AN ORDINANCE TO AMEND CHAPTER 160, SITE AND BUILDING DEVELOPMENT STANDARDS, RELATED TO ARCHITECTURAL AND SITE DESIGN CHARACTERISTICS FOR ARTERIAL OVERLAY DISTRICT BE IT ORDAINED by the City Council of the City of Waukee: Section 1. Chapter 160, Waukee Municipal Code, Zoning Regulations, Site and Building Development Standards, is hereby amended by deleting Section 160.07.3 and inserting the following language: 3. Architectural and Site Design Characteristics – Arterial Overlay District. The regulations specified under this district shall apply to all properties adjoining or integrated with a property adjoining a street classified by the adopted Major Streets Plan as an interstate, primary highway, major arterial, or minor arterial. A. Used car facilities shall be permitted only in conjunction with a new car facility. B. Drive-thru windows, menu boards, and related items shall be positioned or screened so as not to be visible from the corridor. C. Overhead doors shall be designed with full glass giving the general appearance of a storefront window when closed. Section 2. Repealer. All ordinances or parts of ordinances in conflict with the provisions of this ordinance are hereby repealed. Section 3. Severability Clause. If any section, provision or part of this ordinance shall be adjudged invalid or unconstitutional, such adjudication shall not affect the validity of the ordinance as a whole or any section, provisions or part thereof not adjudged invalid or unconstitutional. Section 4. Effective Date. This ordinance shall be in effect from and after its final passage, approval and publication as provided by law.
