AGENDA ITEM: A public hearing on the vacation of a portion of a Storm Water Management
Facility Maintenance Covenant and Permanent Easement Agreement [The
Shops at Kettlestone North Plat 1]
FORMAT: Public Hearing
SYNOPSIS INCLUDING PRO & CON: As a part of the final plat approval for The Shops at
Kettlestone North Plat 1, a Storm Water Management Facility Maintenance
Covenant and Permanent Easement was approved which encompassed the
whole property being final platted which includes property both on the west
and east sides of Grand Prairie Parkway. The Covenant/Easement was
established for purposes of conveyance of storm water from the individual lots
within the plat as well as long term maintenance of the large detention pond
that is being constructed in the southwest corner of the plat.
The three parcels located on the east side of Grand Prairie Parkway will not
actually convey their stormwater to the large pond on the west side of Grand
Prairie Parkway. They will be required to provide their own detention and
maintenance provisions for a pond/ponds as the individual sites develop.
The proposed modification to the existing covenant/easement is to remove the
three parcels on the east side of Grand Prairie Parkway.
In order to dispose of the easements, the City Council needs to hold a public
hearing on the vacation.
