DESIGNATING SUCH AREA AS APPROPRIATE FOR URBAN RENEWAL PROJECTS; AND ADOPTING AMENDMENT NO. 1 TO THE WAUKEE CONSOLIDATED URBAN RENEWAL PLAN WHEREAS, by Resolution No. 13-257, adopted October 21, 2013, this Council found and determined that certain areas located within the City are eligible and should be designated as an urban renewal area under Iowa law, and approved and adopted the Gateway Economic Development Urban Renewal Plan (the “Gateway Plan” or “Gateway Urban Renewal Plan”) for the Gateway Economic Development Urban Renewal Area (the “Gateway Urban Renewal Area” or “Gateway Area”) described therein, which Gateway Plan is on file in the office of the Recorder of Dallas County; and WHEREAS, by Resolution No. 14-320, adopted November 17, 2014, this City Council approved and adopted an Amendment # 1 to the Gateway Plan; and WHEREAS, by Resolution No. 15-350, adopted October 19, 2015, this City Council approved and adopted an Amendment # 2 to the Gateway Plan; and WHEREAS, by Resolution No. 16-490, adopted November 21, 2016, this City Council approved and adopted an Amendment # 3 to the Gateway Plan; and WHEREAS, by Resolution No. 17-485, adopted October 16, 2017, this City Council approved and adopted an Amendment # 4 to the Gateway Plan; and WHEREAS, by Resolution No. 18-414, adopted October 15, 2018, this City Council approved and adopted an Amendment # 5 to the Gateway Plan; and WHEREAS, by Resolution No. 19-023, adopted January 21, 2019, this City Council approved and adopted an Amendment # 6 to the Gateway Plan; and WHEREAS, by Resolution No. 17-458 adopted September 25, 2017, this Council found and determined that certain areas located within the City are eligible and should be designated as an urban renewal area under Iowa law, and approved and adopted the Waukee West Urban Renewal Plan (the “Waukee West Plan”) for the Waukee West Urban Renewal Area (the “Waukee West Urban Renewal Area”) described therein, which Waukee West Plan is on the file in the office of the Recorder of Dallas County; and WHEREAS, by Resolution No. 18-127 adopted April 2, 2018, this Council adopted Amendment # 1 to the Waukee West Plan; and WHEREAS, by Resolution No. 18-413 adopted October 15, 2018, this Council adopted Amendment # 2 to the Waukee West Plan; and WHEREAS, by Resolution No. 17-484 adopted October 16, 2017, this Council found and determined that certain areas located within the City are eligible and should be designated as an urban renewal area under Iowa law, and approved and adopted the Waukee Central Urban Renewal Plan (the “Waukee Central Plan”) for the Waukee Central Urban Renewal Area (the “Waukee Central Urban Renewal Area”) described therein, which Waukee Central Plan is on the file in the office of the Recorder of Dallas County; and WHEREAS, by Resolution No. 18-039 adopted February 5, 2018, this Council adopted Amendment # 1 to the Waukee Central Plan; and WHEREAS, City staff has caused there to be prepared a form of a consolidated plan entitled Amendment No. 1 to Waukee Consolidated Urban Renewal Plan (“Amendment No. 1” or “Amendment”), a copy of which has been placed on file for public inspection in the office of the City Clerk and which is incorporated herein by reference, the purpose of which is to: (a) unify the City’s existing Gateway Economic Development Urban Renewal Area, the Waukee West Urban Renewal Area, and the Waukee Central Urban Renewal Area; (b) rename the unified Gateway Economic Development Urban Renewal Area, the Waukee West Urban Renewal Area, and the Waukee Central Urban Renewal Area, as the Waukee Consolidated Urban Renewal Area (“Urban Renewal Area” or “Area”) and rename the urban renewal plans for the Gateway Economic Development Urban Renewal Plan, the Waukee West Urban Renewal Plan, and the Waukee Central Urban Renewal Plan as the Waukee Consolidated Urban Renewal Plan (“Urban Renewal Plan” or “Plan”); (c) add additional property to the Area; and (d) update and confirm the urban renewal activities and eligible projects that may be undertaken by the City; and WHEREAS, the proposed Urban Renewal Area will consist of the following existing areas that will be linked into a unified area: Gateway Economic Development Urban Renewal Area, as amended, Waukee West Urban Renewal Area, as amended, and Waukee Central Urban Renewal Area, as amended; WHEREAS, the proposed Amendment No. 1 Area includes land classified as agricultural land and consequently written permission of the current owners has been obtained; and WHEREAS, it is desirable that the Area be redeveloped as part of the activities described within the proposed Amendment No. 1; and WHEREAS, by resolution adopted on October 7, 2019, this Council directed that a consultation be held with the designated representatives of all affected taxing entities to discuss the proposed Amendment No. 1 and the division of revenue described therein, and that notice of the consultation and a copy of the proposed Amendment No. 1 be sent to all affected taxing entities; and WHEREAS, pursuant to such notice, the consultation was duly held as ordered by the City Council and all required responses to the recommendations made by the affected taxing