Hickman Rd. (B) Pledge of Allegiance (C) Roll Call – The following members were present: Mayor William F. Peard; Council Members Anna Bergman, R. Charles Bottenberg, Courtney Clarke, Larry R. Lyon. Absent: Council Member Shelly Hughes. Also in attendance: City Administrator Tim Moerman, Development Services Director Brad Deets, Public Works Director/City Engineer Rudy Koester, Parks & Recreation Director Matt Jermier, Recreation Supervisor Danae Edwards, Human Resource Director Michelle Lindsay, Marketing & Communications Director Summer Evans, Police Lt. Jeff Mellencamp, City Clerk Rebecca D. Schuett, City Attorney Steve Brick. (D) Open Forum (E) Agenda Approval – Council Member Lyon moved to approve the agenda; seconded by Council Member Bottenberg. Results of vote: Ayes: Bergman, Bottenberg, Clarke, Lyon. Nays: None. Absent: Hughes. Motion carried 4 – 0 – 1. (F) Mayor’s Report – Mayor Peard noted that November 30 is the deadline for applications for consideration of appointment to a citizen board. He reminded all of the snow ordinance provisions and that City offices will be closed for the Thanksgiving holiday. He congratulated the newly-elected City officials and thanked Council Member Hughes for serving as a council member. (G) Presentations: 1) Waukee Area Chamber of Commerce quarterly report – Report made by Waukee Area Chamber of Commerce Board Chairperson Ray Meister. (H) Public Hearings: 1) On an ordinance to amend Chapter 169, Zoning Regulations, District Regulations, City of Waukee, Iowa, by rezoning certain property from C-1/PD-1 to M-1/PD-1, a property known as Home Solutions of Iowa – Mayor Peard opened the public hearing and asked if any written correspondence had been received; City Clerk Schuett replied in the negative. Development Services Director Deets briefly reviewed the rezoning application, noting that the applicant has outgrown their current facility and wishes to expand. An overall development concept plan was discussed. Nicole Neal with Civil Design Advantage (CDA), project engineer, introduced herself if there were any questions from the council. No comments were made by the public in attendance. 2) On intent to commence a public improvement project known as 2020 N. 10th Street Improvements Project – Mayor Peard opened the public hearing and asked if any written correspondence had been received; City Clerk Schuett replied in the negative. Public Works Director/City Engineer Koester reviewed the project, stating that the City was following the provisions within State Code in the event that the use of eminent domain is necessary. He noted that the City was still working toward a resolution with the affected property owners. Mayor Peard asked for public comment on the matter: 1) Daniel Manning, Jr., with the Lillis O’Malley Law Firm and representing the Moores, stated that his clients had a lot of sentimental value in their property and that he was working with City Attorney Brick on a resolution that would benefit both the City and his clients. He expressed his appreciation for the efforts of the City to resolve the matter and, that while he understood the eminent domain process, he hoped it could be avoided. (I) Public Hearing Action Items: 1) Ordinance: Consideration of approval of an ordinance to amend Chapter 169, Zoning Regulations, District Regulations, City of Waukee, Iowa, by rezoning certain property J1B 2 from C-1/PD-1 to M-1/PD-1, a property known as Home Solutions of Iowa [introduction; first reading]– Council Member Bottenberg introduced the ordinance and moved to approve the first reading in title only; seconded by Council Member Lyon. Results of vote: Ayes: Bergman, Bottenberg, Clarke, Lyon. Nays: None. Absent: Hughes. Motion carried 4 – 0 – 1. 2) Resolution: Consideration of approval of a resolution approving and authorizing a public improvement project to construct the 2020 N. 10th Street Improvements Project, funding of final site-specific design, final route/site selection, to acquire land for the project by purchase and, if necessary, to authorize the use and acquisition of property by eminent domain – Council Member Bergman moved to approve the resolution; seconded by Council Member Clarke. Results of vote: Ayes: Bergman, Bottenberg, Clarke, Lyon. Nays: None. Absent: Hughes. Motion carried 4 – 0 – 1.
