Easement [Waukee Community School District]

SYNOPSIS INCLUDING PRO & CON: The developer for the Clayton Estates Development has
acquired an easement from the Waukee School District related to some
overland flowage improvements that will occur on the Waukee Elementary
site due to the Clayton Estates Development.

STAFF REVIEW AND COMMENT: Staff would recommend approval.
RECOMMENDATION: Approve the resolution

RESOLUTION 18-
APPROVING OVERLAND FLOWAGE EASEMENT ASSOCIATED WITH
CLAYTON ESTATES PLAT 2 [WAUKEE COMMUNITY SCHOOL DISTRICT]
IN THE NAME AND BY THE AUTHORITY OF THE CITY OF WAUKEE, IOWA
WHEREAS, the City of Waukee, Dallas County, State of Iowa, is a duly organized Municipal
Organization; AND,
WHEREAS, a preliminary plat has been approved for the Clayton Estates Residential
Development; AND,
WHEREAS, it is necessary to acquire an overland flowage easement from an adjacent land
owner for purposes of allowing overland flowage through the adjacent property.
NOW THEREFORE BE IT RESOLVED by the City of Waukee City Council in session this
5th day of February 2018, that it hereby approves the overland flowage easement across property
owned by Waukee Community School District.