entities, if any, have been timely made as set forth in the report of the Development Services Director, or his delegate, filed herewith and incorporated herein by this reference, which report is in all respects approved; and WHEREAS, by resolution this Council also set a public hearing on the adoption of the proposed Amendment No. 1 for this meeting of the Council, and due and proper notice of the public hearing was given, as provided by law, by timely publication in the Dallas County News, which notice set forth the time and place for this hearing and the nature and purpose thereof; and WHEREAS, in accordance with the notice, all persons or organizations desiring to be heard on the proposed Amendment No. 1, both for and against, have been given an opportunity to be heard with respect thereto and due consideration has been given to all comments and views expressed to this Council in connection therewith and the public hearing has been closed. NOW, THEREFORE, BE IT RESOLVED, BY THE CITY COUNCIL OF THE CITY OF WAUKEE, STATE OF IOWA: Section 1.That the findings and conclusions set forth or contained in Amendment No. 1 concerning the area of the City of Waukee, State of Iowa, described in the preamble hereof, be and the same are hereby ratified and confirmed in all respects as the findings of this Council for this area. Section 2.This Council further finds: a)Although relocation is not expected, a feasible method exists for the relocation of any families who will be displaced from the Urban Renewal Area into decent, safe and sanitary dwelling accommodations within their means and without undue hardship to such families; b)The Waukee Consolidated Urban Renewal Plan, as amended, and Amendment No. 1 conform to the general plan for the development of the City as a whole; and c)Acquisition by the City is not immediately expected, however, as to any areas of open land to be acquired by the City included within the Urban Renewal Area: i. Residential use is not expected, however, with reference to any portions thereof which are to be developed for residential uses, this City Council hereby determines that a shortage of housing of sound standards and design with decency, safety and sanitation exists within the City; that the acquisition of the area for residential uses is an integral part of and essential to the program of the municipality; and that one or more of the following conditions exist: a.That the need for housing accommodations has been or will be increased as a result of the clearance of slums in other areas, including other portions of the urban renewal area. b.That conditions of blight in the municipality and the shortage of decent, safe and sanitary housing cause or contribute to an increase in and spread of disease and crime, so as to constitute a menace to the public health, safety, morals, or welfare. c.That the provision of public improvements related to housing and residential development will encourage housing and residential development which is necessary to encourage the retention or relocation of industrial and commercial enterprises in this state and its municipalities. d.The acquisition of the area is necessary to provide for the construction of housing for low and moderate income families. ii.Non-residential use is expected and with reference to those portions thereof which are to be developed for non-residential uses, such non-residential uses are necessary and appropriate to facilitate the proper growth and development of the City in accordance with sound planning standards and local community objectives. Section 3.That the Gateway Economic Development Urban Renewal Area, the Waukee West Urban Renewal Area, and the Waukee Central Urban Renewal Area were previously designated as economic development areas within the meaning of Chapter 403, Code of Iowa, and that the Waukee Consolidated Urban Renewal Area, as amended, continues to be an economic development area within the meaning of Chapter 403, Code of Iowa; that such area is eligible for designation as an urban renewal area and otherwise meets all requisites under the provisions of Chapter 403, Code of Iowa; and that the rehabilitation, conservation, redevelopment, development, or a combination thereof, of such area is necessary in the interest of the public health, safety or welfare of the residents of this City. Section 4.That Amendment No. 1 to the Waukee Consolidated Urban Renewal Plan of the City of Waukee, State of Iowa, attached hereto as Exhibit 1 and incorporated herein by reference, be and the same is hereby approved and adopted as "Amendment No. 1 to the Waukee Consolidated Urban Renewal Plan for the City of Waukee, State of Iowa"; Amendment No. 1, including all of the exhibits attached thereto, is hereby in all respects approved; the Mayor and City Clerk are authorized to approve the executed Agricultural Land Agreement; and the City Clerk is hereby directed to file a certified copy of Amendment No. 1 with the proceedings of this meeting. Section 5.That, notwithstanding any resolution, ordinance, plan, amendment or any other document, Amendment No. 1 shall be in full force and effect from the date of this Resolution until the