RESOLUTION 18-
APPROVING THE VACATION OF A PORTION OF A STORM WATER
MANAGEMENT FACILITY MAINTENANCE COVENANT AND PERMANENT
EASEMENT AGREEMENT ACROSS THE SHOPS AT KETTLESTONE NORTH PLAT

IN THE NAME AND BY THE AUTHORITY OF THE CITY OF WAUKEE, IOWA
WHEREAS, the City of Waukee, Dallas County, State of Iowa, is a duly organized Municipal
Organization; AND,
WHEREAS, the City has previously approved a final plat for The Shops at Kettlestone North
Plat 1, which included a Storm Water Management Facility Maintenance Covenant and
Permanent Easement Agreement recorded in Book 2017 Page 5162 (the “Easement”); AND,
WHEREAS, it has been determined that a portion of the Easement as described on attached
Exhibit A is no longer needed; AND,
WHEREAS, the property owner has requested that the easement as described in attached
Exhibit A be vacated.
NOW THEREFORE BE IT RESOLVED by the City of Waukee City Council in session this
19th day of March 2018, that it hereby approves the vacation of a portion of the Storm Water
Management Facility Maintenance Covenant and Permanent Easement Agreement across a
portion of The Shops at Kettlestone North Plat 1.
