SYNOPSIS INCLUDING PRO & CON: On May 20, 2019, the City of Waukee City Council
approved a 28E Agreement with the City of West Des Moines related to the
Ashworth Road Reconstruction – I-80 Bridge to 98th Street Project. Pursuant
to the 28E Agreement, the City of West Des Moines is obligated to convey the
right-of-way obtained for the project that lies within the Waukee corporate
limits to the City of Waukee.

RECOMMENDATION: Approve the resolution for the conveyance of property interest with the

RESOLUTION 19-
APPROVING ACCEPTANCE OF PROPERTY INTERESTS [ASHWORTH ROAD
RECONSTRUCTION PROJECT, I-80 BRIDGE TO 98TH STREET/WACO PLACE]
IN THE NAME AND BY THE AUTHORITY OF THE CITY OF WAUKEE, IOWA
WHEREAS, the City of Waukee, Iowa is a duly organized municipality within Dallas County;
AND,
WHEREAS, on May 20, 2019, the Waukee City Council approved a 28E agreement with the
City of West Des Moines related to the Ashworth Road Reconstruction Project, Phase 3, from I-
80 to 98th Street/Waco Place (Resolution #19-195); AND,
WHEREAS, pursuant to the 28E agreement, the West Des Moines City Council has approved
the conveyance of certain property interests to the City of Waukee for property located within
Waukee corporate limits; AND,
WHEREAS, the following described property has been conveyed to the City of Waukee by the
City of West Des Moines:
That part of Parcel A in Section 10, Township 78 North, Range 26 in the City of Waukee
as shown in Book 2018, Page 21452;
That part of Parcel B in Section 10, Township 78 North, Range 26 in the City of Waukee
as shown in Book 2019, Page 2021;
That part of the NE¼ of the NW¼ in Section 10, Township 78 North, Range 26 in the
City of Waukee as shown in Book 2019, Page 2185;
The Permanent Storm Sewer Easement located in a portion of the NE¼ of the NW¼ in
Section 10, Township 78 North, Range 26 in the City of Waukee as shown in Book 2019,
Page 2186;
The Permanent Storm Sewer Easement located in a portion of the NW¼ of the NW¼ in
Section 10, Township 78 North, Range 26 in the City of Waukee as shown in Book 2019,
Page 1246, and
That part of the NE¼ of the NW¼ in Section 10, Township 78 North, Range 26 in the
City of Waukee as shown in Book 2019, Page 2917; and
The Permanent Storm Sewer Easement located in a portion of the NE¼ of the NW¼ in
Section 10, Township 78 North, Range 26 in the City of Waukee as shown in Book 2019,
Page 2918; and
all as shown in the records of the Office of the Dallas County, Iowa Recorder.
NOW THEREFORE BE IT RESOLVED by the City of Waukee City Council in session this
3rd day of September, 2019, that the property as described above, conveyed to the City of
Waukee by the City of West Des Moines as related to the Ashworth Road Reconstruction
Project, I-80 Bridge to 98th Street/Waco Place, is hereby accepted.
BE IT FURTHER RESOLVED that the Mayor is authorized to sign any and all documents
related to the property acceptance and that such documents shall be recorded with the Dallas
County Recorder as appropriate.