Council amends or repeals the Waukee Consolidated Urban Renewal Plan. The proposed Amendment No. 1 shall be forthwith certified by the City Clerk, along with a copy of this Resolution, to the Recorder for Dallas County, Iowa, to be filed and recorded in the manner provided by law. AGREEMENTS TO INCLUDE AGRICULTURAL LAND 35 - 3 - AMENDMENT NO. 1 TO THE WAUKEE CONSOLIDATED URBAN RENEWAL PLAN FOR THE WAUKEE CONSOLIDATED URBAN RENEWAL AREA CITY OF WAUKEE, IOWA A.INTRODUCTION In response to particular situations during the past years, the City of Waukee (the “City” or “Waukee”) has created and amended several urban renewal areas, covering different portions of the City, the primary purpose of each to stimulate, through public involvement and commitment, private investment in new commercial and light industrial development. Changing economic conditions and priorities makes it unnecessary to have separate areas, and consolidating or linking these areas will allow the City to maximize the future expenditure of incremental property tax revenues in order to promote economic development. Accordingly, this Amendment No. 1 to the Waukee Consolidated Urban Renewal Plan (“Amendment No. 1”) accomplishes all of the following: (1) Consolidates and links the following existing urban renewal areas: • Gateway Economic Development Urban Renewal Area (including Amendments 1-6) • Waukee West Urban Renewal Area (including Amendments 1-2) • Waukee Central Urban Renewal Area (including Amendment 1) • Amendment No. 1 to the Waukee Consolidated Urban Renewal Area (2019) The adoption of Amendment No. 1 will have no effect on any of the tax increment ordinances that have been adopted for any of the urban renewal areas, or on any of the tax base valuations that have been previously established for any of the urban renewal areas or amendment areas. (2) Renames the consolidated areas the Waukee Consolidated Urban Renewal Area (“Area” or “Urban Renewal Area”) and renames the amended and consolidated plans the Waukee Consolidated Urban Renewal Plan. (3) Adds additional property to the Area, which property is designated as the Amendment No.1 Area to the Waukee Consolidated Urban Renewal Area (“Amendment No. 1 Area”). - 4 - (4) Updates and confirms the lists of objectives, activities, and projects for the Area. Except as modified by this Amendment No. 1, the provisions of the plans for the consolidated areas, as previously amended, are hereby ratified, confirmed, and approved and shall remain in full force and effect as provided herein. In case of any conflict or uncertainty, the terms of this Amendment No. 1 shall control. B.DESCRIPTION OF THE URBAN RENEWAL AREA The Waukee Consolidated Urban Renewal Area, including each of the consolidated areas and the Amendment No. 1 Area, is described in Exhibit A. The Area includes the right of way of various roads connecting the Area and is illustrated in Exhibit B. The City reserves the right to modify the boundaries of the Area at some future date. C.AREA DESIGNATION With the adoption of this Amendment No. 1, the City of Waukee continues to designate the Urban Renewal Area, including the consolidated areas and the Amendment No. 1 Area, as an area that is appropriate for the promotion of economic development, both commercial and industrial. D. BASE VALUES Those portions of the existing areas being consolidated as a result of Amendment No. 1 which are already included in a tax increment financing (“TIF”) ordinance will retain their separate existing base values. It is anticipated that a number of TIF ordinances will be adopted for various parcels within the Urban Renewal Area, corresponding to the completion of new development projects. Accordingly, different portions of the Urban Renewal Area will have different base valuation dates. - 5 - E.DEVELOPMENT PLAN Waukee has a general plan for the development of the City as a whole outlined in the Waukee Comprehensive Land Use Plan, adopted in 2019. This Amendment No. 1 is in conformity with the 2019 Comprehensive Plan and the land use policy and priorities that were adopted as part of the planning process. Specific objectives identified in the Comprehensive Plan include, but are not limited to, a connected citizenry involving the creation of strong civic gathering places; a successful and economically viable downtown; business environments that define our future through innovation and creativity; and mixed- use and neighborhood integrated commercial developments which maintain a strong retail base and are designed to be sustainable. This Urban Renewal Plan does not change or in any way replace the City's current land use planning or zoning regulation process. The need for improved traffic, public transportation, public utilities, recreational and community facilities, or other public improvements within the Urban Renewal Area is set forth in this Amendment No. 1. As the Area develops, the need for public infrastructure extensions and upgrades will be evaluated and planned for by the City. F.PROJECT AREA OBJECTIVES Renewal activities are designed to provide opportunities, incentives, and sites for community economic development purposes, including new and expanded industrial and commercial development. More specific objectives for development within the Waukee Consolidated Urban Renewal Area are as follows: 1. To stimulate through public action and commitment, private investment in new commercial and industrial development. 