(A) Call to Order – The regular meeting of the Waukee City Council was called to order by Mayor
Pro Tem Bottenberg at 5:30 p.m. in the Council Chambers at Waukee City Hall, 230 W.
Hickman Rd.
(B) Pledge of Allegiance
(C) Roll Call – The following members were present: Council Members R. Charles Bottenberg,
Courtney Clarke, Larry R. Lyon. Absent: Mayor William F. Peard; Council Members Anna
Bergman, Shelly Hughes. (Council Member Hughes arrived at 5:35 p.m.)
Also in attendance: City Administrator Tim Moerman, Finance Director Linda Burkhart,
Development Services Director Brad Deets, Public Works Director/City Engineer Rudy Koester,
Community & Economic Development Director Dan Dutcher, Human Resource Director Michelle
Lindsay, Marketing & Communications Director Summer Evans, Police Lt. Jeff Mellencamp, City
Clerk Rebecca D. Schuett, City Attorney Steve Brick.
(D) Open Forum – 1) Dawn Sturm, 875 SE Westgate Dr., referenced an email she had sent to the
council regarding her concerns with parking and safety in her neighborhood, citing speeders, a
recent accident, and concerns for the safety of neighborhood children. While she understood
that SE Westgate Dr. has public parking, she had received a suggestion from Council Member
Bottenberg that she circulate a petition to possibly limit the hours for parking. Council Member
Clarke replied that there are similar issues along many residential roads and that the petition
suggested by Council Member Bottenberg would help the council to see if a majority of
neighbors wanted limited parking. Ms. Sturm voiced her belief that it is the school’s
responsibility to provide enough parking for students, asking if there was anything being done to
remedy the student parking situation. (Council Member Hughes arrived at 5:35 p.m.) Council
Member Bottenberg replied that the second high school would help alleviate neighborhood
parking, adding that the City was looking into possible traffic-calming methods for issues such as
these. 2) Leroy Monson, 3181 SE Waco Pl, asked for an embargo on heavy truck traffic on his
street, citing ruts and dust caused by such vehicles. He added that speeding on SE Waco Pl.
was also a concern. City Administrator Moerman replied that City staff would look into both
concerns and provide a report to the council.
(E) Agenda Approval – Council Member Clarke moved to approve the agenda; seconded by
Council Member Lyon. Results of vote: Ayes: Bottenberg, Clarke, Hughes, Lyon. Nays: None.
Absent: Bergman. Motion carried 4 – 0 – 1.

(G) Presentations:
1) Waukee Park Board report – Report made by Board Member Troy Taylor.
2) Waukee Public Library Board of Trustees report – Report made by Trustee Jared
Starkweather.
(H) Public Hearings:
1) On an ordinance to amend Chapter 160, Site and Building Development Standards
related to Architectural and Site Design Characteristics (Overhead Doors) – Mayor Pro
Tem Bottenberg opened the public hearing and asked if any written correspondence had
been received; City Clerk Schuett replied in the negative. Development Services Director
Deets briefly reviewed the proposed ordinance, which would allow for front-facing overhead
doors for businesses located along major corridors. No comments were made by the public
in attendance.
2) On an ordinance to amend Chapter 169, Zoning Regulations, District Regulations, City
of Waukee, Iowa, by rezoning and changing certain property therein from A-1 to K-RC,
a property known as the Gonnerman Property – Mayor Pro Tem Bottenberg opened the
public hearing and asked if any written correspondence had been received; City Clerk

Schuett replied in the negative. Development Services Director Deets reviewed the rezoning
application. The applicant requests K-RC zoning to allow for the development of a
wedding/special events venue. The Kettlestone Master Plan identifies the area for multi-
family residential development but the plan allows for flexibility in zoning as development
occurs. If the application is approved, it may impact how surrounding properties can
develop, as it may be more commercial than residential in certain areas. If approved, City
staff recommends a possible amendment to the master plan for the area and engaging the
residents impacted by any changes. Mr. Deets noted that the original master plan called for
SE Esker Ridge Dr. to extend through the area but City staff believes it would be difficult to
extend that road due to topography and that is no longer necessary as there are other
means of roadway access. Mayor Pro Tem Bottenberg asked for public comment on the
matter: 1) Dave Little with Buyer’s Realty, representing property owner Don Gonnerman,
discussed the plan for a wedding venue and the topography of the site. He stated that while
the Kettlestone Master Plan shows multi-family residential development in the area, the
proposed project is a better transitional use. Based on some comments made at the
Planning & Zoning Commission meeting, the developer has committed to some extra steps,
such as fencing, to please neighbors. 2) Don Gonnerman, property owner, reiterated Mr.
Little’s comments that the property would be better developed as proposed instead of with
high-density housing. He stated that a well-done wedding venue would be successful. 3)
Leroy Monson, 3181 SE Waco Pl., voiced his objection to this particular zoning, believing it
to be a piecemeal and incremental approach. He asked the council to table consideration of
the events center special use and instead discuss how the overall area should be
developed. He would like to see the entire area zoned for commercial development but with
special protections so that residents are not taxed at the commercial rate until properties are
developed. He added that he did not see how a wedding venue would proper and
expressed his concern with noise created by late-night concerts. At the request of Council
Member Bottenberg, Mr. Deets reviewed the rezoning and master planning processes,
noting that the City does not typically rezone property until a property owner requests it. He
added that tax rates do not tie to zoning but to current use, so that any property zoned
commercial but still being used as residential is taxed at the residential rate. 4) Brad Brody,
project developer, stated that his company reached out to neighbors regarding the
application but never heard from Mr. Monson until his comments tonight. He clarified that
the development was a wedding venue that would close at 11:00 p.m. and that they would
require a police officer at all events. He added that noise created by the proposed venue
would be less of an issue than if the property were developed as multi-family residential.
Council Member Clarke stated that she was glad to see that the master plan would be
revisited and that many of the neighbors’ comments from the Planning & Zoning
Commission meeting would be addressed. 5) Bill Atcheson, 3307 SE Ashworth Dr., stated
that, while he understands that change is coming, his property will “get hammered” no matter
how the subject property develops. 6) Kathy Atcheson, 3307 SE Ashworth Dr., asked Mr.
Little how another of his properties in the area would develop; Mr. Little stated that he could
not be specific due to a pending offer. Council Member Hughes thanked all who spoke on
the matter.
3) On an ordinance to amend Chapter 169, Zoning Regulations, District Regulations, City
of Waukee, Iowa, by rezoning certain property from A-1 to C-1 and R-4, a property to
be known as Waukee Crossing – Mayor Pro Tem Bottenberg opened the public hearing
and asked if any written correspondence had been received; City Clerk Schuett replied in the
negative. Development Services Director Deets briefly reviewed the rezoning application,
noting that the majority of the parcel would be C-1, with a small portion of R-4 to align with
proposed roads and the existing R-4 zoning to the north. Council Member Clarke asked
about planned uses for the commercial property; Mr. Deets replied that there were no
specific uses at this point in time but that C-1 is a very general commercial zoning district
and is typical along the Hickman Rd. corridor. No comments were made by the public in
attendance.

