AGENDA ITEM: Consideration of approval of a resolution approving a Public Sidewalk
Easement [Lot 1, The Shops at Kettlestone North Plat 6]

SYNOPSIS INCLUDING PRO & CON: With the site development of Lot 1, The Shops at
Kettlestone North, the proposed sidewalk needs to be routed around existing
utilities within the public right-of-way and onto private property necessitating
the public sidewalk easement.

RESOLUTION 19-
APPROVING PUBLIC UTILITY EASEMENT ON LOT 1 OF THE SHOPS AT
KETTLESTONE NORTH PLAT 6 [2520 ENCOMPASS INVESTMENT GROUP,
L.L.C.]
IN THE NAME AND BY THE AUTHORITY OF THE CITY OF WAUKEE, IOWA
WHEREAS, the City of Waukee, Dallas County, State of Iowa, is a duly organized Municipal
Organization; AND,
WHEREAS, on January 21, 2019, the Waukee City Council approved a final plat for The Shops
at Kettlestone North Plat 6 (Resolution #19-039); AND,
WHEREAS, it is necessary to acquire a Public Sidewalk Easement across a portion of Lot 1 of
The Shops at Kettlestone North Plat 6.
NOW THEREFORE BE IT RESOLVED by the City of Waukee City Council in session this
2nd day of December 2019, that it hereby approves the public sidewalk easement in The Shops at
Kettlestone North Plat 6.