2. To plan for and provide sufficient land for commercial and light industrial development in a manner that is efficient from the standpoint of providing municipal services. 3. To provide for the installation of public infrastructure and other public facilities which contribute to the sound development in the Area. 4. To provide a more marketable and attractive investment climate. - 6 - 5. To achieve a diversified, well-balanced economy providing a desirable standard of living, creating job opportunities, and strengthening the tax base. G.TYPE OF RENEWAL ACTIVITIES To meet the objectives of this Amendment No. 1 and to encourage the development of the Area, the City intends to utilize the powers conferred under Chapters 403 and Chapter 15A, Code of Iowa including, but not limited to, tax increment financing. Activities may include: 1. To undertake and carry out urban renewal projects through the execution of contracts and other instruments. 2. To provide for the construction of specific site improvements such as grading and site preparation activities, access roads and parking, fencing, utility connections, and related activities. 3. To arrange for or cause to be provided the construction or repair of public infrastructure, including but not limited to, streets, water, storm sewer, sanitary sewer, public utilities, sidewalks, street lights, public parks and open spaces, bike trails, landscaping or other related facilities and activities in connection with urban renewal projects. 4. To make loans, forgivable loans, tax rebate payments or other types of economic development grants or incentives to private persons or businesses for economic development purposes on such terms as may be determined by the City Council. 5. To use tax increment financing to facilitate urban renewal projects, including, but not limited to, actions to achieve a more marketable and competitive land offering price and to provide for necessary physical improvements and infrastructure. 6. To borrow money and to provide security therefor. 7. To make or have made surveys and plans necessary for the implementation of the Urban Renewal Program or specific urban renewal projects. - 7 - 8. To acquire property through a variety of means (purchase, lease, option, etc.) and to hold, clear or prepare the property for redevelopment. 9. To dispose of property so acquired. 10. To use any or all other powers granted by the Urban Renewal Act to develop and provide for improved economic conditions for the City of Waukee and the State of Iowa. Nothing herein shall be construed as a limitation on the power of the City to exercise any lawful power granted to the City under Chapter 15, Chapter 15A, Chapter 403, Chapter 427B, or any other provision of the Code of Iowa in furtherance of the objectives of this Urban Renewal Plan. The regional youth sports complex is anticipated to host a number of - 10 - regional tournaments, which will draw many outside visitors, generating a need for additional commercial retail and service businesses. 5 Way Intersection Improvements – Ashworth Drive/Warrior Lane/Northview Drive 2021 - 2025 $2,000,000 - $5,000,000 Improvements to an intersection that has a poor level of service, generates a number of accidents, and creates a safety problem/delay in response time for the nearby police and fire station. The location is a key intersection of two major collector roads that when extended will create the opportunity for additional commercial economic development. Warrior Lane Widening – University Avenue to Ashworth Drive 2021 - 2023 $5,000,000 - $8,000,000 Expansion of existing collector roadway Corridor that serves a number of school and City facilities. The Corridor is currently insufficient in size and creates a number of delays and safety concerns including concerns related to police/fire response times. The roadway serves as a major collector roadway which when expanded and extended will allow for additional commercial economic development activity. University Avenue Widening and Extension – LA Grant Parkway to 6th Street 2021 - 2025 $15,000,000 - $18,000,000 Commercial/Industrial Corridor Roadway Expansion Total Range of $168,500,000 to $225,500,000 2) Development Agreements (existing): - 11 - As authorized in the Gateway Economic Development Urban Renewal Plan, Waukee West Urban Renewal Plan and Waukee Central Urban Renewal Plan, as previously amended, and which are incorporated and consolidated into this Amendment No. 1, the City has entered into the following development agreements which are continuing: a. Agreement with KC Kettlestone, L.C. Under authority granted by the Gateway Economic Development Urban Renewal Plan, as previously amended, the City entered a Development Agreement (the "Agreement") with KC Kettlestone, L.C. (the “Developer”) and Ashworth Properties Development, Inc. (the "Land Developer"). The Agreement obligates the Developer to construct