 (Resolution #19-107); AND,
WHEREAS, Shive-Hattery, Inc., has submitted Amendment No. 2 to the agreement for additional
construction administration services needed to complete the project.
NOW THEREFORE BE IT RESOLVED by the City Council of the City of Waukee that the
Professional Services Agreement Amendment No. 2 with Shive-Hattery, Inc. [Westown Meadows
Park Improvement Project], attached hereto as Exhibit A, is hereby approved.
Passed by the City Council of the City of Waukee, Iowa, and approved the 5th day of August, 2019.

ORIGINAL AGREEMENT DATE: October 15, 2018
AMENDMENT DATE: June 28, 2019
City of Waukee, IA and Shive-Hattery, Inc. (S-H) agree to amend the Original Agreement as follows:
SCOPE OF SERVICES:
Shive-Hattery, Inc. (S-H) will provide the following additional services:
1. Provide Construction Phase Ser vices in the amount of $6,800:

$22,300.

the construction phase but should have been provided during the design phase.

SCHEDULE
We will start our services upon receipt of this executed Agreement.
COMPENSATION:
We will provide the Scope of Services for fixed fee of sixty-eight hundred dollars ($6,800.00)
It should be noted that during the process, unexpected items or events occur that sometime s result in
the need for additional services that cannot be identified in the proposal stage. Should additional
services be required beyond the Scope of Services listed in this proposal, we will submit an other
amendment to our contract for your approval and signature prior to our proceeding with the additional
services.
The terms of this proposal are valid for 30 days from the date of this proposal.
TERMS AND CONDITIONS
No changes from the terms and conditions agreed-upon in the agreement dated October 15, 2018.
AGREEMENT
When accepted by both parties, this Amendment will amend the Original Agreement and is subject to all
other terms and conditions of the Original Agreement. Original, facsimile, electronic signatures or other

electronic acceptance by the parties (and returned to Shive-Hattery) are deemed acceptable for binding
the parties to the Amendment. The Client representative signing this Amendment warrants that he or
she is authorized to enter into this Amendment on behalf of the Client.
