Hickman Rd. (B) Pledge of Allegiance (C) Roll Call – The following members were present: Mayor William F. Peard; Council Members Courtney Clarke, Shelly Hughes, Larry R. Lyon. Absent: Council Members Anna Bergman, R. Charles Bottenberg. (Council Member Bergman arrived at 5:36 p.m.) Also present: City Administrator Tim Moerman, Development Services Director Brad Deets, Public Works Director John Gibson, Parks and Recreation Director Matt Jermier, Marketing and Communications Director Summer Evans, Police Chief John Quinn, City Clerk Rebecca D. Schuett, City Attorney Steve Brick. (D) Open Forum (E) Agenda Approval – Council Member Lyon moved to approve the agenda; seconded by Council Member Hughes. Results of vote: Ayes: Clarke, Hughes, Lyon. Nays: None. Absent: Bergman, Bottenberg. Motion carried 3 – 0 – 2. (F) Mayor’s Report – Mayor Peard noted plans for the Waukee Youth Sports Complex following voter approval of a bond referendum for a second high school. He reviewed the snow emergency declaration ordinance, then stated that the Parks and Recreation spring/summer program guide will soon be available. (G) Presentations: 1) Waukee South Middle School Future City competition – Planner II Melissa DeBoer presented on her involvement as a mentor of the Future City team and the results of their competition. (Council Member Bergman arrived at 5:36 p.m.) 2) Waukee Area Chamber of Commerce quarterly report – Report made by Waukee Area Chamber of Commerce Board Chairperson Kevin McCormick. 3) Recognition of outgoing citizen commission, committee and board members – Mayor Peard recognized the following with certificates of appreciation: Community and Economic Development Advisory Council: Chris Littlefield, Chris McLinden, Tim Wolf Library Board of Trustees: Tracie Witt Park Board: Corby DeBord Planning & Zoning Commission: Steve Stonebrook, Scott Fontenot 4) Proclamation: In recognition of Joe Schmidt’s service as a City of Waukee Planning & Zoning Commissioner – Mr. Schmidt was unable to attend, so the proclamation presentation will be rescheduled. 5) Proclamation: In recognition of the State of Iowa Home Rule 50th Anniversary – Mayor Peard read the proclamation aloud. (H) Public Hearings: 1) On an ordinance to amend Chapter 301, Zoning Ordinance, City of Waukee, Iowa, by rezoning and changing certain property therein from C-4 to R-4, a property to be known as Prairie Crossing Townhomes – Mayor Peard opened the public hearing and asked if any written correspondence had been received; City Clerk Schuett replied in the negative. Development Services Director Deets reviewed the rezoning history of the subject property. When some nearby property was rezoned to residential use in 2013, the pre-existing Team Partners/OneNeck data center owners raised concerns regarding the potential impact of noise generated by their operation. At that time, a memorandum of understanding was approved, setting 70 dBs as the maximum noise level at the data center property line. OneNeck continues to have concerns regarding noise generated by their operation. The current rezoning applicant has acknowledged the concerns and has suggested ways to mitigate those concerns: an amendment to the existing development agreement, the establishment of a noise easement along the property, and the extension of private covenants similar to the Prairie Crossing J1B 2 development to the west. Denser landscaping and berming techniques will be explored during the site planning process. Mayor Peard invited public comment on the matter: 1) Stuart Ruddy, general counsel for Knapp Properties, addressed the council and noted that his company has been working with the data center to mitigate noise concerns. He believes their proposals will provide ample notice to future residents, but the two entities are still negotiating the three proposed agreements. City Attorney Brick asked if all such agreements would be in place prior to the third reading of the rezoning ordinance; Mr. Ruddy replied in the affirmative. Mr. Deets added that City staff would not recommend approval of the third reading without those approved and signed agreements. 2) Joel Templeman with Lillis O’Malley Law, representing OneNeck, addressed the council to voice his client’s continuing objection to the rezoning without finalized agreements, adding that they did not want approval of the third reading of the ordinance without those documents being approved and recorded. In response to a question posed by Council Member Lyon regarding the frequency of the noise omitted by the data center, Mr. Templeman noted that it is a continuous and not an intermittent noise. Council Member Clarke asked if walls or extensive berming was needed to mitigate the noise; Mr. Deets replied that there were several options to consider and that City staff will continue working with the developer on ways to lower the dB levels at the property line. Mr. Ruddy added that there has been no true study conducted on the actual noise levels currently omitted by the data center, but that the developer concurs that the noise levels will not exceed 70 dBs. Council Member Hughes stated that she would support the first reading of the ordinance but would not approve the third and final reading if the agreements are not in place. Council Member Bergman agreed with Council Member Hughes, adding that she would like information on how any potential noise complaints will be addressed. 