certain Minimum Improvements (as defined in the Agreement) on certain real property located within the Gateway Urban Renewal Area as defined and legally described in the Development Agreement, consisting of the construction of a 90,000 square foot, two story building to be used for office space, together with all related site improvements, under the terms and following satisfaction of the conditions set forth in the Agreement. Developer anticipates the Minimum Improvements will be leased to a commercial business that will employ employees therein. The Agreement further obligates the City to make up to five (5) consecutive annual payments of Economic Development Grants to Developer consisting of 100% of the Tax Increments pursuant to the Iowa Code Section 403.19 and generated by the construction of the Minimum Improvements; the cumulative total for all such payments is currently estimated to be $1,740,000 but in no event will exceed the amount accrued under the formula outlined in the Development Agreement, under the terms and following satisfaction of the conditions set forth in the Agreement. The Land Developer will dedicate property to the City, at no cost to the City, to be used as right-of-way for certain Public Improvements, as described in the Agreement, to be constructed by the City in the Urban Renewal Area. The Agreement further proposes that Land Developer will pay for the costs of the Public Improvements not otherwise paid for by RISE grants. The Agreement further obligates the City to make up to five (5) additional consecutive annual payments of Economic Development Grants to Developer consisting of 100% of the Tax Increments pursuant to the Iowa Code Section 403.19 and generated by the construction of the Minimum Improvements, the cumulative total for all such payments not to exceed the amount accrued under the formula outlined in the proposed Development Agreement - 12 - (currently estimated to be $1,740,000), under the terms and following satisfaction of the conditions set forth in the Agreement. The Developer will contribute $25,000 from each Economic Development Grant to offset the cost of the City constructing certain Public Amenities in the Urban Renewal Area, as described in the Agreement. b. Agreement with Fridley Properties LLC. Under authority granted by the Gateway Economic Development Urban Renewal Plan, as previously amended, the City entered into a Development Agreement (the "Agreement") with Fridley Properties LLC (the “Developer”). The Agreement obligates the Developer to complete Minimum Improvements (as defined in the Agreement) on certain real property located within the Gateway Urban Renewal Area as defined and legally described in the Development Agreement, consisting of the construction of a 64,000 square foot movie theater and related improvements (as defined in the Agreement) on a portion of the Development Property, and to employ employees therein. The Agreement further obligates the City to make five (5) annual payments of Economic Development Grants to Developer, each consisting of 100% of the Tax Increments pursuant to the Iowa Code Section 403.19 and generated by the construction of the Minimum Improvements, under the terms and following satisfaction of the conditions set forth in the Agreement and up to a cumulative maximum of $2,000,000. c. Agreement with Kettleview, L.L.C. Under authority granted by the Gateway Economic Development Urban Renewal Plan, as previously amended, the City entered into a Development Agreement (the "Agreement") with Kettleview, L.L.C. (the “Developer”). The Agreement obligates the Developer to complete Minimum Improvements (as defined in the Agreement) on certain real property located within the Gateway Urban Renewal Area as defined and legally described in the Development Agreement, consisting of a series of office buildings and including an event space and water feature with a minimum total investment of $55,385,000 and to employ employees therein. The Agreement further obligates the City to make five (5) annual payments of Economic Development Grants to Developer for each building constructed, each consisting of 90% of the Tax Increments pursuant to the Iowa Code Section 403.19 and generated by the construction of the Minimum Improvements, under the terms and following - 13 - satisfaction of the conditions set forth in the Agreement and up to a cumulative maximum of $5,300,000. d. Agreement with Hurd Waukee LLC: Under authority granted by the Gateway Economic Development Urban Renewal Plan, as previously amended, the City entered into a Development Agreement (the "Agreement") with Hurd Waukee, LLC (the "Developer"). The Agreement obligates the Developer to construct certain Minimum Improvements (as defined in the Agreement) on certain real property located within the Gateway Economic Development Urban Renewal Area and consisting of the construction of eight buildings, collectively totaling approximately 50,000 square feet, on the Development Property to be used for commercial/retail use and the employment of employees therein, together with all related site improvements, as outlined in the Agreement. The Developer has prepared the