HomeMy WebLinkAbout2018-02-05-K04 Building Code Amendment Ordinance_INTRO, 1ST READ AGENDA ITEM: CITY OF WAUKEE, IOWA CITY COUNCIL MEETING COMMUNICATION MEETING DATE: February 5, 2018 AGENDA ITEM: Consideration of approval of an Ordinance to amend Chapter 222, Building Code Regulations and Penalties [Introduction, First Consideration] FORMAT: Resolution SYNOPSIS INCLUDING PRO & CON: Staff is proposing several amendments related to the building code. The first two amendments relate to how valuation can be determined based upon the proposed improvements associated with both residential and commercial applications. The amendment allows the option for utilization of engineered estimates as presented by the applicant. The proposed change to the National Electrical Code is the result of state adoption of the 2017 National Electrical Code and its amendments. FISCAL IMPACT INCLUDING COST/BENEFIT ANALYSIS: COMMISSION/BOARD/COMMITTEE COMMENT: STAFF REVIEW AND COMMENT: Staff would recommend approval of the introduction of the ordinance and first consideration. AN ORDINANCE TO AMEND CHAPTER 222 OF THE MUNICIPAL CODE OF THE CITY OF WAUKEE, IOWA, BY AMENDING SECTION 222.3 AMENDMENTS, MODIFICATIONS, ADDITIONS AND DELETIONS (RELATED TO INTERNATIONAL RESIDENTIAL CODE), SECTION 222.5 AMENDMENTS, MODIFICATIONS, ADDITIONS AND DELETIONS (RELATED TO INTERNATIONAL BUILDING CODE), AND SECTION 222.13 AMENDMENTS, MODIFICATIONS, ADDITIONS AND DELETIONS (RELATED TO NATIONAL ELECTRICAL CODE). BE IT ENACTED BY THE CITY COUNCIL OF THE CITY OF WAUKEE, IOWA: Section 1: Chapter 222.3, Waukee Municipal Code, Amendments, Modifications, Additions and Deletions (related to 2015 International Residential Code) is amended to add subsection E as follows: E. Add the following to Section R108.3: The Building Valuation will be derived from the construction costs for the total work submitted by the contractor, or the most current Building Valuation Data Schedule published by the International Code Council (ICC). Submitted contractor valuation shall not be less than derived valuation through ICC. Published data is utilized by the Administrative Official in an effort to maintain consistency and fairness for permit fee calculations. It is not intended to reflect actual taxable value. Section 2: Chapter 222.5, Waukee Municipal Code, Amendments, Modifications, Additions and Deletions (related to 2015 International Building Code) is amended to add new subsection D and to renumber all remaining subsections within the section as follows: D. Add the following to Section R109.3: The Building Valuation will be derived from the construction costs for the total work submitted by the contractor, or the most current Building Valuation Data Schedule published by the International Code Council (ICC). Submitted contractor valuation shall not be less than derived valuation through ICC. Published data is utilized by the Administrative Official in an effort to maintain consistency and fairness for permit fee calculations. It is not intended to reflect actual taxable value. Section 3: Chapter 222.13, Waukee Municipal Code, Amendments, Modifications, Additions and Deletions (related to National Electrical Code) is amended by deleting the section in its entirety and replacing it with the following: §222.13 Amendments, Modifications, Additions and Deletions. The following amendments, modifications, additions and deletions to the National Electrical Code, as currently adopted by the State of Iowa, are hereby made: A. Amend Section 90.2 to add the following language: 90.2(D) Scope. Permits required. Permits shall be required for work contained within the scope of this article with the following exception: The electrical permit 2 for new construction shall be deemed included in the general building permit issued to the builder/general contractor. B. Delete section 210.12(D) C. Delete section 406.4(D)(4). Section 4. Repealer. All ordinances or parts of ordinances in conflict with the provisions of this ordinance are hereby repealed. Section 5. Severability Clause. If any section, provision or part of this ordinance shall be adjudged invalid or unconstitutional, such adjudication shall not affect the validity of the ordinance as a whole or any section, provisions or part thereof not adjudged invalid or unconstitutional. Section 6. Effective Date. This ordinance shall be in effect after its final passage, approval and publication as provided by law.