2) On an ordinance to amend Chapter 301, Zoning Ordinance, City of Waukee, Iowa, by rezoning and changing certain property therein from A-1 to R-1, a property to be known as The Reserve at Daybreak – Mayor Peard opened the public hearing and asked if any written correspondence had been received; City Clerk Schuett replied in the negative. Development Services Director Deets reviewed the rezoning application, including lot size and access from Ashworth Rd. City staff continues to work with the developer on parkland dedication. Mayor Peard invited public comment on the matter: 1) Erin Ollendike with Civil Design Advantage (CDA), introduced herself as representative of the developer. 2) Joe Kazor, 31475 Ute Ave., addressed the council and voiced his concerns with storm water control and possible run-off, ground saturation, erosion, changes to groundwater levels, and septic system issues impacting his adjacent property. He has been assured by the City that storm water will be monitored, but voiced his concern that the developer has yet to apply for an Iowa Department of Natural Resources storm water permit. Mr. Kazor added that he does not oppose the rezoning application, but is concerned with how the development is planned regarding storm water control. In response to some of Mr. Kazor’s comments, Mr. Deets noted that storm water management is not addressed during the rezoning process, but during the subsequent preliminary platting and construction plan development. Construction drawings include storm water and erosion control measures that are implemented both during and after plat construction. Council Member Lyon stated that Mr. Kazor has valid concerns and encouraged him to continue monitoring the situation as the development progresses. Mr. Deets replied that City staff met with Mr. Kazor recently to discuss his concerns and that they have offered to review the preliminary plat and construction drawings with him when they are submitted by the developer. 3) On an ordinance to amend Chapter 301, Zoning Ordinance, City of Waukee, Iowa, by rezoning and changing certain property therein from A-1 to R-2, a property to be known as Ashworth Acres – Mayor Peard opened the public hearing and asked if any written correspondence had been received; City Clerk Schuett replied in the negative. Development Services Director Deets reviewed the rezoning application, including lot sizes and plans for a future elementary school site. Parkland dedication would be adjacent to existing parkland, which does not abut the proposed school site but provides good connectivity to the school. Mayor Peard invited public comment on the matter: 1) Erin Ollendike with Civil Design Advantage (CDA), introduced herself as representative of the developer. Council Member Hughes noted the unusual distribution of parkland in the area; Mr. Deets replied that the proposed park would be a decent size, but agreed it had a unique configuration. Parks and Recreation staff have reviewed the parkland proposal and have no major concerns. Council Member Lyon asked if there was a way for the developer to the north to relocate their parkland dedication site to abut the existing park; Mr. Deets noted the difficulty in doing so, as the plat to the east has already been 3 approved. Council Member Hughes asked if the Waukee Community School District had already purchased the elementary school site property; Mr. Deets responded that the school district was in the process of purchasing the property. 4) On an ordinance to amend Chapter 301, Zoning Ordinance, City of Waukee, Iowa, by amending Chapter 301.4, Establishment of Districts: Provisions for Official Zoning Map, by repealing said section and enacting in lieu thereof the readoption of the Official Zoning Map – Mayor Peard opened the public hearing and asked if any written correspondence had been received; City Clerk Schuett replied in the negative. Development Services Director Deets reviewed the zoning map updates, noting that it was last updated in March 2016. No comments were made by the public present. (I) Public Hearing Action Items: 1) Ordinance: Consideration of approval of an ordinance to amend Chapter 301, Zoning Ordinance, City of Waukee, Iowa, by rezoning and changing certain property therein from C-4 to R-4, a property to be known as Prairie Crossing Townhomes [introduction; first reading] – Council Member Lyon introduced the ordinance and moved to approve the first reading in title only; seconded by Council Member Bergman. Development Services Director Deets recommended approval of the first reading, pending completion of the noise mitigation agreements prior to consideration of the final reading.