Development Property for development by installing a wider entrance drive and left turn lane at an investment of approximately $172,000, dedicated right-of-way valued at $110,000 to the City, and will contribute $88,000 to the City to be used for the installation of traffic signals. The Agreement obligates the City to make up to five (5) consecutive annual payments of Economic Development Grants to Developer consisting of 80% of the Tax Increments pursuant to Iowa Code Section 403.19 and generated by the construction of the Minimum Improvements, the cumulative total for all such payments not to exceed the lesser of $370,000, or the amount accrued under the formula outlined in the proposed Agreement, under the terms and following satisfaction of the conditions set forth in the Agreement. e. Agreement with Hurd Kettlestone LLC. Under authority granted by the Gateway Economic Development Urban Renewal Plan, as previously amended, the City entered into a Development Agreement (the "Agreement") with Hurd Kettlestone LLC (the “Developer”). The Agreement obligates the Developer to construct certain Minimum Improvements (as defined in the Agreement) on certain real property located within the Gateway Economic Development Urban Renewal Area, and consisting of the construction of an approximately 185,000 square foot commercial building, together with all related site improvements. The Agreement further contemplates that the City will construct certain Public Improvements (as defined in the Agreement) in order to assist in the development of the Minimum Improvements, under the terms and following satisfaction of the conditions set forth in the Agreement. The parties entered into a Minimum Assessment Agreement with the County setting the minimum actual value of the Minimum Improvements for tax purposes at not less than $18,500,000. - 14 - f. Data Center Development Agreement: As authorized by the Waukee West Urban Renewal Plan, as previously amended, the City entered into a development agreement with a technology company in order to incentivize the construction of data center and support building(s) in the Waukee West Urban Renewal Area. The developer’s obligations include executing a minimum assessment agreement setting a minimum assessed value for each completed data center building, and employing employees in the building(s). In exchange, the City agreed, among other things, to abate a percentage of the value created by each building from taxation under the authority provided by the High Quality Jobs Program and Iowa Code Section 15.322, to expedite the completion of certain public improvements, and to rebate franchise fee payments on electricity paid by developer in the event franchise fees are imposed by the City. The City does not anticipate rebating any tax increment under the development agreement. g. Agreement with The Rose Companies and Deery, Deery & Deery, LLC. Under authority granted by the Waukee Central Urban Renewal Plan, as previously amended, the City entered into a Development Agreement (the "Agreement") with The Rose Companies (the “Developer”) and Deery, Deery & Deery, LLC (the "Employer"). The Agreement obligates the Developer to construct certain Public Improvements (as defined in the Agreement) on certain property within the Waukee Central Urban Renewal Area (“Development Property”). The Agreement further obligates the Developer to complete Minimum Improvements (as defined in the Agreement) on a portion of the Development Property, including construction of a new 38,975 square foot building and associated paved lot to be used for a car dealership with cost for construction estimated to be $6,500,000.00. The Agreement further obligates the Employer to employ employees at the Minimum Improvements. The Agreement obligates the City to make seven (7) annual payments of Economic Development Grants to Developer, each consisting of 100% of the Tax Increments pursuant to the Iowa Code Section 403.19 and generated by the construction of the Minimum Improvements, under the terms and following satisfaction of the conditions set forth in the Agreement, up to a cumulative total for all such payments to Developer not to exceed the lesser of the cost of the Public Improvements or $950,000. - 15 - I. ELIGIBLE URBAN RENEWAL PROJECTS Although certain project activities may occur over a period of years, the Eligible Urban Renewal Projects under this Amendment No. 1 include: 1) Public Improvements: Urban Renewal Project Description Estimated Date Estimated Cost Rationale Ashworth Road Widening – LA Grant Parkway to Waco Place 2021-2025 $15,000,000 - $20,000,000 Expansion of existing arterial roadway Corridor that serves a number of school facilities as well as the larger regional transportation network. Development Agreements (future): The City expects to consider requests for Development Agreements for projects that are consistent with this Plan, in the City’s sole discretion. Such Agreements are unknown at this time, but based on past history, and dependent on development opportunities and climate, the City expects to consider incentives as authorized by this Plan, including but not limited to land, loans, grants, rebates, public