SYNOPSIS INCLUDING PRO & CON: The project bid letting was held at Waukee City Hall
on Wednesday, October 16, 2019, at 2:00 p.m. Six (6) apparent bids
were received, with the low bid submitted by Busy Bee Construction of
Lewistown, MO, in the amount of $695,617.68 ($617,465.57 base bid
and $78,152.11 alternate bid).
FISCAL IMPACT INCLUDING COST/BENEFIT ANALYSIS:$695,617.68
COMMISSION/BOARD/COMMITTEE COMMENT:
STAFF REVIEW AND COMMENT: City staff recommends awarding contract to Busy Bee
Construction of Lewistown, MO, in the amount of $695,617.68.
RECOMMENDATION: Approve the resolution

RESOLUTION 19-
RESOLUTION MAKING AWARD OF CONSTRUCTION
CONTRACT FOR THE TRANSITE WATER MAIN
REPLACEMENT - PHASE 1
WHEREAS, Council has been alerted to two irregularities with the bid proposal of the
lowest apparent bid; and
WHEREAS, the lowest apparent bidder timely submitted informal acknowledgments of
both addendums 1 and 2 to the City and has explained the bid irregularity related to its late
transmittal of the formal acknowledgments of the addendums was the result of an inadvertent
administrative error, and;
WHEREAS, the lowest apparent bidder submitted a bidder status form with its bid proposal
which did not specify the type of preference given or required by the state in which the nonresident
bidder is a resident; and
WHEREAS, the lowest apparent bidder has requested that the City waive the bid
irregularities; and
WHEREAS, waiver of the bid irregularities does not give an economic advantage to any
bidder and is in the best interest of the taxpayers.
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF WAUKEE, STATE
OF IOWA:
Section 1.That the following bid for the construction of certain public improvements
described in general as the Transite Water Main Replacement - Phase 1, described in the plans and
specifications heretofore adopted by this Council on October 21, 2019, be and is hereby accepted,
the same being the lowest responsive, responsible bid received for such work, as follows:
Contractor: Busy Bee Construction of Lewistown, MO
Amount of bid: $695,617.68
Portion of project: All construction work
Section 2.That the Mayor and Clerk are hereby directed to execute the contract with the
contractor for the construction of the public improvements, such contract not to be binding on the
City until approved by this Council.
