AGENDA ITEM:Consideration of approval of a resolution ratifying, confirming, and
approving revised project description, increased damages for delay,
revised notice to bidders, and revised notice of public hearing [Little
Walnut Creek Trunk Sewer Phase 4 Project]

SYNOPSIS INCLUDING PRO & CON: Following 02/05/2018 council approval to order
construction and fix a hearing date for the Little Walnut Creek Trunk
Sewer Phase 4 Project, some minor changes were made to the project
description in the Notice to Bidders and Notice of Public Hearing.
FISCAL IMPACT INCLUDING COST/BENEFIT ANALYSIS:

STAFF REVIEW AND COMMENT: Bond counsel has provided a resolution ratifying the
revisions to the notices.
RECOMMENDATION: Approve the resolution.

RESOLUTION RATIFYING, CONFIRMING, AND APPROVING REVISED
PROJECT DESCRIPTION, INCREASED DAMAGES FOR DELAY, REVISED
NOTICE TO BIDDERS, AND REVISED NOTICE OF PUBLIC HEARING
FOR THE LITTLE WALNUT CREEK TRUNK SEWER EXTENSION –
PHASE 4
WHEREAS, on February 5, 2018, the City Council of the City of Waukee, Iowa,
approved construction of the Little Walnut Creek Trunk Sewer Extension – Phase 4, fixed a date
for the public hearing thereon and fixed a date for the taking of bids therefor; and
WHEREAS, on February 6, 2018, the Notice to Bidders was posted in accordance with
law; and
WHEREAS, on February 6, 2018, the Notice of Public Hearing was sent for publication
on February 15, 2018, to be published in accordance with law; and
WHEREAS, on February 7, 2018, the Project Engineer revised the project description as
follows:
LITTLE WALNUT CREEK TRUNK SEWER EXTENSION – PHASE 4
Construct Little Walnut Creek Trunk Sewer Extension – Phase 4 including all labor,
materials and equipment necessary for approximately 6,050 linear feet of 8-inch through
24-inch diameter sanitary sewer in open cut, 210 linear feet of 18-inch through 24-inch
diameter sanitary sewer augured in steel casing, manholes, excavation and backfill,
surface restoration and miscellaneous associated work, including cleanup.
; and
WHEREAS, on February 7, 2018, the amount of damages per calendar day to be assessed
for each day that work shall remain uncompleted after June 30, 2018 at the sole discretion of the
City with due allowance for extensions of the contract period due to conditions beyond the
control of the Contractor, was increased from $500 to $1,000; and
WHEREAS, on February 8, 2018, a revised Notice to Bidders including the
aforementioned changes was posted in accordance with law; and
WHEREAS, on February 15, 2018, a revised Notice of Public Hearing was published in
accordance with law; and
WHEREAS, the Council has reviewed the revised project description, the increased
damages for delay, and the aforementioned revised Notice to Bidders and revised Notice of
Public Hearing, and deems it proper to ratify, confirm, and approve the foregoing actions taken
upon them.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF WAUKEE, STATE OF IOWA:
Section 1. That the revised project description and the increased damages for delay as
set forth in the revised Notice to Bidders and revised Notice of Public Hearing is hereby ratified,
confirmed, and approved.
Section 2. That the actions of the City Clerk in posting a revised notice to bidders once
in a relevant contractor plan room service with statewide circulation and a relevant construction
lead generating service with statewide circulation and on an internet site sponsored by the City or
a statewide association that represents the City, such posting having been made not less than
thirteen clear days nor more than forty-five days prior to the date fixed to receive bids, is hereby
ratified, confirmed and approved.
Section 3. That the action of the City Clerk in publishing a revised notice of hearing
once in the "Dallas County News", a legal newspaper, printed wholly in the English language,
published at least once weekly and having general circulation in this City; said publication
having been made not less than four clear days nor more than twenty days prior to March 5,
2018, the date fixed as the date for a public hearing on the plans, specifications, form of contract
and estimate of costs for the project, is hereby ratified, confirmed and approved.
