HomeMy WebLinkAbout2019-10-07-I02 Kinship Brewing Company Rezoning - PH AGENDA ITEM: CITY OF WAUKEE, IOWA CITY COUNCIL MEETING COMMUNICATION MEETING DATE: October 7, 2019 AGENDA ITEM: Public Hearing on an ordinance to amend Chapter 301, Zoning Ordinance, City of Waukee, Iowa, by rezoning certain property from M- 1 to M-1/PD-1, a property to be known as Kinship Brewing Company FORMAT: Public Hearing SYNOPSIS INCLUDING PRO & CON: The applicant is requesting approval of a rezoning to create a Planned Development Overlay District on approximately 6.25 acres of property that is located within the Stratford Crossing Plat 4 development and is generally located west of NW 10th Street and north of W Hickman Road. As a part of the recent Zoning Ordinance overhaul, the principal use of the proposed project as a brewery was incorporated as an allowable use within the M-1 Zoning Ordinance. However, because of the unique use the owner desires for the property as well as the accessory uses to the property, staff recommended a Planned Development Overlay be prepared. The Planned Development Overlay addresses the overall uses of the project as well as specific site related elements including parking, open space building requirements and signage. As identified within the Planned Development, the building requirements are more stringent than what the minimum requirements are within the M-1 Zoning District. The applicant has proposed a series of signage elements unique to the site including an art wall adjacent to the building which would periodically be changed. FISCAL IMPACT INCLUDING COST/BENEFIT ANALYSIS: COMMISSION/BOARD/COMMITTEE COMMENT: The Planning and Zoning Commission reviewed the proposed Ordinance at their meeting held on October 1, 2019 and recommended approval: Approval of a Rezoning related to a change from M-1 (Light Industrial District) to M-1 ( Light Industrial District) / PD-1 ( Planned Development Overlay [Kinship Brewing] Director of Development, Brad Deets, introduced the request for a rezoning for development of a brewery production facility and taproom as submitted by the applicant, Zach Dobeck. The subject property is generally located west of NW 10th street and north of Hickman road, containing approximately 6.24 acres. The applicant has submitted the necessary consent to the rezoning, and notification to adjacent property owners was mailed on September 17th, 2019. To date, staff has not received any correspondence for or against the proposed rezoning. Mr. Deets advised that the concept plan identifies a brewery, outdoor plaza, loading dock, associated parking, trail connections to Raccoon River Valley Trail, and a dog park to be developed on the site. Currently, the main use of production proposed for the project is an allotted I2 use in the M-1 district, however, the applicant has suggested the addition of a planned development to address additional unique and accessory uses that would not otherwise be allowed. In addition to the specified uses, the Planned Development has provisions and requirements to ensure a high quality development. At this time staff would recommend approval of the rezoning for Kinship Brewing subject to any remaining staff comments and review of the legal documents.  Commissioner Hoifeldt questioned if the live music would be an issue for the residential districts surrounding the area. Zach Dobeck, the applicant, and his representative, Matt Carlile, advised that the most recent lay out of the project would point the stage back towards the principal building, directing the sound away from the residential districts. Most of the live music would be acoustic in nature, however they did not want to commit to saying that amplified sound wouldn’t be allowed. Mr. Dobeck and Mr. Carlile did advise that for amplified occurrences, they were aware and willing to go through the appropriate channels for noise permits and following City ordinance requirements.  Commissioner Tietz questioned where the food trucks would be located. Mr. Carlile advised that there was a specified pad located just outside the entrance of the facility for a “daily truck”, with parking spaces available for two more in the front parking spaces. The intent being the trucks would serve on to the walkway to avoid pedestrians crossing the parking area.  Commissioner Broderick questioned how the parking lot would drain. Mr. Carlile advised that the parking lots would drain into the center green area which would then disperse the water to the wet bottom detention ponds indicated to the west of the property.  Commissioner Hoifeldt questioned about the area titled as future expansion and what that might add to the area. Mr. Dobeck advised that the idea was to give the taproom a year to see how it functions. If it is doing well, he hopes to add on to create a “village” feel with retail options in the area such as bicycle repair shops and restaurants. Commissioner Hoifeldt moved to approve the rezoning related to a change from M-1 (Light Industrial District) to M-1 (Light Industrial District) / PD-1 (Planned Development Overlay [Kinship Brewing], subject to any staff comments and review of the legal documents. The property owner is currently installing the public infrastructure for the development. The applicant has submitted a rezoning request to rezoning the property from M-1 (Light Industrial District) to M-1 (Light Industrial District) / PD-1 (Planned Development Overlay District). The applicant has submitted the necessary consent to the rezoning with consent from 55.7% from neighboring property owners for the area proposed to be rezoned. Notification to adjacent property owners was mailed on September 17, 2019. To date, staff has not received any correspondence either for or against the proposed rezoning. PROJECT DESCRIPTION The concept plan identifies a brewery, outdoor plaza, loading dock, associated parking, a trail connecting to the adjacent Raccoon River Valley Trail, and a dog park to be developed on the site. The applicant has indicated that they aspire to create a sense of place that is established by the arrangement of buildings, pedestrian/bicycle connections, parking areas, the proximity to the Raccoon River Valley Trail, and open space improvements. In order to accomplish the applicant’s vision they wish to provide some unique principal and accessory uses on the property that would otherwise not be allowed within the M-1 zoning district. The attached Planned Development includes those additional uses that would be allowed on the property if the Planned Development were to be approved. Those uses include the following:  Bicycle repair and sales,  Breweries and distilleries, including on-site sales and service,  Dog parks,  Drinking establishments,  Food trucks including overnight parking and storage,  Outdoor performances, and  Restaurants September 20, 2019 3 of 3 In addition to the uses listed above the Planned Development has provisions and requirements for signage, architecture, landscaping, and parking. The intent of including these components within the Planned Development is to ensure a high quality development while allowing flexibility in the development of the property. COMPREHENSIVE PLAN The Comprehensive Plan identifies the subject property as Light Industrial Office which includes a variety of showroom, flex space, and manufacturing space. The primary focus of this land use category is the assembly, storage, or distribution of goods or products with some office space. Staff believes that the proposed use of this site is in conformance with the Comprehensive Plan as the primary use of the site is intended to produce beer on-site. The other proposed uses on site will provide a unique opportunity for development and recreation/entertainment not available anywhere else in the City. STAFF RECOMMENDATION The proposed rezoning is in general conformance with the Comprehensive Plan as discussed above.