infrastructure assistance and other incentives. It is further expected that such indebtedness, including interest on the same, may be financed in whole or in part with tax increment revenues from the Urban Renewal Area. PUBLIC BUILDING ANALYSIS (Restated from Waukee West Urban Renewal Plan, as previously amended) A future public safety facility with fire and police services is contemplated for this Area due to the distance from existing public safety facilities and the response times for this area of the community. - 17 - As development occurs, additional protection will be needed. Using tax increment financing dollars to pay for the construction and equipping of this public building is a fair and rational way to fund this urban renewal project. Alternative development and funding options for a potential public building project in the Urban Renewal Area would be for the City to go through a process that could result in the issuance of general obligation bonds to fund the project, resulting in the entire cost for the facility to be borne by City residents. This option is arguably less feasible than the use of TIF funds because there would be no contribution of tax increment revenues from affected school districts and Dallas County. Because the public safety facility listed in this Plan will benefit Dallas County residents/taxpayers and school patrons/taxpayers, the use of tax increment is the most appropriate funding mechanism because it is fair for the school districts and the county to share in the costs for the project. The project demonstrates regional benefits. Additionally, purchasing land and constructing a new public safety facility will protect this area of the City, which will promote development, thus increasing the property tax base, thereby benefiting the City, school and county. The City also intends to consider the use of other funding sources, such as state, federal, and/or local grants, and private donations. Construction of a new public safety facility will provide needed fire and ambulance protection in this western edge of the City. The fire district serviced by the City of Waukee extends along the Highway 6 corridor west to S Avenue. This area is included within the proposed Urban Renewal Area. Construction of a new public safety facility in the Area is necessary to allow for commercial and industrial development in the Area, including the proposed data center development. Construction of the new public safety facility in the Area will significantly reduce response times to the anticipated commercial and industrial development in the Area, and such improved responsiveness is imperative to attracting additional development to the Area, including the data center project described above. The Waukee Community School District has purchased property for a new high school scheduled to be open to students in the Fall of 2021. The subject property is located one half mile north of Highway 6 and east of R-22 (10th Street). Construction of a public safety facility within the proposed Urban Renewal Area will allow for minimal response time to the location of the proposed high school. In addition, the proposed City Public Safety Building will be approximately three miles from the soon to be constructed Dallas County Public Safety Building, providing new opportunities for mutual assistance and increased collaboration between the Waukee Police Department and the Dallas County Sheriff’s Office. In conclusion, for all the foregoing reasons, alternative options for funding of the urban renewal projects described above are less feasible than the use of incremental taxes. L. AGREEMENT TO INCLUDE AGRICULTURAL LAND Because some of the property included in the areas being consolidated into the Waukee Consolidated Urban Renewal Area included land that was defined as “agricultural land” - 18 - by Iowa Code Section 403.17(3), the City and property owners entered into agreements in which the property owners agreed to allow the City to include real property defined as “Agricultural Land” in the Urban Renewal Area. The original signed agreements are on file at the City Clerk’s office. In addition, a portion of the property being added to the Area by this Amendment No. 1 contains land that is defined as “agricultural land” by Iowa Code Section 403.17(3), and the City and property owner(s) have entered into agreement(s) in which the property owner(s) agree to allow the City to add that real property into the Urban Renewal Area. A form of the agreement is attached as Exhibit C and the original signed agreement(s) are on file at the City Clerk’s office. M. URBAN RENEWAL FINANCING The City of Waukee intends to utilize various financing tools such as those described below to successfully undertake the proposed urban renewal actions. The City of Waukee has the statutory authority to use a variety of tools to finance physical improvements within the Area. These include: A. Tax Increment Financing. Under Section 403.19 of the Iowa Code, urban renewal areas may utilize the tax increment financing mechanism to finance the costs of public improvements or economic development incentives associated with redevelopment