4) On a proposed Urban Renewal Plan for an Amendment No. 9 of the Waukee Unified
Urban Renewal Plan in the City of Waukee, State of Iowa – Mayor Pro Tem Bottenberg
opened the public hearing and asked if any written correspondence had been received; City
Clerk Schuett replied in the negative. Development Services Director Deets briefly reviewed
the proposed amendment. No comments were made by the public in attendance.
5) On a proposed Urban Renewal Plan for an Amendment No. 1 of the Waukee
Consolidated Urban Renewal Plan in the City of Waukee, State of Iowa – Mayor Pro
Tem Bottenberg opened the public hearing and asked if any written correspondence had
been received; City Clerk Schuett replied in the negative. Development Services Director
Deets briefly reviewed the proposed amendment, which combines the existing Waukee
West, Gateway and Waukee Central urban renewal plans. No comments were made by the
public in attendance.
6) On a proposal to enter into a Development Agreement with Midtown Waukee
Holdings, LLC – Mayor Pro Tem Bottenberg opened the public hearing and asked if any
written correspondence had been received; City Clerk Schuett replied in the negative.
Community & Economic Development Director Dutcher briefly reviewed the proposed
agreement and economic development incentives. Applicant Daniel Pettit of Encompass
Holdings discussed the project to be known as The Quarter, which will include entertainment
venues, “lifestyle retail” businesses and hotels. No comments were made by the public in
attendance.
7) On the proposal to enter into an Amended and Restated Agreement for Private
Development with Kettleview, LLC – Mayor Pro Tem Bottenberg opened the public
hearing and asked if any written correspondence had been received; City Clerk Schuett
replied in the negative. Community & Economic Development Director Dutcher briefly
reviewed the proposed agreement amendments and economic development incentives. No
comments were made by the public in attendance.
8) On plans, specifications, form of contract and estimate of cost [NW 10th Street Project,
West Hickman Road to NW Douglas Parkway] – Mayor Pro Tem Bottenberg opened the
public hearing and asked if any written correspondence had been received; City Clerk
Schuett replied in the negative. Public Works Director/City Engineer Koester briefly
reviewed the project, which includes the paving of NW Sunrise Dr. to its future connection
with NW 6th St. and box culverts for drainage and recreational trail connections. No
comments were made by the public in attendance.

1) Ordinance: Consideration of approval of an ordinance to amend Chapter 160, Site and
Building Development Standards related to Architectural and Site Design
Characteristics (Overhead Doors) [introduction; first reading]– Council Member
Hughes introduced the ordinance and moved to approve the first reading in title only;
seconded by Council Member Lyon. Results of vote: Ayes: Bottenberg, Clarke, Hughes,
Lyon. Nays: None. Absent: Bergman. Motion carried 4 – 0 – 1.
2) Ordinance: Consideration of approval of an ordinance to amend Chapter 169, Zoning

4) Amendment No. 9 to the Waukee Unified Urban Renewal Plan
A. Resolution: Consideration of approval of a resolution determining an area of the
City to be an economic development area, and that the rehabilitation,
conservation, redevelopment, development or a combination thereof, of such area
is necessary in the interest of the public health, safety or welfare of the residents
of the City; designating such area as appropriate for urban renewal projects; and
adopting Amendment No. 9 of the Waukee Unified Urban Renewal Plan – Council
Member Lyon moved to approve the resolution; seconded by Council Member Clarke.
Results of vote: Ayes: Bottenberg, Clarke, Hughes, Lyon. Nays: None. Absent:
Bergman. Motion carried 4 – 0 – 1. (Resolution #19-401)
B. Ordinance: Consideration of approval of an ordinance for the division of revenues
under Section 403.19, Code of Iowa, for Amendment No. 9 to the Waukee Unified
Urban Renewal Plan [introduction; first reading] – Council Member Hughes
introduced the ordinance and moved to approve the first reading in title only; seconded
by Council Member Lyon. Results of vote: Ayes: Bottenberg, Clarke, Hughes, Lyon.
