regarding proclamation and publicity of snow emergencies [second, third
(final) readings]

STAFF REVIEW AND COMMENT: City staff recommends approval of the second reading of
the ordinance in title only and waiver of the third reading. The Code of Iowa
requires a vote of not less than three-fourths of all the members of the council
(or 4 out of 5, in Waukee’s case) in order to waive readings of an ordinance.
RECOMMENDATION: Approve the second reading in title only, waive the third reading, and place
the ordinance on final passage.

AN ORDINANCE TO AMEND CHAPTER 502, WAUKEE MUNICIPAL CODE,
TRAFFIC REGULATIONS OF THE CITY OF WAUKEE, IOWA, BY AMENDING
SECTION 502.17, PROHIBITED PARKING DURING SNOW EMERGENCY,
REGARDING PROCLAMATION AND PUBLICITY OF SNOW EMERGENCIES
WHEREAS, Waukee Municipal Code Chapter 502, Traffic Regulations of the City of
Waukee, Iowa, Section 502.17, Prohibited Parking During Snow Emergency, empowers the chief of
police or his designee to declare and promote snow emergency parking bans; AND,
WHEREAS, the City of Waukee has determined that the public works director or his
designee shall instead be empowered to declare and promote snow emergency parking bans.
BE IT ORDAINED by the Council of the City of Waukee:
Section 1. Chapter 502, Waukee Municipal Code, Traffic Regulations, Section 502.17,
Prohibited Parking During Snow Emergency is hereby amended as follows:
§502.17 Prohibited Parking During Snow Emergency: No person shall park,
abandon or leave unattended any vehicle on any public street, alley or city-owned off-
street parking area during any snow emergency proclaimed by the public works director
or his designee unless the snow has been removed or plowed from said street, alley or
parking area and the snow has ceased to fall. A snow emergency parking ban shall
continue from its proclamation through the duration of the snow or ice storm and the
forty-eight (48) hour period after cessation of such storm except as above provided upon
streets which have been fully opened.
Such a ban shall be of uniform application and the public works department is directed to
widely publicize the requirements, using all available news media, in early November
each year. When predictions or occurrences indicate the need, the public works director
or his designee shall proclaim a snow emergency and shall inform the news media to
publicize the proclamation and the parking rules thereunder. Such emergency may be
extended or shortened when conditions warrant.
This section shall not be construed as suspending parking limitations or restrictions
imposed by any other section of this chapter, except that, in the event of a proclamation
pursuant to this section, this section shall supersede any ordinances in conflict with this
provision.
Section 2. Repealer. All ordinances or parts of ordinances in conflict with the provisions
of this ordinance are hereby repealed.
Section 3. Severability Clause. If any section, provision or part of this ordinance shall be
adjudged invalid or unconstitutional, such adjudication shall not affect the validity of the ordinance
as a whole or any section, provision, or part thereof not adjudged invalid or unconstitutional.
Section 4. Effective Date. This ordinance shall be in effect upon its final passage, approval
and publication as provided by law.