projects. Upon creation of a tax increment district within the Area, by ordinance, the assessment base is frozen and the amount of tax revenue available from taxes paid on the difference between the frozen base and the increased value, if any, is segregated into a separate fund for the use by the City to pay costs of the proposed urban renewal projects. The increased taxes generated by any new development, above the base value, are distributed to the taxing entities, if not requested by the City and in any event upon the expiration of the tax increment district. B. General Obligation Bonds. Under Division III of Chapter 384 and Chapter 403 of the Iowa Code, the City has the authority to issue and sell general obligation bonds for specified essential and general corporate purposes, including the acquisition and construction of certain public improvements and urban renewal projects within the Area or incentives for development consistent with this Plan. Such bonds are payable from the levy of unlimited ad valorem taxes on all the taxable property within the City of Waukee. It may be the City - 19 - will elect to abate some or all of the debt service on these bonds with incremental taxes from this Area. The City may also determine to use tax increment financing to provide incentives such as cash grants, loans, tax rebates or other incentives to developers in connection with the urban renewal projects identified in this Amendment No. 1 related to commercial or light industrial development or other urban renewal projects. In addition, the City may determine to issue general obligation bonds, tax increment revenue bonds or such other obligations, or loan agreements for the purpose of making loans or grants of public funds to private businesses located in the Area for urban renewal projects. Alternatively, the City may determine to use available funds for making such loans or grants or other incentives related to urban renewal projects.In any event, the City may determine to use tax increment financing to reimburse the City for any obligations or advances. Nothing herein shall be construed as a limitation on the power of the City to exercise any lawful power granted to the City under Chapter 15, Chapter 15A, Chapter 403, Chapter 427B, or any other provision of the Code of Iowa in furtherance of the objectives of this Amendment No. 1. N. PROPERTY ACQUISITION/DISPOSITION If property acquisition/disposition becomes necessary to accomplish the objectives of Amendment No. 1, urban renewal powers will be carried out, without limitation, in accordance with the State of Iowa Urban Renewal Law. O. RELOCATION The City does not expect there to be any relocation required of residents or businesses as part of the Urban Renewal Projects; however, if any relocation is necessary, the City will follow all applicable relocation requirements. P. STATE AND LOCAL REQUIREMENTS All provisions necessary to conform to state and local laws will be complied with by the City and the developer in implementing this Amendment No. 1 and its supporting documents. - 20 - Q. REPEALER AND SEVERABILITY Any parts of the Gateway Economic Development Urban Renewal Plan, Waukee West Urban Renewal Plan and Waukee Central Urban Renewal Plan, as preciously amended, in conflict with this Amendment No. 1, are hereby repealed. In the event one or more provisions contained in this Amendment No. 1shall be held for any reason to be invalid, illegal, unauthorized or unenforceable in any respect, such invalidity, illegality, unauthorization or enforceability shall not affect any other provision of this or the Amendment No. 1, and this Amendment No. 1 shall be construed and implemented as if such provisions had never been contained herein. R. URBAN RENEWAL PLAN AMENDMENTS This Amendment No. 1 may be further amended from time to time for a number of reasons, including but not limited to, change in the Area, to add or change land use controls and regulations, to add or modify urban renewal projects, to modify goals or types of renewal activities, or to amend property acquisition and disposition provisions. The City Council may amend this Amendment No. 1 pursuant to appropriate procedures under Iowa Code Chapter 403. S. EFFECTIVE PERIOD This Amendment No. 1 will become effective upon its adoption by the City Council and the Amendment No. 1 will remain in effect until it is repealed by the City Council. During the life of the Amendment No. 1, the City Council may designate all or any portion of the property covered by this Amendment No. 1 as a “tax increment area.” With respect to any property covered by this Amendment No. 1 which is included in an ordinance which designates that property as a tax increment area, the use of incremental property tax revenues, or the “division of revenue,” as those words are used in Chapter 403 of the Code of Iowa, is limited to twenty (20) years from the calendar year following the calendar year in which the City first certifies to the County Auditor the amount of any loans, advances, indebtedness, or bonds which qualify for payment from the incremental property tax revenue attributable to the portion of the Area within the ordinance.
