AGENDA ITEM: Consideration of approval of a resolution approving Amendment No. 2 to
Agreement for Professional Consulting Services with Shive Hattery [Waukee
City Hall Renovation Project]
FORMAT: Resolution
SYNOPSIS INCLUDING PRO & CON: The City Council approved the original Professional
Consulting Services Agreement with Shive Hattery in September 2018 for the
improvements currently being made at City Hall as well as Amendment No. 1
which included services related to site lighting. The proposed Amendment
No. 2 relates to the additional landscape work that will be done in front of
City Hall, the cost of the building signage which was billed to Shive Hattery
instead of the City and additional construction administration related to the
overall project.
FISCAL IMPACT INCLUDING COST/BENEFIT ANALYSIS: $33,740.00

APPROVING AMENDMENT NO. 2 TO AGREEMENT FOR PROFESSIONAL
CONSULTING SERVICES WITH SHIVE HATTERY [WAUKEE CITY HALL
EXTERIOR IMPROVEMENT PROJECT]
IN THE NAME AND BY THE AUTHORITY OF THE CITY OF WAUKEE, IOWA
WHEREAS, the City of Waukee, Dallas County, State of Iowa, is a duly organized Municipal
Organization; AND,
WHEREAS, the City retained the services of Shive Hattery, related to the design development
and construction and bid administration for the Waukee City Hall Exterior Improvement Project;
AND,
WHEREAS, Amendment No. 2 relates to additional services for site landscaping, building
signage and construction administration;
NOW THEREFORE BE IT RESOLVED by the City Council of the City of Waukee that the
Amendment No. 2 to Agreement for Professional Consulting Services with Shive Hattery
[Waukee City Hall Exterior Improvement Project] is hereby approved.
Passed by the City Council of the City of Waukee, Iowa, and approved the 5th day of August
2019.

AMENDED SCOPE OF SERVICES
We will provide the following additional services for the project:
1. Extended construction phase services for City Hall renovations
2. Landscape architecture concepts and refinements
3. Construction phase services for Fall 2019 landscape improvements
4. Construction staking services for verification
CLIENT RESPONSIBILITIES
No changes.
SCHEDULE
The Schedule is revised as follows:
We will begin our services upon receipt of this Agreement executed by you which will serve as a notice
to proceed.

The terms of this proposal are valid for 30 days from the date of this proposal.

AGREEMENT
When accepted by both parties, this Amendment will amend the Original Agreement and is subject to all
other terms and conditions of the Original Agreement. Original, facsimile, electronic signatures or other
electronic acceptance by the parties (and returned to Shive-Hattery) are deemed acceptable for binding
the parties to the Amendment. The Client representative signing this Amendment warrants that he or
she is authorized to enter into this Amendment on behalf of the Client.
